In Clarke –v- Credit Resource Solutions, a Tribunal holds that an employee had suffered a detriment and had been unfairly dismissed for taking time off work to arrange emergency childcare.
Background
Under the Employment Rights Act 1996, an employee is entitled to take a reasonable amount of time off work in order to take necessary action to deal with certain situations affecting a dependant (such as a child, spouse, partner or parent). This right applies to all employees irrespective of length of service. It includes situations such as a breakdown in childcare arrangements.
In exercising this statutory right, an employee must tell their employer the reason for their absence as soon as is reasonably practicable and how long they expect to be away from work. If permission is refused or if the employee is subject to a detriment or dismissal for having taken dependant's leave (or seeking to do so), an employee is entitled to bring a claim in the Employment Tribunal.
Facts
Mr and Mrs Clarke were employees of Credit Resource Solutions (CRS). Mrs Clarke's mother usually looked after their children during working hours. However, on one occasion in 2010, Mr Clarke sought to make alternative childcare arrangements when Mrs Clarke's mother unexpectedly fell ill. On this day, Mr Clarke dropped Mrs Clarke off at work and left to find another relative to care for the children. Mrs Clarke informed Mr Clarke's line manager that he would be in as soon as he had taken care of the situation with their children.
Mr Clarke arrived at work at 10 am, 30 minutes after his contractual start time. When he arrived at work he was asked to sign a 'late form' stating that "I {name} agree to being late (sic) and that one hour will be deducted from my salary at the end of this calendar month." He refused to sign the late form but at the end of the month his payslip showed a deduction of one hour's pay. Mr Clarke pursued the issue with the wages department and became very agitated. The next day, the Finance Manager complained about Mr Clarke's behaviour. This resulted in Mr Clarke being suspended and invited to a disciplinary hearing.
At the disciplinary hearing, Mr Clarke was told that unless he signed the late form, made a written apology and accepted a final warning, he would be dismissed for gross misconduct (on the ground of a refusal to carry out a reasonable instruction and for threatening behaviour). Mr Clarke refused and was subsequently dismissed for gross misconduct.
Mr Clarke issued tribunal proceedings, claiming that he had suffered a detriment and had been unfairly dismissed.
Decision
The Employment Tribunal upheld Mr Clarke's claim. It found that Mr Clarke had validly exercised his statutory right to take time off in order to make alternative childcare arrangements. It was held that he had suffered a detriment in two respects, by having one hour's pay deducted and by being put under repeated pressure to sign the late form, in addition to being unfairly dismissed.
The Tribunal noted that Credit Resource Solutions' 'Time off for Dependant's' policy stated that, although the statutory right to time off was unpaid, discretion might be exercised to pay an employee depending on the circumstances. However, none of Credit Resource Solutions' witnesses had been aware of this policy when they were pressuring Mr Clarke to sign the late form and the Tribunal found that Credit Resource Solutions' policy was not, in any case, sufficiently clear.
Commentary
This decision is a Tribunal decision and it is not binding on other Tribunals. However, it is a useful reminder to employers of the importance of understanding the scope of an employee's statutory right to time off to care for dependants.
In this case, the Tribunal adopted guidance which had been issued by the EAT in a previous decision in considering whether the reason, or principal reason, for Mr Clarke's dismissal was 'connected with' the fact that he had exercised his statutory right to time off to make emergency childcare arrangements. The guidance issued by the EAT was that this should be interpreted widely and in a pragmatic, common-sense fashion.
This decision also highlights the importance of bringing any company policy/procedure to employees' attention and ensuring that managers are aware of the way in which the policy operates/the circumstances in which they may exercise discretion. - organmani sorted them out after days of calls told them the number they were calling was my 11 year old daughters and accused them of being peadofiles got no more calls from them!!
