    I got a text from Steve Garland telling me he was coming to my house to give me paperwork for Payday loan I have never got a loan from them back in 2013,2016 and 2019 I was not working in 2013 I could not work I have been on social security 2014 they said I owed $3000 now

    Some of you are gnawing down your fingernails over this "Steve Garland" character without questioning how he does his job when you're all given generous advance notice by voice and SMS. The threat of process service is how the dubious collectors frighten and distract you from thinking straight.

    Process servers do not collect debts for plaintiffs or get involved otherwise in resolving legal disputes. The nature of their job is the surprise visit, not setting appointments. Paying strangers on the phone to shoo away a server is not how real debts are collected by creditors. Rather, that is how extortion for severely stale, invalid, and phantom debts gets done.

    "Pay me or get served" is usually an empty threat, in particular when that demand is the first you ever hear of some purported debt claim. Such empty threats are illegal per the FDCPA and similar state laws.

    Lawful debt collection is a process, not an ambush. You are due a chance at each stage to raise a dispute. You have a limited right to debt validation on real paper. You have a right to honest answers and polite treatment. You have a right to limit or bar all phone calls. You also have a right to sue debt collectors who deny those other rights.

    Got the same message and I'm in Southern NJ so either they're full of crap or Mr. Garland really gets around, lol. I'm now think thinking is this a total scam.

    FYI debt collectors are not allowed to make idol threats. In other words unless what they say is true and they do serve legal documents on you as they are saying they are, then if not they are breaking the law.  If you can figure out who the debt collection company actually is, name - address - etc.... then you can pursue suit against them according to the FDCPA.

    Those would be idle threats, but you're otherwise correct. This is a collector class which finds numerous ways to break §1692e, their favorite being the false implication that the alleged debtor has been sued or soon will be. I think there also could be room for a little-invoked ban on false "affiliation with the United States", through abuse of the D.C. area code -- a trick we're accustomed to seeing from freaks claiming "your SSN has been suspended" and other such impostors.

    This "Steve Garland" gang has shown its weak hand through the "two forms of ID" blather. This is a stock threat phrase from the phantom process server's toolbag, often followed by an order to "restrain your dogs". "Service address confirmed", in-deeeeed! Do they have phasers locked on target, too? Real lawyers with real debts at issue don't have to role-play with threat scenarios. They're most likely to send one or two saber-rattler letters and quietly file suit when it's plain that the debt won't be rapidly settled over a phone call ... far cheaper than incurring court and server fees.

    The drop number from that threat text has an Atlanta area code, a far more plausible company locale, as a city overrun with dirty collector shops. The related thread also cites "Steve Garland" along with a "Richard Carmichael" persona and more of the same payday loan poser threats.
