They do not care whether you owe money or not, but will attempt to collect based on what they have given by their clients.
Review your rights under the Fair Credit Reporting Act and cite in a letter to the company you deny their claim and claim your rights. They must relinquish information on the bill you supposedly pay and listen when you tell them not to call. They must take their claim to court or give up.

FMS collects on defaulted student loans It is not a credit card co. these are federal debts owed to United States Government so you guys keep telling these people not to answer who are they hurting no 1 but their self! Point of the matter is when these people took out these loans they were happy to go to school but when its time to pay back they wanna run, keep ducking and dodgeing it will never go away non dischargeable thru Bk and no statue of limitations!!!!!!!!! just instrest and penalties fees!! add on keep not paying they dont care they still get paid

Bull crap. They do more than student loan collections. They collect debts on credit card debts that are beyong statute of limitations as well. These goofnuts used to call me and I never had a student loan but I did have a chargeoff thru credit card which I settled. They in turn bought the remaining balance and attempted to collect on it even though it was 8 years ago.

If you look at their website, you can clearly see that they collect on more than government loans. They also collect on healthcare, utility company and bankcards/retail cards. Its not just student loans. You're right that they are not a credit card company but they do collect on credit card debt. People who don't owe debt shouldn't be harrassed and my experience is that debt collectors don't care whether they've reached the right number or not. They assume the person they have reached is lieing. I've been harrassed in this matter as well. I've already filed a complaint with a state bar on agency for forging the name of a deceased attorney to a letter sent to me to collect on a debt my ex husband owed before we were married. If they're willing to do that, they really don't care about obeying other laws either. - unknown replies to Ricky BobbyYes I understand ppl are sometimes irresponsible but less not ASSume it's that. These ppl make profit by getting you to refinance through them. When you go on student loan site, their name appears NOWHERE. I have refinanced my loan and these [***] are still calling me. They need to get a life and stop asking me for my debit card number.

They asked for a certain person and I informed them, they had a wrong number. They continue to call, but with a different person calling and a different number. I turned them in to the do not call registry. Still waiting for them to stop calling.

- threadbareMy fiancee has received calls from this company regarding a credit card debt on a credit card he never had. These people are extremely persistant & rude. We checked with Clark Howard, who does a spot on Headline News. One of Clark's financial advisors sugessted sending what he calls a "drop dead letter" to them (you can get a copy of it at his website). Don't know if it will be effective or not after reading these posts, but we will try. Perhaps those of you who are getting harrassing calls from this company will be helped by trying to send one of these letters as well. You can do a search to find Clark's website & a copy of his "drop dead letter."

For instance, we were promised certain items that the school never fulfilled, one was a laptop computer for ALL IT students. Never got it! Also, The school did not have the updated books for the courses we were taking. They gave us the wrong books!!! So we refused to pay. The school shut down. This was in 2000. You need to relax, OK? We dont owe nothing for some bBS courses. Why should we? We reported them and they got shut down!!!! HOO-Yahh! It's [***] like you that cause revolutions to take place.

