Everyone here needs to be familiar with the Fair Debt Collections Practice Act.  At NO TIME can a collection agency (or a law firm for that matter)  THREATEN you, or suggest that they can put you in jail.  Only the police or the courts can put you in jail, and these are civil matters, so the police really don't even enter into it.  They cannot take your kids from you.  If they are contacting ANYONE other than you and speaking to them about your debt, that is ILLEGAL, and if you can prove it, they can be punished under the FDCPA. IF they are a law firm (which I doubt), they CAN sue you, but unless you have a substantial amount of debt (like thousands of dollars), they won't, because it costs too much to sue, and it isn't usually worth it to them.  They are trying to get money from you by any means they can, and they will come at it from a lot of directions.  As long as they do it legally and you owe the money, they can continue.  Read the document, it is available online and will help you out..

These guys contacted me today about sending me a 1099c for "forgiven debt" by some creditor.  I'll call them back and see what they say.  By the way, I am NOT a lawyer, just sharing my experiences....

Today, I received a call from a Vincent Sharipro, who stated that I was being sued for a credit card debt that I had no knowlegde of. He went on to tell me that the sheriff's department will be issusing a warrant for my arrest if I didn't send his law firm (Rueben & Yates) $5,650.00 before 6:00 pm this afternoon. I asked him what company was this amount owed to, he could not give me any information. He went on to state that this information was attached to my social security number and that it was going to be on my credit report. I asked him for an address where I could send the money, I was put on hold. When he returned, I was told to go to the nearest western Union and they could tell me what I needed to know. After hanging up fron him I dialed the number back and got a recording. Who are these people, because I don't have any outstanding debts. I'm inclined to believe that these peope are trying to get money from anyone that will give them their infromation.

At 10:41am, I received a call from a Bryan Norfolk who claimed to be representing Maryland National Bank with a firm of Rubin & Yates. I was a little shocked because they called my WORK phone. I asked him how he got this number and he claimed it was public record available through the court. WRONG.

I let the guy spill his crap about I owed $4359.06 from a debt in 1993. He spoke quickly and said that an Affidavit was being filed against me in the Clark County Court and I would have to go to court on this debt unless I made arrangements with them today to make payment.

I then asked him his last name again. He stuttered and repeated his crap about taking me to court. I said well, I'll give you a fax number and you can fax your complaint over to me for review. He said he wasn't going to fax anything that if I didn't pay they were taking me to court. We went round and round with him claiming I needed to "cool my jets." Boy, don't tell me that!

Then I started gathering and making him repeat information which he didn't want to do. He claimed I was confrontational and I told him he was all hot to trot about who he represented and now he couldn't tell me? Meanwhile, I'm looking up his telephone number and came across this site. Then I let him have it. "I'm not going to cool my jets. Do you know the collection laws of Nevada? Apparently not, so let me tell you. IF this is my debt and it is now over 6 years old you cannot legally file a claim in court. Do you even  know what an Affidavit is? Do you know how to properly serve someone a complaint? It isn't done by an Affidavit and it isn't done over a phone. And, do you know that by contacting me at work you have violated Federal law?

He kept saying he was going to take me to court, yet wouldn't provide a complaint. I said, I have been to court numerous times in Clark County in the District Court, Justice Court, and going to the Supreme Court. There are rules that you are required to follow to serve someone a complaint, and this is not it! He said those rules did not matter. I said, The rules of the court DO matter, I am a paralegal. I know what I am talking about. Of course, he claimed I didn't. Whatever. So, eventually after being whipped, he hung up the phone.

Ten (10) minutes later someone else from his firm called me, Dan Hollister, and claimed to be an investigator. He said he had received my file and wanted to verify some information. I said, Yeah, you received my file about 10 minutes ago and go ahead, what information would you like to verify? How about the information that you all are in violation of Federal law? How about that you can't collect a debt (real or imagined) in the State of Nevada that is over 6 years old. He hung up too.

End of story. I am reporting these people to the FCC for their blatant violation of Federal laws. Let's see how they get their butts out of that court date. >:|

You know the most wonderful part? Since they contacted everyone and his brother that is remotely related to me, we have some very fine recordings of their antics for the feds. Oh, what a lovely day when people with reason fight back! :O) I just feel so warm and fuzzy right now. Let them continue to call. Since I am a perpetual evidence gatherer it will help the feds tremendously in shutting their illegal butts down. :O)

Folks don't forget... document, record, file complaint with FTC. Yup, that about says it all. :O)

These clowns are nothing more than a glorifed collection agency.  They are scam artist, and do nothing but break the laws.  Per FDCPA laws which they break, TRUST ME...I have decided that next time they  harrass me I am going to tape record their [***] and turn them in.  They are NOT a Law Office like they claim they are and break the law by saying that they are.  I am taking steps to catch them and will pursue them.  I am so tired of them harrassing me and my relatives.  They make commission when we pay them, that is why they go out of their way to be illegal on the phone.

Rubin & Yates is nothing but a COLLECTION agency trying to scare people with their Illegal threats.
People get educated.  Go to google type in your state and read FDCPA Laws then you can file suit against them.  Good Luck

This number also known as 866-237-7191 has been harrassing my family. No need to call my diabetic mother and stressing her out leaving voicemails. They called her cell phone and left a message stating my FULL name. Said I need to call back in 24 hours regarding a claim filed against me. I called back and gave the reference number left on the message. A RUDE man answered said I need to pay off a debt that is dated back to 2001. I have no clue what that debt is. Funny thing is I recently filed to claim bankruptcy and none of this so called debt was on the report. As far as the threats with warrants for my arrest. Come to my home, show me a REAL warrant then we'll talk. until then quit calling my family looking for me.

STATUTE OF LIMITATIONS ON COLLECTION OF A DEBT.
    GOOGLE IT for your state.
Yes, you may owe something that was LONG written off by an original lender but the interest and fees accrued make it a currently insane amount.

Then again, you may owe nothing, be the victim of a false identity scam, be unfortunate to have a similar name to a debtor etc.

Either way. THESE ASSCLOWNS CAN BURN IN HELL.
RUEBEN AND YATES are worthless slime representing themselves as a law firm and nothing more than a bottom feeding junk debt collector which knows NOTHING about the laws in the states for which they claim to be suing you in.

They try to use harrassment, threats, gain more information than ANY legitimate collector is entitled to in order to supposedly represent a lender.  Then, they won't even accept a payment plan, just somehow you are supposed to pull some ungodly amount out of you ass.

Someone put a stop to this madness.  They probably are based in the Bahamas or offshore and are skirting U.S. collection laws.

Some  unprofessional little boy keeps calling  me from that number, then started calling me "private" (which I don't answer any way)and harassing me from 7:30am until 8pm.
I and my care givers have let them know that I live on SSI, and notified them years ago that I am not in any position to pay a debt that is over 5 years old.

I hope you are NEVER in a postion like this.. when money is borrowed. These loan companies/credit cards are sorry and should be illegal. They give unreasonable payment terms to were you pay 1000's more and still continue to charge you intrest, they prey on the middle class. Now these collection agencies buy the account for pennies on the dollar and still try to collect the WHOLE amount. Everyone in this business is money hungry and make a sorry living. Majority of the people who cant pay have a valid reason. Most would like to pay the bills, dont be ignorant.
