SPOKE TO A GUY NAMED DOMINIC LAST WEEK AND I TOLD HIM WE HAVE GOT TO MAKE SOME KIND OF ARRAINGEMENTS AND WE DID, BUT I KEEP GETTING PHONE CALLS FROM MARK SAYING WE WILL BE ARRESTED IF WE DON'T PAY. I CONTACTED MY ATTORNEY TO HAVE THEM INVESTIGATED.

- TrinnityInvestigator Mark Sehwar called me just over two weeks ago and told me that I had two weeks to pay my debt off in full or he was going to send the paper work to the County Court for defrauding a financial institution. I told him that there was no way I was going to be able to make the payments in two weeks on what he wanted me to pay. Which totals over 1600 dollars, even though before his collections bought the account it was just over 600 dollars that I owed. I took out the payday loan from Cashnet USA in August of 2008, and I am aware of that and have full intentions of paying back my debt, but I am not in a financial position to pay this company 1600 + dollars right now and am struggling to pay my own bills and keep a roof over my head. After calling me on one occasion, he then called my grandmother and told her that she needed to pay the bill for me and that she needed to help me with my debt. And he told her the amount and that I had bounced a 1600 + dollar check. He told her everything he should not have told anyone but myself. I gave him information to take 200 out of my checking account but was unable to come up with that money as I had to pay my rent and so he then proceeded to try to take out the 1400 + that I was trying to come up with without calling me first to inform me that the other check had not gone through. If he had, I would have told him that the money was not going to be in there because I could not find a way to get that much in a short period of time. I work 40+ hours a week and make 400 dollars a week take home, at which point I have to pay rent, and and my electric and gas bill as well as my car payment and have enough money for gas for me to get to and from work. My husband is currently unemployed and so I do not have help from him in paying bills. Investigator Sehwar proceeded to tell me this morning that he knows my husband and I both working and that he doesn't care that I had to pay rent to keep a roof over my head because all he cares about is getting paid by me so he gets paid by the company he works for. I am extremely irritated with this man. He is pushy, rude, and does not respect anyone. He called my home at 6:30 in the morning on Monday 6/15/2009. He thinks that because he is three hours ahead, he can call when ever he wants to because it is within the time frame for where he is at. So, he is now giving me until 3pm EST today (6/17/2009) to call him back with full payment or he is going to send the paperwork to riverside `so fast that my head will spin` and those were his exact words. He also told me that the day my husband spoke with him when he called that the judge was going to laugh because my husband cursed at him numerous times. Well, that was because Investigator Sehwar would not let my husband speak and kept on cutting him off. And at the end, Investigator Sehwar finally hung up on my husband because he did not want to hear anything else he had to say. I do not know what to do about this person and am extremely irritated as well as worried that I am going to get arrested for what he is saying and that he is going to send this paperwork to the courts. Two weeks ago was the first time I had heard from this company and this is what it has all been. I also called him and asked him for his license number since he claims he is an investigator and he told me that he doesn't have one and that he isn't really an investigator and that he works for a bank, but when my husband talked to him and asked him the same thing he told my husband that it didn't matter and that he was an investigator and doesn't work for a bank and that he is an investigator that finds people and gets the money owed the company. My husband asked for his license number and he told him that didn't matter. I am, again as I said before, extremely concerned that this man is going to send paperwork to the courts and that I am going to be arrested. I do not know what else to do at this point and I have no way of paying this debt back to him by 3pm EST today(6/17/2009). Also, I took this loan out when I was living in Utah. Not here in California. After which I lost my job and was barely able to pay all of my bills and survive off of what the new job was paying me. And after which my husband then lost his job and still has not been able to find work. Investigator Sehwar also told me that I took the loan out in 2008 and my husband believes he told him 2007 but is not certain.

