I got a call and was told that there was a lawsuit for $4035 pending from Capital Bank for a credit card bill from 2003 and was told that I could make a settlement of $1700 but I had to make a down payment of no less than $500 by tomorrow at noon. Is this a scam????

Yes it is a scam! Process serves do not make appointments to serve you papers. They catch you off guard. That's their job. No one wants to be served, they surprise you. And you are the only person who knows if you have been in any trouble . And if you have had a ticket, domestic dispute, or suing or being sued, ETC.,  No One  is going to call you to tell you you missed a court date. Except maybe your personal lawyer. Hell that's how the court system makes money here in Harris and Montgomery Counties!

Just got a call earlier from one of their verification agents. Funny thing is the call was in Spanish. I asked the verifier about the court case and she wouldn't give me any info. I *67'd the 855-309-0252 number and after I was connected to someone, asked what number they had for me on file and they said they didn't have one. Weird. They knew my number and my telephone number, though I'm using a Google Voice number and I just happened to change my PTN this past week.

By the way, I'm in the County of El Paso, TX and the court date is in California.

The guy told her i was in danger of going to jail if i missed this court date and said someone over 18 needed to appear with me in court? first ive heard of that why would i need someone to go to court with me? They have everyones elses number but cant find mine, ive had the same number for 10 years. SCAM,SCAM,SCAM!

I received a call today from my ex-husband who had received a call on his cell phone from AG Financial looking for me regarding a bad credit card debt in 2007.  I haven't never received anything from this company in writing and have never had any contact regarding a bad debt until today. They told me if I didn't pay $400 today and make payment arrangements of $100/month until debt settlement of $974 has been paid, I will have to appear in court and my wages would be garnished. I called the Federal Trade Commission and made a complaint against AG Financial. The person I spoke with advised me that if they call back to send something in writing-they have 5 days and she advised me if they ask for my address to tell them, you have my credit report, you have my address.  This is a SCAM!

I have been receiving calls from these people stating they have a summons for me and there had already been one failed attempt.   I looked on my county court website to check if there is any case filed against me.  There is not.  I also checked my previous county fot the same thing and there isn't one on there either.  I finally called this place back to find out what debt this was and so on.  I told them that I had checked and there was no case filed.  They stated there wouldn't be unless I had been served. I told them that it would still need to be filed in the court for the summons to even be issued.  He kind of skirted the subject.  Went on to find out this is a debt from a credit card that I last had in 2005.  The last payment I made was in 2006.  I checked my states statute of limitations and it is 4 years.  The company is saying this debt is from 3007, but it isn't.  They said they were willng to cut the payment down to half and willing to split it up in two payments.  I told them I would need to verify the debt before I admitted to owing anything.  This debt was written off from my credit card company.  This man stated that a group of investors bought this account and how they don't make any money from the little people.  He said they won't make any money with the deal I was offered.  So, my question to him is then why bother. You aren't going to make any money, but you are willing to sue me if I don't pay it.  Makes no sense.  I knew from the beginning this was a scam.  My suggestion is to check with your state and find out what the statute of limitations is for your state before agreeing to pay anything..  I believe Minnesota is the only state that can have a summons served without going through a court first. You want to check that out too.  Also, a lot of the info they have, such as previous names if married, phone number, and so forth is on your credit report.  Since they do have bought the delinquent account, they are able to access your credit report.  I know it is scary, but that is what this company is relying on.  People being scared and giving them money.  Don't fall for it.  Do your research and then decide how you want to proceeed from there.

    Don't be Deceived
When you call the number 855-309-0252 the person answering the phone will claim that it is a litigation law firm.  However, the tactics used to get someone to return this call are illegal under federal legislation so it is highly doubtful that this is a legitimate law firm!!!!  DO NOT RESPOND TO THIS TELEPHONE NUMBER NOR GIVE THEM ANY IDENTIFYING DATA ABOUT YOURSELF.  THEY ARE MOST LIKELY A COLLECTION AGENCY.  THE MAJORITY OF CALLS THEY MAKE ARE TO PERSONS WHOM CAN BE FOUND AS ASSOCIATED WITH ANYONE OWING A DEBT TO A BANK OR CREDIT CARD COMPANY.

I got a call on Monday Oct 3 from 855-309-0252 and they said they were a process server ready to serve me papers at my residence for a credit card debt. I never heard of any credit card company doing that. They said i will have to appear in court. They said they will have a court official with himself ready to evaluate any property I may own to satisfy this order. Well they supposed to be here today between 4 pm-12 noon. So far noone has come and i got no further calls from them since Monday. I hope it is a scam and that they don't show up I will keep you all advised.

A guy by the name of RICK DAVIS said he was from HEF Company and that he was calling concerning a credit card I had opened up in 2008. I didn't live in Ohio at that time and he said that this is where this claim is coming from. Sounds a little weird to me.

THIS IS A SCAM. I use to get calls saying the same thing. I looked up my record here in town at our local court house and there is NO suit against me. I even went as far as to call the police. The gentleman from this company said that I would be in jail by Christmas time, etc. The police said not to worry and if someone showed up to serve me papers to call them and they would deal with him.
