- Diva replies to ChristyYou do NOT have to pay your ex and deceased husband's electric bill, or ANY of HIS bills after you were divorced, unless ordered to do so by the courts, or your name is on the bill. Also, debt collectors MUST stop contacting you when you demand that they stop - even if you did owe the money. Failure to stop harassing you - and it IS harassment is a violation of a Federal law known as the Fair Debt Collection Practices Act (FDCPA). Whether the debt is yours or not you should send them a cease-and-desist letter, sent by certified mail, to the collection agency advising them that they may not contact you. When the collection agencies receive the certified letters, they can’t contact you, again, except for two reasons: 1st) To notify you that they've received the letters and won’t be contacting you again; 2nd) To notify you they intend to take a specific action against you, such as filing a lawsuit. Since this debt is NOT your debt, you can sue them for harassment. Keep track of all their calls and the times. Taking photos of your caller ID when the calls come in is great evidence. Keep track of any out of pocket $ spent trying to resolve this issue, i.e., loss of income because you had to take time off from work, getting copies of divorce decrees, court orders, etc. Want more info? I am going through this crap right now with Portfolio Recovery concerning debt incurred by someone who used to have my phone number over 3 years ago. I am getting ready to sue these jerks. Even though the people who used to have this number may still be giving it out as their number, that does NOT absolve debt collectors from violating the law concerning phone contact.