- 2 Steps Ahead| 1 replyOkay, so here's the deal. These people tried calling me as well, singing the same song to me about warrants for my arrest, sheriff's on their way to my office to arrest me, class C felony charges, theft by deceit, you name it. So, I listened. And let them talk all the trash they wanted, because I was recording the whole conversation. After they were through with their barrage of threats, I kindly told them I wasn't the person they were looking for and that they had obviously made a mistake. Like all the other people on here noted, that just pissed him off even further, causing even more colorful words and insults to fly.
The great part is, I have family in all facets of litigation - from Justices to Lieutenants to Assistant D.A.'s and even some extremely successful attorneys - not only in the city I reside but other much larger cities as well. I also know my rights as a citizen, and have made quite a few phone calls to investigate this situation as far as possible. Hence the name, 2 Steps Ahead.
Here are my discoveries: I played this recording to anyone in law enforcement that I know personally and who would listen. Most thought it was a riot, but some also felt offended at the choice of tactics and words that were used. There is something called the Fair Debt Collection Practices Act (http://www.ftc.gov/os/statutes/fdcpajump.shtm), in which they refer to these types of tactics. Ladies and gentleman, THEY ARE ALL ILLEGAL. Also, there is NO SUCH THING as a CLASS C FELONY!!! There is a Class C Misdemeanor for which a collection agency of ANY kind cannot file as it is completely beyond their jurisdiction and would cost WAY too much money to do so, even IF they could. Furthermore, THERE IS NO SUCH CHARGE as "THEFT BY DECEIT"!!! I was almost laughed out of the police station with that one. Yes, I did say POLICE STATION. Because my facts are backed up by REAL, MULTIPLE LAW ENFORCEMENT AGENCIES who will hear nothing of this recording, and I have attorneys foaming at the mouth to start a class action lawsuit based entirely off the ONE recorded conversation I was able to capture. There is also something that many of you have referred to, which is filing a complaint with the FTC (https://www.ftccomplaintassistant.gov/). If enough people do this, with the economy the way it is, they will be out of business in no time from federal fines. It literally takes 10 minutes - I did it.
Any business that has a broken down, pitiful website such as Marval and Associates, and then doesn't have a physical address listed anywhere is definitely a company to be questioned. To compound the situation further, ANY LEGITIMATE COMPANY has a listing or record on the Better Business Bureau National Website (http://www.bbb.org/us/Find-Business-Reviews/). There is NOTHING listed for Marval and Associates.
If this doesn't answer your questions about the tactics you are experiencing, then I really don't know what else to tell you. The only thing I WILL waste my time on is a class action lawsuit against these guys - Anyone interested??- Caller: Marval and Associates
- LynneI received calls at work after they had been told that personal calls were not allowed at my place of business. They stated that did not apply to them as they were legal. I was also told that the Sheriff would be coming to serve me with a supeona and that I would be arrested on a Class C Felony for defrauding a finanical institution ( on a payday loan). They gave me 24 hours to pay. Incidentially, my payday loan was received on May 1 for 290.00, they now want to collect in full 973.00........ I called the Pay Day Loan company I dealt with and explained that I truly thought this had been paid, as I don't use the account involved much. They told me that Marval and Associates was just a collection agency and I started to tell the Representative about what the "Investigator" said. She actually jumped in after my first comment and repeated what she thought he would be threatening me with..... She said that he is not to be worried about, nothing will happen like that. I told her that I fully wanted to pay what I owed. She told me to ask the person at Marval for the City Governors Office Phone Number and they would hang up very quickly. She said it is just totally a scare tactic from a collection agency. It's still a bit scary. They will, by the way, according to the payday loan people, take payments........and unfortunately, the total amount that Marval states will have to be paid.........but to ask for a complete itemized bill, and then you will pay. I have received nothing in the mail from these people, she said their threats and tactics aren't legal!

- RobertWell I didnt recieve a call from the same people I think. My mother recieved the call because my phone number had een changed in the past due to other rasons but anyways I called the people back claiming to be a private processor and that I had a case number and they were trying to serve me papers to appear in court for defrauding a bank or federal institution. I asked him how and he explained that I had a bank account and applied for a payday loan and then when the time came to collect the payment they are saying that that the bank account was closed and that this was intentional. The truth is I didnt close my bank account it had been closed to other issues that I was having I had lost my job I made the mistake of doing a few payday loans but my account was closed by Bank of america due to other reasons not to just stiff the loan place. They said if I paid the payment of 1700.00 before the time they reciee the papers of Dudilligence or something he said that the case files would be deleted fromt he system. IS this legal is there something I have to worry about. I intend to pay the payday loan place back but I am still looking for a job in the economy right now and I kind of freaked out. is there anything I can do as a word of advice should i call an attorney is there certain laws in Arizona that I am not aware of. help.
- MarshaReceived a call from 1-877-252-0491. Told me he was an investigator looking for me and that he has a warrant for my arrest for theft by deception. He said it was probably a minor item that could be cleared up. He made payment arrangements with me. Since when does a law enforcement officer make payment arrangements on an overdue payment? He sounded official and gave me his id number and recorded our conversation. I am so scared because I could lose my job.

