    They call once every three days.  Some days I just let it go to voice mail, others I have just a bit of fun with but not too much.  I don't bother to let them rile me up anymore. Sunrocket DID comes up on caller ID, but it's actually Portfolio Recovery.  Yup, I'm one of those lousy, dead-beat, scumbags who doesn't pay her bills. They are trying to collect on a Capital One, credit debt from late 2000 to possibly sometime early 2001. Fell behind in everything, when I had to take use the Family Medical Leave Act, and as usual, short-term disability policies are pretty worthless. No money coming in. No pay bills. No choice. Sad part? I took that cute little insurance policy on the credit card that was supposed to pick up the payments on the card if the person became disabled. It didn't. So now, portfolio has been calling me a year or so, every couple of days. If it goes to voice mail, all I get is dead air. If I answer the phone, after waiting a few seconds, someone will come on the line. I allow to go through their whole spiel. I remember the first name of the person, and the minute they say they are from Portfolio, I politely (usually) say.. "Have a Nice Day <insert name here> then hang up the phone.  Hey, right now it works for me.. and I am sooooo looking forward to all those people out there that choose to tell us what scum of the earth we are for having debt collectors harass us. They take the time to read these things.. Do they enjoy wasting their time? I guess so..

    If the debt is more than 3 years old and the account has had no activity in that time it is most likely past the time it can be legally collected in most states, unless they can provoke new activity by getting you to make a payment. Check out the statute of limitations in your state!!

    Alwayz Have A Nice Day, I went through the same thing you did and now I have these zombie debt collectors after me.  If someone thinks I am a deadbeat well all I can say is let the who person who is without sin cast the first stone.  I too have fun on occasion.  When they ask for me i tell them various things, for example once I said in a very dignified voice, "I'm afraid he is not in.  Would you like to leave a message?"  The caller asked rather rudely, "Who are you, a sibling?" and I replied, "No, I'm just the butler." LOL

    Current regulation states that after seven years of "no activity" on the account it must be removed from your credit report. However, if the company sells your account to a debt collector, updates any info or you speak to the collection agency, this is considered "activity" on your account and the "seven years" starts again. these collection companies are also restricted as to the times and locations that they are allowed to call. They can not (legally) call you at work or speak to anyone else about your debt (including a spouse or other family member). They can not call before 8:00 am or after 9:00pm. Also, Robo dialing is illegal! This is where the computer calls your number. In other words, when you answer the phone it takes a minute for someone to come on the line. If you experience any of these issues, report it. Each and every time! They get fined heavily for each occurance.

    They are scavenger debt collectors. The debt I allegedly owe is at least 13 years old. And goes back to an ex husband. Hows that for statute of limitations? They have 20 different names & numbers so its just abt impossible to block. They call 2 or 3 times in a row a couple of times a day.

    Calls about 3 or 4 times a week, for the last 3 months, at least. If you answer no one is there. And never leaves a message, hangs up when answering machine comes on.

    I get calls all the time from these people,I tell them everytime that I am not the person they are looking for, because my identity was stolen.They want my date of birth and ss# I tell them no but they insist they need it....I ask "What for? "Don't you understand the person that got the credit card in my name, used my info it is not me that owes this do not call me again"....I filed police report on theft and reported it like I'm supposed to do!" but they still call me...What can I do about this?     These people do try to aggravate you they are a collection agency In My case they have bought some old paper on me that has been closed for over 11 years and is not able to be collected. all that has been ajudicated and does not show on my credit report at all. What can be done to stop these pest

    Once the 7 years expires, they cannot put the information on the credit report just because the sell the debt to a debt collector.  If they could, the debt collectors would be selling every single debt they own between themselves every 7 years so that the debt could always be put on the credit report.

    Also, just talking to the debt collector won't allow them to put it on your credit report.  However, you must be careful what you say, because they are probably recording the conversation.  If you agree that you owe the debt, or that you will make payments on the money owed, then the clock starts again, and they can put the bad debt on your credit report for another 7 years.

    The collection agencies use all sorts of legal tactics to get you to agree to pay even a little bit of money, since that will start the clock againl  I dealt with a collection agency about 10 years ago, and they said I owed about $7,000 on a car that was repossessed in the late 80's, which included around $3000 for the amount that was defaulted, and $4000 in interest and penalties.  But, if I agreed to make payments on the debt, then they would waive the interest and penalties.  Since they probably bought the debt for less than $300, anything above that would be pure profit.

    The best thing to do is to not to talk to them, and to tell them to stop calling you.  If they continue to call, then you can report them to the FCC.

    If it's after the 7 years, and they put the collection on your credit reports, all you have to do is dispute the entry to the credit bureau, telling them the credit is over 7 years old.  The collection agency more than likely reported the date that they bought the debt to the credit bureau because they know that they would not include it in the credit reports if more than 7 years old.  Once you report the entry to the credit bureaus, they will contact the company that reported the debt.  Unless the company can provide proof that the debt is less than 7 years old, the credit bureau will remove the entry.

    I was enjoying my beautiful Sunday afternoon when these SOB's called me about a debt that is so old that Crapital One does not have it on it's books. She tried to get me to tell her how long I have been collecting unemployment. I told her that was not any of her business. Then she said something to the fact that she was trying to help me with a repayment. Well, I lost it. I mean, people are trying to pay for the "bare life necessities." Who gives a dam about Crapital One of the Portfolio Recovery!!
    Hey, why don't they recover some REAL portfolio's!!!!!!!!!!! Like the ones that people lost when the stock market crashed!!!!!!!!!!!