First of all, this s of course a legit company, contracted by the United States Department of Education directly. They do not do their own collections so they have 17 agencies within the U.S that does this for them. We do not get any of the money that we collect, we make government wages for working for them however, which is where the perks are. All the funds go straight to the federal government, and if you were in a payment program on them you would know that because it shows that on bank statements and credit card receipts.
The company does a few things. One is collect on Sallie Mae student loans...thats in one sector. In another, you have a group that calls you BEFORE your student loans default and they try to help you STOP that from happening. In most cases it is by giving loan holder a forbearance or deferment. But since some borrowers tend to never pay the 8-100 a month it costs to stay out of default, they get transferred to my dept..the Department of ED.
Here is the thing. Some people have it in their minds that we can not touch you if you hang up, refuse to verify your identity, or refuse to pay. Even a cease and desist. This will actually speed up the process for 3 things. 1. AWG administrative wage garnishment. This allows the government to garnish your wages up to 15 percent of each pay period, without taking you to court. They send a letter to your employer, who MUST comply or they are breaking the law, and within 30 days of that date you will start the garnishment process. This will continue on until the debt is paid in full, while intrest still accrues, as well as you will be held responsible for collection agency fees (a way the agency gets paid only INVOLUNTARILY..so it PAYS us to garnish you.) We have an in house garnishment department so all it takes is one click and you will be sent there.
2. Federal TOP transactions, meaning...treasury offsets where they seize all or a portion of your taxes at the end of the year. Those of you trying to hide that job from the collector will find out the hard way that the IRS is the government, and that your SSN is attached to everything. Good luck evading that. Some of you will wonder...well my debt is ten years old...why haven't they done anything yet!?!?! Well, you got lucky, and have had the collectors working your account on your side. They can hold on to your account, and choose to not send it back as a refusal to pay, rolling the account over to the next of 17 agencies OR, go back to the department of ED where they will recycle it until a certain amount of time has passed. HOWEVER, this only happens to a select few and I get more calls a day from disgruntled borrowers with 1 to 100k loans very angy that they are getting 500 a month seized in garnishments AND they didn't get their taxes back.
3. Litigation. If you have no wages and you don't file taxes you will be taken to court. That's not a maybe. The reason this can take longer than the other two processes is because the dept of ed tries to work with borrowers first, by offering them payment repayment options that may have little no no payments right away, unless they do not qualify, and seek to resolve student loans as neatly as possible to increase the chances of you borrowing again.
The facts: These are not threats, they are just the process. Only dept of ed has the rights to do these things, sallie mae CAN NOT GARNISH YOU. Also, credit cards, auto loans etc CAN NOT GARNISH YOU without court orders.
If you are under employed you may not be eligible for garnishment at the time, BUT you will still face tax offsets and litigation. That fancy car you drive? Not for long.
FOR THOSE ON SSI AND DISABILITY. the myth is that you can not be garnished. True, but NOT true. The correct term is OFFSET, and they can and WILL offset a portion of those federal funds until the balance is paid in full.
I know what it is like to be n debt, but you can not run from it..and getting angry at the people who try to collect it from you doesn't only make you look ignorant, but it also makes you look foolish. Did you even go to school with those types of remarks???
You were more than eager to take out the loan, and in case you forgot you signed a promissory note..a legally binding federal contract, that states pretty much come hell of high water, unemployment, WHATEVER, you are responsible for paying this debt, and that if you do not these are the consequences. Want a copy of that note? Simply ask the collector, they can have one sent right out to you with those terms and your signature right on it.
Most of the collectors are quite nice, but once you insult them which we get daily, because you get mad at us that you didn't pay your bill, because clearly we made that happen.....you're going to find yourself on the road to involuntary action pronto.
We record and monitor every single phone call made, which we tell everyone, but they still curse and scream and cry and belittle us. We get that things come up and we will work with you to help you out..but we also don't control your payment amounts. Depending on your balance we will attempt to get you the lowest repayment option available...but when you have a 30k loan, your payments can not be 20 dollars, you are in DEFAULT for not paying, and now you suffer those consequences.
HOW TO HELP YOURSELF NOW THAT YOU ARE IN DEFAULT.
The government has a settlement on all account, deleting half of your interest and all the collection fees. This might be a good road for those who want to go back to school and get more loans right away, since in default your financial title 4 funding is cut off. It's also a huge reduction in what you owe. However it's a lump sum and you have only 90 days to complete it. Some collectors will tell you you have less time, but that's because they want to get credit the money they collected to keep their jobs. It's tough and when you can not collect money they will fire you and move on to the next. Truth is truth.
Option 2..loan rehabilitation. Best program out there, hands down. This is a payment program for 9 months where they make min payments to re establish payment history with the gov. You do not pay the whole balance in 9 months. After the 6th payment, your federal funding s reinstated. After the 9th payment(and these must be consecutive) your loan is considered rehabbed and bought out by the original lender, who pays the WHOLE BALANCE you still owe to the dept of ed on your behalf, and you continue repayment with them. At that time, we waive your collection fees and do not hold you responsible anymore. Also, that new lender will give you lower payment options or make you eligible for a deferment or forbearance once more. It also will be removed off of your credit report like it NEVER happened EVEN if it was 10 years ago. This is because it's starting as a fresh loan, so they can not hold you responsible for the past on it.
Then there is ICRP..income contingent repayment program. This is a consolidation program, that you only qualify for if you are below poverty level, receive assistance like food stamps, welfare etc..and have no previous consolidations. This lets you make little to no payments right now, but you must fill out and send back in an application for that where they can approve or deny you. They require proof of income, assistance, and all others of the home as well.
DISABILITY....only and ONLY ONLY ONLY if you are 100 percent totally and permanently disabled and have a doctor who can sign off on that will the government discharge your loan.
In the military, if we report you n default and not paying on the loan, you will be subject to dishonorable discharge, I believe its article 134....you can't work for the govt and owe them...sorry. SO......
