    Here's my story about cold calls from Link Financial.

    I was called by a young Welsh woman named Charlene at around midday on a Monday. She wanted me to put a note through a neighbours' letterbox about undelivered mail. When I asked what the company she works for does I was told Link are 'a multi-services company.' I never could get her to say what this means or what they do. Charlene told me she would be ending the call.

    I was then transferred at my request to another lady named Sian who was more evasive and difficult. She also I thought I was calling her and not vice versa.

    Sian then cited company policy and the Data Protection Act as reasons why she couldn't tell me a) the industry of her company, b) which department she worked in, c) the name of the MD d) the name of the head of Customer Services, and e) what her job is. Despite this she did give me the name and address of my neighbour and information that my neighbour was being pursued by a 'multi-services company.'  

    When I asked to speak to a manager I was told they were all at lunch.  

    After calling through on a switchboard number Sian gave me I tried again to discover the nature of the company. After some difficulty and repeated requests for my personal details I found that Link Financial are a debt recovery agency. I was told I would have to give my post code if I wanted an email address or the website address.

    When I asked why all the cloak and dagger affair it was put to me that perhaps I had an outstanding debt with them and that was why I wasn't handing over my personal details. I was also asked if I am a solicitor, as if this might produce a different response from them.

    Eventually I spoke with Alan Mackie the head of operations who also proved evasive and particularly untalkative as I went through the details of my experience. He also pushed me for personal details.

    A thoroughly unpleasant experience throughout. I've never dealt with such an evasive and difficult company. They all seemed determined to say as little as possible while probing me for as much info as possible while getting me to do their unpleasant work for them.

    Ah well, since they were pursuing a council tenant I have reported their street-to-street witch-hunting to the council.

    One of my neighbours come round today to give me a phone number as someone called her asking questions about myself and my husband.

    Turns out it was link financial, my neighbour was quite upset about getting phone calls for ppl she does not really know.

    Are the allowed by law to do this???

     Contacting people's neighbours is illegal harassment under Section 40 of the Administration of Justice Act.  You should report Link Financial to the Police, Trading Standards and the OFT.

    Agreed.  Harry obviously works for this company, no question.

    If you're contacted either by phone or letter, confirm nothing, admit nothing.  Then, refer to the Consumer Action Group website, and head for the debt collection industry forum boards.  Link are very frequently under discussion there, and have attained a notorious reputation for ignoring the law and industry guidelines.

    Link have already ran into trouble by repeatedly contacting neighbours, a big OFT no-no, and still they do it.

    This company contacted my parents today...  my folks are old and I do not see why someone would try to contact me at their address when I am registered at an address elsewhere.

    I do have debts although they are mine, not my parents.

    they keep ringing me and sometimes withheld number.They keep threating me and already took me to court.Even I pay my monthly payment on time they still send me a text to call them urgently and call me day and night that I haven't paid.They are seriously getting on my nerves and thinkoing about reporting them to the police for hasseling

    The MBNA ( & Link Financial ) bank has been accused by a High Court judge of "torturing" a customer with  demanding he repay his credit card.

    Keith Harrison had his debt of £20,270 written off by the judge, Nicholas Chambers QC, at Mold in North Wales.

    The judge said MBNA had failed to give Mr Harrison the terms and conditions for the card, when he took it out.

    MBNA said it was reviewing the comments and said it had been unable to have "meaningful dialogue" with Mr Harrison.

    "[We] were unable to ascertain the reason for non-payment," the bank added.

    The judge denounced the tactics that MBNA and its debt collection firm had used to force him to pay up.

    "In my view, the claimant rightly complains that, mainly by MBNA but also by the defendant [debt collectors Link Financial], he was hounded by telephone calls seeking payment of what was said to be due," said Mr Justice Chambers.

    "The calls were a form of torture oppressively frequent in amount and often without attribution to an identifiable number."

    The judge was scathing about the non-traceable phone calls which both MBNA and Link Financial - who bought the debt in 2008 - had used to try to recover the debt.

    "It seems to me that such conduct has no proper function in the recovery of consumer debt," Mr Justice Chambers said.

    "[There] can be no excuse for conduct of which it must be supposed the sole purpose must have been to make the claimant's life so difficult that he would come to heel.

    "I cannot think that in a society that is otherwise so sensitive of a consumer's position this is conduct that should be countenanced," he added.

    Link Financial blamed Mr Harrison, from Devon, for being uncooperative and said its own approach had been "both proportionate and reasonable".

    A spokesman said: "We attempted to contact Mr Harrison 18 times over a period of 12 months, as Mr Harrison acknowledges himself through his own records."

    "Although all those calls were unanswered, answerphone messages were left with a polite invitation to call us together with a contact telephone number.

    "Mr Harrison declined to do so," the spokesman said.

    Mr Harrison took out the card in 1998, after responding to a mailshot sent to five million people.

    From 2007 he ran into financial problems, ran up a large debt and stopped making any repayments.

    In court he argued that, contrary to the explicit requirements of the Consumer Credit Regulations 1983, the bank had failed to send him the necessary terms and conditions for his card, either when he applied for the card or when it was issued to him by post.

    MBNA said it would have done so. But the bank could not prove to the court that this had occurred.

    "I find that neither with the application pack nor with the card was the claimant sent the MBNA terms and conditions," said the judge.

    "It is perfectly clear that the legislature regards it as desirable that such documents should be provided.

    "It seems to me that a total failure to supply the required documents will prima facie call for some reaction from the court," he added.

    'Tricks'

    Marc Gander of the Consumer Action Group (CAG) was delighted with the ruling.

    "This is a real message to anyone else who tries the same tricks," he said.

    Some financial firms, including mortgage lenders, have been criticised for over aggressive attempts to force defaulting borrowers to pay up.

    Last December MBNA agreed to improve the way it dealt with customers struggling with debts.

    The Office of Fair Trading (OFT) had criticised the operation of the lender's in-house debt collection department.

    It had been failing to let customers know if offers of partial payments, to start paying back debts, had been accepted.

    I've just got a really wierd phonecall. This guy called Harry said he was a friend of my next door neighbour and they worked together. He wanted to get his landline number as it was urgent and to do with work.

    I said 'well that's odd because my neighbour is Polish, speaks hardly any English and has been paralysed from the chest down for almost 18 months now so how can you be a friend from work?'

    (he used to work on a building site but obviously not anymore) and the guy just hung up on me without another word. He gave me the number of 02920808610 to give to my neighbour but I'm reluctant to pass it on to him as it sounds like some kind of scam?

    Firstly, learn how to spell and use basic grammar. That way you might be able to get a proper job and stop hassling old ladies. How would you like it if some w****r from a debt collecting company kept phoning your mum, asking for details of her neighbours.  

    There are laws about paying debts, there are also laws about harassment. In my opinion Link are a total bunch of a'holes. Even the Police have to operate within the remits of the law. However Link think they are above the law. At the end of the day NOBODY LIKES A BULLY

    These wnkrs rang my dad to get my mobile number and said their name was mark and an old school friend. My dad fell for this and gave them my number, to which they have rung me around twenty times in the last month and up till 9pm. As far as I know they got my number by way of disception and I am now having to change my number. Can anyone advise on having similar happen to them. these people need to be fined heavy by the ombudsman and struck off.

    I received a call and the caller hung up when I answered.  The name on the i.d. was Reyes Teresa, phone #321-235-2413 which I called back immediately by pressing phone.  A message indicated that the number had been disconnected.  How can that be when it just called me?  I called the operator who was no help....  could this be another tactic for collecting debts?  Not sure about that, I pay my bills.
