- Andy replies to genesisThey can take you to court for up to 12 years in most states under the statute of limitations. They can only keep calling you for 6. As soon as you acknowledge the debt to them, that resets the statute back to 0 and they then have another 6 years to hassle you. Every time you make a payment to them it also resets the statute. The reason they're so aggressive is that if they end up taking you to court in a civil case, the courts usually can request that you pay back a more modest amount than what they are chasing.
Agreed that paying debts is the best way to avoid all this, but not always 100% avoidable. Personally I developed cancer last year and had to quit work. Most of my creditors were very understanding and reduced or froze payments until I recovered, but the company that held my personal loan were the opposite - and after a short period onsold the debt to this company. The understanding creditors are now being paid back first. Guess who is not being paid back until the others are? - tanyai received a hand written letter in my mail box to call 1300 133 667. please advise why im getting this.
- Nameless| 1 replyOk, give this guy a break. He has said he is paying it but obviously having problems with them. I am too. I agreed on an amount affordable for me to pay off a debt that was made by my ex who I STUPIDLY got a phone plan for. The first payment went through fine but ever since then each payment is knocked back and it sure as hell isn't on my end yet they call every week complaining about it. Don't know why I am even bothering to be honest!