They're doing business in NY unregistered. They specialize in 3rd party pay day loans, and try to hide the fact that they are collectors.
Learn the FDCPA (15 U.S.C. 1692 et seq) and use it. If they break it, they're liable to you up to 1000 dollars in statutory damages. And trust me, they'll break it.
Among other things it's illegal for a debt collector
a) not to tell you they're a debt collector
b) tell you they can have you arrested, your wages garnished, or that your actions are criminal
c) use abusive and intimidating tactics to collect a debt
d) Generally threaten to take any action that they cannot legally take or intend to take.
If they break this law www.naca.net is a great place to find consumer lawyers who stand up against these shady outfits. - brian ConnellyThis mark guy has called me too, he always says I am being sued. Said he had an "Act of David" for me......think he meant affidavit .....This guy only calls from private numbers or pay phones and never shows up to deliver this legal paperwork. Beware he is a con artist trying to scam money out of people. NO LEGAL debt collector, or process server would ever use such means or not know the legal terminology that was necessary for them to do their jobs. I was a process server years ago, you just show up and have them sign. Not make ridiculous threatening phone calls, and not a one is authorized to make a settlement on behalf of a creditor. HANG UP ON THIS GUY, report him to the police and give them all the numbers he has called you from or left for you to call.
- LUEserWell I've gotten an offer of settlement from these guys, it took actually filing a complaint to do it. Now time to see how this plays out. Complaint asks for 91k, Asking for about 1/10th of that. ;)

- SickofitThese people are ridiculous. I got a call today and I don't even know who they are! They said that I am going to be sued and this and that. It's funny to me because the people that call from this number sound uneducated, unprofessional, and downright lowlife. It's pretty sad when you have to work a job that's described as harassing other people for money. I will be getting my number changed today. I don't even live in the same vicinity that this so called business is located in. I live across the damn country! People are relentless for cash and will stop at nothing to get it. It's so sad...and pathetic.

They told her that if I didnt get back to them asap they were going to file a case against me. They also told her that they got her information by hiring a PI. I am currently stationed in Iraq and the last thing I need to be worried about is some crap like this. The info you provided was a big help.

- MeMe85I recently received a called from this number saying I took out a loan in 2008. The guy even had my ss# but I never took out a loan from bank of america. I went to the bank nothing was in the system about a loan. I did a credit report nothing was on it. This guy is runnin g a scam. Thanks for the posts at least now I know the truth about this caller.

He told her I owed $1400+ due to 6 years of interest. What a crock. I may have taken out a loan at that time, but I always paid them back in case I needed to borrow again. He told her he had to get a letter to me within the next 24 hours to avoid prosecution. I tried to assure my mom even if it was a legit "debt" which I am most positive it is not, they cannot take any action against me and it was a collection tactic and what they were doing was illegal. I was a collector for over 5 years and certified with the FDCPA...I know my rights. They prey on people who do not know the law. 1-you cannot prosecute on a post dated check 2-I live 6 states away, if I did indeed owe this debt, I doubt I would be expedited over less than $400 3-their tactics are illegal, by law, you cannot threaten to take an action that cannot be persued!!! The name of the company is Rosenthal and Levine Associates in Ohio Cleveland and they are ignorant of their own demise. Unfortunately, I know it works on some people but please do research and arm yourself before communicating with these idiots. After I stated the words "post dated" and refused to pay unless it could be proven that I owed this debt, all the guy kept saying was ...good luck in court, I said ok and hung up on them. Tony had "just" stepped out of the office. DO NOT deal with these people, he admitted they purchased these accounts from the pay loan company, therefore, they are ONLY collectors, and manipulating ones at that.
