    This is the 2nd time they have called. I've not answered either time. The first time they called in the afternoon. Tonight they called at a few minutes before 9. I had JUST got my baby to sleep and was getting ready to lay him down. Of course it woke him up! Ugh! People need to stop!

    They keep calling me...I call back..they say I owe money so I tell them to send me a bill.  I have never once received a bill that apparently is the reason it went to a debt collector.  I pay all my bills on time, so I have no idea what this is.  The voice mails are very annoying.  I have called them back about 4 times and say the bill is on the way.  If I get another call I will lose my mind.  I believe it is some sort of scam...why won't they just send me the bill??

    These people call here at least 3 times a week at 9:00 at night when I'm trying to get my baby to sleep. He is sick with a fever and ear infection so I was trying to comfort him when they called. A lady asked for Carla?? I usually dont' answer the phone but tonight I did and these people got a piece of my mind! It's BS calling this late at night! All she said was it's not 9:00 here. I told her not to call back and then I hung up. I hope they don't call back ever again!

    I'm constantly declining the calls when I see what number it is, but it keeps leaving the automated message on my voice mail. Of coarse it is looking for someone else I have never even heard of. I'm going to send them a cetified letter.

    Don't bother w/ the Do Not Call list. That was created for telemarketers.

    Protections Under the Law
    The activities of debt collectors in Texas are regulated by the Texas Debt Collection Act. The Act prohibits the use of fraudulent and abusive collection tactics by individuals or corporations to obtain payment on outstanding debts against a debtor.

    It is unlawful for a debt collector to attempt to collect more than the amount originally agreed upon – whether the agreement was in writing or not. However, the debt may be increased by the addition of attorney fees, investigation fees, service fees, collection fees, or other charges if a written contract authorizes the additional charges.

    If you dispute an item in the file a debt collector has on you, you must give the debt collector written notice. The debt collector is not required by law to cease collection efforts if you merely call the debt collector about your dispute. Written dispute of the debt is best accomplished by sending your complaint to the debt collector by certified mail return receipt requested. Keep a copy of all correspondence you send to the debt collector. The debt collector has 30 days after receiving your written request to determine whether or not the disputed item is correct.

    If it is incorrect, it must be corrected. The debt collector must notify anyone who has already received a report containing the incorrect item. If, at the end of 30 days, the debt collector has not been able to determine whether the item is correct or not, he or she must make the change you requested and notify anyone who received a report containing the incorrect item.

    If it is later determined that the item was correct after all, you must be notified and collection efforts may be continued.

    Harassment and Fraud are Prohibited
    State law prohibits the use of harassment and abusive collection tactics. It is illegal for any debt collector to:

    threaten violence or other criminal acts;
    use profane or obscene language;
    falsely accuse the consumer of fraud or other crimes;
    threaten arrest of the consumer, or repossession or other seizure of property without proper court proceedings;
    use the telephone to harass debtors by calling anonymously or making repeated or continuous calls;
    make collect telephone calls without disclosing the true name of the caller before the charges are accepted.
    The use of fraudulent or deceptive practices is also prohibited, including:

    using a false name or identification;
    misrepresenting the amount of the debt or its judicial status;
    sending documents to a debtor that falsely appear to be from a court or other official agency;
    failing to identify who holds the debt;
    misrepresenting the nature of the services rendered by the collection agency or the collector;
    falsely representing that the collector has information or something of value in order to discover information about the consumer.
    Your home and wages:
    Some collectors will threaten to take your home or wages to pay for a debt. In Texas, if your residence has been declared a homestead, it cannot be taken to pay a debt except for debts taken for the purchase of the home (ie, a mortgage in default), for home improvements, for home equity loans or to pay certain taxes. Wages may be garnished only to pay debts related to court-ordered child support, back taxes, and defaulted student loans. Debt collectors cannot garnish wages for repayment of consumer debt.

    Penalties for Violations
    Violators of the Texas Debt Collection Act are subject to criminal and civil penalties. Consumers who think they have been harassed or deceived may seek injunctions and damages against debt collectors.

