- Savy8:08 am they called me!!!!! It's Portfolio Recovery and they call from a multitude of phone numbers and area codes around the country. Don't even know what debt they are after and I don't care! If I owe someone, I'll pay them direct and these nuts can just sing for it! I ignore the calls and google the numbers. BUT CALLING AT 8 AM. SERIOUSLY!

- tmw| 8 repliesJust received call from Portfolio Recovery who claims to have purchased an old credit card debt. I told the caller that since the debt has not been validated, she has no right calling me at all. She rudely insisted her collection call was within the rules of the Fair Debt Collection Practices Act. I got their collection notice a few days ago; by certified mail, Portfolio Recovery must validate the alleged debt and stop all phone calls. I want :
A) Copy of original credit card application with my signature
B) Copy of the original credit card agreement
C) Copy of all charges on the account from zero to final balance
D) Copy of the bank charter. To quote McCormick vs Market National Bank, " A contract made by a corporation beyond the scope of its corporate powers is unlawful and void." To quote Merchants' Bank vs Baird, " A national bank ... cannot lend its credit to another by becoming surety, endorser, or guarantor for him, such an act is ultra vires .. ". Does the charter state that the bank can lend its credit ?
E) If original contract is "ultra vires", I owe no debt to original creditor who has no debt to sell to 3rd party debt buyers.
F) Proof that Portfolio Recovery purchased alleged debt from original creditor.
G) Copy of any contract between me and Portfolio Recovery. None ever existed. I DO NOT OWE THEM ONE CENT.
I have been sued 6 times last year. Each time I answered the complaint and served the plaintiff with discovery. Each time the plaintiff's attorney asked the court to dismiss the case.

- Mr UncollectibleThe law should be such that, when the debt is not legally collectible, collection efforts are prohibited.
As it is, unless the debt is discharged in bankruptcy, the can call you thousands times and ask to be paid. This is their business, and some people must be paying them just to not be bothered.
I recommend not answering the phone unless it is a local number, but even then they eventually will have numbers in every area code and can match yours with one of theirs. They have a lot of them. - no debt| 1 replyThey have been calling me a couple times a month for 6 months. First time they called I answered and they claimed I had a credit card debt from 12 years ago with Chase. I said no, I have never had a Chase card and I don't have ANY credit card debt since I don't have ANY credit cards and haven't had any in over 25 years. They said Chase couldn't sue me or garnish my wages but they could call me as much as they wanted. I said no you can't call me if I ask you not to call. So they said they would send me something in the mail detailing the debt and proving it was mine. They never sent it and they keep calling. I keep not answering.

- TessaNoelUghhhh. . . . I am so sick of these creeps calling. Somehow they got my cellphone number. I just add them to the Reject list and then they call from a different number. Hopefully they will exhaust all their numbers before long and can't call me. I can see from other posts that this is Portfolio Recovery

- Phone bugPortfolio has called me for about two years now. I have never taken any call from them. Now they seem to have given up. The last call was from this number, about three weeks ago. The used to call 10 times a week, then 5 times, then just one or two. Now it is a few per month. By Portfolio; now get a real job and offer real products or service that people want.
It seems they give up after about two years, but IF you answer they will keep calling you in hope of shaking you down for money. Stay off the phone; you can not win. Those people are trained not to take "no" for an answer.- Caller: Portfolio Recovery.

- Anonymsue them, call your state attorney general , or those sights you see here, where it says Mad at NCO, they are a consumer group and you get a 1000 dollars , keep all records of calls, they have been calling me for over 3 years about a 250 dollar credit card bill from 1997, they are scum bags, and what they are doing is illegal , it is also illegal for them to call your cell phone doing this, and also illegal they will not identify theirselves and why they are calling. My paper work has been filed at the county court house already

- shayeWhen asked who is this...the caller said cory. Like we're old friends or something. I knew I didn't know him so I just let him talk while I laid the phone on the counter and continued reading my e-mail. Pisses me off when they don't say what company they are calling from. I got into an argument with one because when I asked who she represented she kept asking me my name......I was thinking you called me, it's like a stranger knocks on your door. Its a curtousy to say who you are and what you want before I open the freakin door.
