- J.J.| 1 replyThey just called me at 8:08 p.m. ET. They've been calling every few days, with some of the numbers previously listed. I do not answer; if I do have an outstanding debt, they can always send me a letter. If they have my telephone number, I'm sure they have my address.
As for the poster regarding a 15-plus year credit card debt, you've just raised a point. My mother -- who lives three hours away from me -- occasionally gets calls for me. She tells them she has not spoken to me in several years. I think I had problems with a Sears card, but that was at least 20 years ago. I've never asked for a credit report, even though I know I can receive one from each company once a year -- I think now is a good time.
If I read some research correctly, somehow the statute of limitations can start over once a debt is sold to another company. So it may be able to go on and on, even if previous companies have written off debt. The recommendation I read: do NOT answer the call -- it could set the statute of limitations back to zero. - SURE SHOTJust tell them to go do themselves.

- GGot a call from this number tonight. The caller ID came up as Portfolio Recovery Associates, a debt collector. This is the third number they have called me from. I don't know why their calling me. They always have an automated message whenever I answer saying to call such and such number back.
Really what their doing is illegal. Under the FDCPA, they have 5 days from the first time they call to send something in writing; telling you how much the debt is, the original creditor, and the information you would need if you wanted to dispute the debt their trying to collect. I never received any such letter, they just started calling.
Since I don't have an account number to reference, I will use my phone number and send a cease and desist letter. They picked on the wrong person to try and scam.- Caller: Portfolio Recovery Associates

- lynni just called them and asked them to remove the number from their database, and informed them that it is a cell phone. They by law cannot call your cell phone and charge you for the call. next time they call you let them know to remove the number they are calling, tell them they have the wrong person, do not give your name at all. By law they have to remove wrong numbers, if they do call again they are in violation of the FCC laws.

These people know the guidelines to a limited degree, and they get paid well to be as combative and intimidating as possible. They use phone 'spoofing' to use time differences against you and will try to confuse and control the call. One of the best tricks they use is refusal to disclose who they are and their physical address. If you request the firm ceases the calling (or) as that they provide the alleged debt in writing, they do not have to comply unless YOU send them a letter stating your wishes. The above is the information you need for many of the calls you get. Send the letters Certified Mail, Return Receipt and make sure you TYPE the requests professionally, with proper grammar and spelling. The more they can make you look ignorant (or) incompetent the better chance they have to get a quick 'default judgment' and begin garnishing your wages. Know your rights, and keep an eye on dockets for civil cases in your state against you. If you show up prepared, you will be surprised how often you come out on top! - The TRUTH replies to J.J.JJ, They can't start the SOL unless you make a payment or agree to a new payment plan. Just answering the phone won't start the debt. 1st, DON'T answer their calls if you are sure the SOL has expired, check your state. 2nd, if you want to answer, which you shouldn't, then deny the claim, again, DENY THE CLAIM. Tell them you don't owe the money and have no clue what they are talking about. If they call you a liar, they will, ask for written proof to be mailed to you and remind them to stop calling. ASK for written proof to be mailed and you will look it over. PRA will never send you anything, because if they do and it is incorrect they can be legal issues for harassment. They fear courts on out of SOL cases more than harassment suits. PRA has lost many cases for harassment once the debt was proven wrong and continued to call. To sum it all up. THEY DON'T have any of the files. They know they can't legally make you pay SOL debt, unless you agree to pay it, even $1. Don't let them talk you into if you pay as little as 10% to clear the debt, because they may stop calling, but it can now go back on your credit report for up to 7 years as a settlement and will hurt your credit score big time. BIG TIME! They buy this debt for pennies on the dollar, it is called ZOMBIE debt, but companies won't give them private information just in case they use it wrong and they end up getting sued. So they will lie to get you claim the debt is yours and that way they can use that in court to collect. But if the SOL has passed they can't do anything, but to try to trick you. The sad news is that debt NEVER gets forgiven unless you pay it or by court order, bankruptcy. The good news is that SOL in most states is between 4 -10 years, average being 7. That just means they can't take you to court or file a 1099 on the debt once the SOL expires. The newest technique being used by creditors is filing 1099 on new debt. That way they can write it off on taxes. But that also means the debt is PAID since you will have to pay taxes on the debt. No more phone calls, but a tax bill. Sorry for the long explanation. But the best thing you can do is not answer the phone, if you do, just hang up immediately and block the number. PRA has many numbers, but Comcast let's you block up to 12 and forward 12 numbers Buy a Panasonic block phone that let's you block up to 70 numbers. You may also want to get a Google number and start using that number to block and get forwarded numbers. Google let's you block unlimited amount of numbers.

Beware if you pay even one penny then you are acknowledging the debt and the clock starts again. Next time answer and tell them you are required to let them know you are recording the call, tell them you want validation of debt MAILED to you with YOUR signature and you tell them by law you are giving them notice that they are to no longer call you. When I did this, she said we can call when we want and I happily let her know that each violation would be filed with the Attorney General of my State. Just report these people and keep doing it, don't let them bully you!!!!

I will double check but I think 9pm is past the time that is legal to call. Besides that I don't owe them anything. I have a form to fill out for my States Attorney's Office, filing it out tomorrow and sending it in!!! I suggest everyone else should do the same!
