    I received several calls from them about Cashnet.net

    Are they legitimate or not? Yes I was with cashnet and they told me to ignore all calls like that. They told me they would send paperwork in the mail for balance due money. I have received from all types of bogus companies which are looked into by federal trade commission. This one claims to be NCW National Cash Works LLC and they can call themselves anything.
    I do know that there is a huge network in NY with scams in which I have talked to at least 3 or 4 calling me in the past.

    they keep calling EVERY NIGHT around the same time, i ignore their calles, and they will call 4-5 times in a row...... is there a way to stop them?

    This # belongs to Actionable Claims Processing. A debt collection company that specializes in abusive tactics to recover payday loans. They will tell you they are a filing firm. They are NOT. They will tell you the next step in your case is to pursue it legally. They Won't. They will tell you you owe more than the actual balance and claim it's the fee for a process server. When they give you your balance they will try to claim that they can settle your account without charging you for the " Paperwork". Their is no paperwork ever issued to your local county clerks office. This company will never sue you in any way shape or form.
    Get in contact with your local county clerks office and you will see that no paperwork has been filed under your name and social.
    The collectors of this company use alias's instead of their real names. Dan Clark is actually Jon Jablonski. Mike Thomas is actually Mike Jablonski. Marshall Keenan is actually Matt Sehm. None of which follow the guidelines as stated in the FDCPA.
    Here is important information to defend yourself.
    The actual address for this company is 189 North Water Street in Rochester NY. Not 621 Park Avenue.
    The office is run by an actual New York Licensed attorney named Mike Jablonski and his brother Jon Jablonski. When they call you it's your right to inquire for an attorney that you'll never get. So, Here is the actual law firm that Mike Jablonski works for.Woods Oviatt Gillman LLP. 2 State Street  Rochester, NY 14614.(585) 987-2800. When you get these calls from this # return the favor and call them at their actual place of employment. You should let the law firm know your getting debt collection calls from Mr. Jablonski and you want it to stop. Inform the partners of this law firm. However all the information regarding this company is not under his name it is registered to Dan Olcott who also is the owner of Portfolio Recovery Group on Grand Island NY.
    This company will call your family, friends and your work to try and get you to pay a loan back.
    Under no circumstance should you pay this company. Instead, record all conversations and turn them over to an attorney. This company violates the FDCPA in every message they leave. You will never hear them say " this is an attempt to collect a debt and any information obtained will be used for that purpose" This is known as the Mini Miranda and is required to be said in every debt collection call anywhere in the united states. Contact the New York State Attorney Generals office and the BBB to report this company every time they call you. New York has a strict collection policy and this company does not follow any of it. They will impersonate process servers and then when you call in and the guy that claimed to be "Serving" you is right next to the person your on the phone with.
    Payday loans all have a statute of limitations in which you can collect the debt. The time limit varies by state. Inform yourself of how long that time is in your state. You do not have to pay this company. Instead contact the payday loan company. The loan company will tell you your debt has been placed with a collection agency. Payday loans are never placed in an actual attorney's office. To sue you is far more expensive than to try and convince you they're going to sue you. The only way it's worth suing someone is in a wage garnishing state and even then they won't get their money. The payday loan will NEVER be on your credit report either.     Thank you so much for revealing the true colors of these scammers!  I cannot tell you how happy I was to see this post as they have scared my friend to death...  My friend actually set up payment arrangements with these quacks after I told him to wait until I had a chance to check into the situation...  I hope this isn't a problem!  I have read they record all of their messages and I am concerned that his making arrangements with them has locked him into a commitment...  Please tell me this isn't so!!  Thank you again for posting this information.  You have made our day a little less stressful!!

    I'd cancel the payment arrangement on the basis that they misrepresented themselves, you were not advised of your rights or informed of their true identity, and not given the Mini Miranda (which Educate Yourself mentions above). Tell them that agreement obtained under duress or misrepresentation is not a valid agreement.

    Then call your bank to confirm that you have withdrawn authority for this crowd to make deductions from your bank account/credit card and all that this be noted.
