- LanceThey are collection agency for Duke Electric. They have called twice and the first time they called their system mispronounced my last name so I had no idea who they were looking for. then on the second call I missed the call and returned the phone call. The lady on the other end proceeded to ask a few questions and then wanted to know if I was going to pay this bill. personally waking someone out of a sound sleep is a bad mistake. So I turned rude. I then hung up on the woman and then proceeded to look up the information on this company. Here is what I found.

FDCPA - 805. Communication in connection with debt collection
(a) COMMUNICATION WITH THE CONSUMER GENERALLY. Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt-
(1) At any unusual time or place or a time or place known or which should be known to be inconvenient to the 15 USC 1692b 15 USC 1692c 805 15 USC 1692c consumer. In the absence of knowledge of circumstances to the contrary, a debt collector shall assume that the convenient time for communicating with a consumer is after 8 o'clock antimeridian and before 9 o'clock postmeridian, local time at the consumer's location;
(2) If the debt collector knows the consumer is represented by an attorney with respect to such debt and has knowledge of, or can readily ascertain, such attorney's name and address, unless the attorney fails to respond within a reasonable period of time to a communication from the debt collector or unless the attorney consents to direct communication with the consumer;
or
(3) At the consumer's place of employment if the debt collector knows or has reason to know that the consumer's employer prohibits the consumer from receiving such communication.
(b) COMMUNICATION WITH THIRD PARTIES. Except as provided in section 804, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a postjudgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than a consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector.
(c) CEASING COMMUNICATION. If a consumer notifies a debt collector in writing that the consumer refuses to pay a debt or that the consumer wishes the debt collector to cease further communication with the consumer, the debt collector shall not communicate further with the consumer with respect to such debt, except-
(1) To advise the consumer that the debt collector's further efforts are being terminated;
(2) To notify the consumer that the debt collector or creditor may invoke specified remedies which are ordinarily invoked by such debt collector or creditor; or 805 15 USC 1692c
(3) Where applicable, to notify the consumer that the debt collector or creditor intends to invoke a specified remedy. If such notice from the consumer is made by mail, notification shall be complete upon receipt.
(d) For the purpose of this section, the term "consumer" includes the consumer's spouse, parent (if the consumer is a minor), guardian, executor, or administrator.
FDCPA - 806. Harassment or abuse
A debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section: (1) The use or threat of use of violence or other criminal means to harm the physical person, reputation, or property of any person.
(2) The use of obscene or profane language or language the natural consequence of which is to abuse the hearer or reader.
(3) The publication of a list of consumers who allegedly refuse to pay debts, except to a consumer reporting agency or to persons meeting the requirements of section 603(f) or 604(3) of this Act.
(4) The advertisement for sale of any debt to coerce payment of the debt.
(5) Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number.
(6) Except as provided in section 804, the placement of telephone calls without meaningful disclosure of the caller's identity. . Section 604(3) has been renumbered as Section 604(a)(3). 15 USC 1692d- Caller: Helvey & Associates, Inc.
- Angry| 1 replyI received a phone call prior to 0900. I work nights and had just fallen asleep. They called and asked for a Kevin ------. Same last name as myself, but absolutely no idea who this Kevin is. I called the number back after they hung up on me and asked how they got my number. They apologized and said they had the wrong number. How funny that they just happen to pick another person with the same last name as the person they were looking for and called me!!!! I believe that they just call every number available with the same last name in hopes of finding that person. Meantime that is harrassment of innocent people such as my self. I am reporting them to the State of Ohio as well as considering legal action. I find it particularly humorous that a collection agency would be calling me when I have absolurely no debt. My house is paid for, no credit card debt, no nothing. I am angry that they have invaded my privacy and refused to state how they got my number. Hopefully, my lawyer will help them remember how they got it!

It's really easy to tell people to pay their bills... I also have been the only one with a job in my house with *2* kids... and my "collection" is for a medical bill for one of my 2 little girls! And hospitals are so kind to want their money right damn now. How compassionate. So back off the rest of us.

III will probably have to go to a lawyer to get THEIR MISTAKE fixed, because anyone i talk to there just gives me the run around.
Im not saying every worker there is like that, but the company and the companies they associate themselves with, making fraudulent claims in peoples GOOD names, are slanderous villains in the eyes of a hardworking american who cant get a god damn break.

Then when we ask what their "lawyers" name is so we have permission to speak with them they get all flustered and hang up. That's because normally they don't have a lawyer. Normally if they can't pay their bills they don't have money to have a "lawyer". But in your case a lawyer isn't going to do anything about them calling you for someone else. A lot of collection agencies use a system called a "accolaid" system that goes through the yellow pages or something like that. This is for the people who think they can just give out fake #s and they'll never get a phone call. But sometimes that system does put in a similar person's name's telephone # or address in. But you can't say they violated your privacy. Is it againist the law to call a wrong #?
- MalenkoI too receive calls from this Collection Agency and they are trying to collect on the $1000 hospital ded. Medicare requires each and every time a Medicare patient has an hospital admission all year long. My wife is disabled due to a serious staph infection that this hospital gave her during surgery and she had been admitted there several times that yr. so she had a $4,000 ded. bill that Medicare did not pay that hospital. So the greedy hospital that almost put my wife in the grave now expects me to pay them 4 grand!!! I refuse so they have turned me over to this Collection Agency to call and harass us. So all you employees who want to justify working there harassing hard working Americans think about my case!!That hospital has been paid $380,000 by the health insurance company and they are stupid enough to think that I am going to pay them the balance. It ain't gonna happen. I don't care how many collection companies they hire!!!!!!!!!!!!

Then they would get so mad when they got a different person almost every time, because they realized that they were just wasting their own time. :)

You must have had a lot of disclosures when you worked in collections.
