They were looking for someone that doesn't even live here. I've had my phone (landline) for over 7 years. I don't know who's giving out my number but they better knock it off. - Minnesotan replies to NormaI agree w/you. I owe no one and any debt I do have is paid on time. If there is a do not call list, then why in heaven's name are they allowed to call you unsolicited? It is flat wrong. Time to make our congressmen do some work for a change and pass some laws re: this. I have had it up to my eyeballs.
- Ron H| 2 repliesI want to enlighten some of you on some things. This company, RGS, is a collection agency, not a solicitor. The "do not call" list has nothing to do with them. That only protects you from calls from solicitors and has NOTHING to do with this type of call. However, as a licensed debt collector, they are bound by the FDCPA, Fair Debt Collection Practices Act. The FDCPA has very explicit and strict guidelines by which they must go by. If you owe a debt then they are trying to collect it. If you do not owe anyone then they have your number by one of three means. Either you were put down as a reference when whoever owes the debt contracted for it and thus they have every right to call you. I understand that you may not have known about this but it still gives them the right to call you, but only until you tell them to stop. The second way is they got your information through some method such as running an Accurant or other service that gives associated names and numbers of an individual. I worked for a company that used these to locate people and they are very thorough. We were very careful to use only information that we knew was obviously a good lead. Some companies however will use everything on these reports and call any number. These reports can show, relatives, neighbors, other residents who have had the same address or others who have had that number. Again, it's very thorough. If this is the case, you are still covered and after you tell them to stop calling, they must do so. There is a misconception that you must request the cease and desist in writing. This is not true if you are not the debtor. You may simply state that you are not the person they are trying to contact and that in accordance with the FDCPA you are hereby notifying them to cease all further communication. At that point they must do it. Now, even if you are the debtor they don't know that and must comply. However, if you are the debtor and they know that then, based upon the debt agreement, you may be required to send in the cease and desist in writing. Usually this is not the case though. Since I doubt that you have kept your documents you may just have to go with it if they tell you it has to be in writing. The third way they got your number is if it belonged to that person prior to you. Again, tell them you are not them and do the FDCPA speech and they should leave you alone. Hopefully all of this helps. Again the do not call list does not apply to debt collectors. Only Solicitors. The FDCPA covers debt collection practices, is very strict and is one of the few pieces of legislation that actually protects the individual. Like I said before, usually just mentioning the FDCPA is enough to get them to stop. One last thing, as far as the calling you at work thing..... Whether you are the debtor or not no one can call you at work but only if you inform them that this is a work number and that you are not allowed incoming calls. There is a whole different set of rules for this in the FDCPA and they have severe penalties because it is a dual violation. You and your employer can sue them so you almost never have issues with this again.

- LindaT25For anyone getting any collection call on a CELL phone keep a log of the number and when they call each and every time. It's actually against the law for debt collectors, or even solicitors of certain types, to call you on your cell phone. They can be liable for approximately $1500.00 for each call they make. Check out a website classactions.com for more info on this classaction lawsuit.

- Li replies to Ron HYou forgot to mention that also under the FDCPA, check topclassacions.com website, these money grubbing debt collectors are prohibited by law to contact anybody on a cell phone and may be fined stiff amounts for each and every call made! Many rights are accorded to the consumer under the TCPA, telephone consumer protection act. For example here's a class action against Bill Me Later, calling consumers using prerecorded messages or voices is against the law unless given prior permissions.
Bill Me Later Inc. has agreed to settle a class action lawsuit alleging it used an automatic dialing system to contact individuals by telephone without their consent, in violation of the Telephone Consumer Protection Act (TCPA). If you received an automated or prerecorded telephone call made by or on behalf of Bill Me Later, you may be entitled to cash benefits from the class action settlement.
The TCPA prohibits companies from using automated telephone dialing systems or prerecorded voices to call consumers without their prior express consent. Violations of the TCPA can carry a $500 fine per phone call. The class action lawsuit alleged Bill Me Later and its agents violated the TCPA by making automated or prerecorded telephone calls to consumers who did not consent to receiving the phone calls.
Bill Me Later has not admitted any wrongdoing but agreed to pay $9.9 million to settle the TCPA class action lawsuit and avoid the cost, risk and delay of trial. - LindaT25check out this website, topclassactions.com under the FDCPA it's against the law period for a debt collector, and some sales calls, to contact any person on a CELL PHONE. There's a class action lawsuit going now. Keep diligent records of the number calling you, dates, times, etc. This can rake in some big bucks like $1500 per call that they make to you, whether you owe the debt or not.

- seasoned bill collectorJust an fyi..the do not call list doesn't apply to collector calls. If you tell then it's a wrong number and they call again it's grounds to sue. If they use deceptive practices or treat you improperly I'd report to fcc. They will call relatives or neighbors and are allowed to once only for location information.