    These actions are also violations of the Texas Deceptive Trade Practices/ Consumer Protection Act which gives the Attorney General the authority to take action in the public interest.

    Federal Fair Debt Collection Practices Act
    Texas statutes cover actions by anyone trying to collect a consumer debt. The federal Fair Debt Collection Practices Act applies only to collectors working for professional debt collection agencies and attorneys hired to collect a debt. It is similar to Texas law, but also prohibits:

    calls at work if the collector has reason to know the employer does not permit such calls;
    calls before 8 a.m. or after 9 p.m. unless the collector knows such times are more convenient for the debtor;
    "unfair or unconscionable means to collect or attempt to collect a debt;"
    any conduct to harass, oppress, or abuse.
    If you are being subjected to harassing, abusive, or fraudulent debt collection tactics by professional debt collectors, and you want to stop further contact with you, notify the collector in writing. Keep a copy of your letter and send the original to the debt collector by certified mail.

    These idiots have been calling me for several months 'regarding a medical debt'. I am certain I have no outstanding debts or bills, medical or otherwise. They call at random times of the day and night and leave an automated message.

    Sometimes if I pick up there is only a robo-caller but other times there is a human who never gives their last name. They refuse to say what the bill is for or to whom it is owed. I know that by failing to communicate in writing they have broken the law, but if I say they must write to me, they just hang up.

    I've been at my current address for nearly a year so if they were legit they would have it, and be able to write. I am 100% certain I have no medical bills outstanding from when I lived at my previous address, so they must be calling about a doctor's visit after I moved - yet I only had two bills in this time and the doctor/lab in question are both definitely aware that my insurance of the time is handling the claim and they will get paid shortly, so they are both happy and not pursuing anything.

    I do not know how to get them to just go away! I don't owe anyone any money and if I did as a matter of honor I would pay up.

    they are looking for a bentley for a year i have been telling them that this is not the bentley reseadent's !! we received this number in a three in one package from insight.. phone .tv.and internet a year and 2 mounths ago..but this does not stom them they keep caling

    a) if I had a debt I would expect the service provider to bill me and send me many notices that I'm late

    b) if I had a debt , why would I call them!?!?! I'd be in Brazil instead.

    what can be done to stop this crap...I'm going to try to see if they have a web site and get the registrar information.

    I have reported this company and thieir contact# to Donotcall registry 4 separate times. They have done nothing and I continue to get calls to my cell phone for which I get charged. I have no medical bills so their is no need for them to keep calling.     Rec'vd calls from them at 8:25am no msg left, been recv'ng calls for weeks when I don't have medical bills. Nothing in collections!! My husband tells them that the person they want doesn't live here, we have lived here & have had this phone# for over 2yrs.

    the caller Id stated "telemarketing 800-804-0057" first time I'd seen this number/company, I answered so I could tell the "telemarketing" to remove our number from their list, but when I answered they hung up!
    So I called back and asked them who they were they said they are based out of new york, and a collection company for labcor and suddenly new my name and asked about a particular bill that is still going through the insurance for payment. they said they would hold all calls for the next 30days. I think its a scam between these collection companies and Insurance companies. Every and I mean EVERY claim I make through AETNA is automatically denied EVERY time me or one of my family members has any kind of doc visit or medical work, its denied I have to call and confirm every time w/ AETNA- they claim we are dual insured and thats why they deny, but we have not been dual insured ever! Eventually they pay but sometimes I have to call back the insurance company AETNA 3 times on the same bill to get it resolved. BS I should have to call on every dam doc visit-even for well child exams, check-ups the basics. EVERY claim is denied even though we pay close to 900$ month for f-n medical insurance through AETNA. Of course we has since gone with a new med. ins. but I am still wrapping up the old AETNA stuff!!

    The call came in on my cell phone. I answered, heard background static (as if someone was riding in a car with the windows down), and then the caller hung up. Not cool. I don't have time for worthless anonymous calls.
