- AceAbout Eastern Asset Management--don't be intimidated at all. The first thing to do is contact the Attorney General's office in your state of residence, and find out about the statute of limitations. Eastern can't sue you if the debt is older than the statute of limitations allows. Next, tell them you are recording all their calls, and you have asked all your relatives contacted to do the same. They will scream threats at you; let them. Trust me, these people have no chance in a court of law. Then, if you collect enough information from them, sue them. See the list of lawsuits above. Also contact your attorney general's office to file a complaint. If you are so inclined, you can contact reporters at local TV and news stations as well. They don't like the scrutiny of reporters. I've been a reporter, and these sorts really hate it when reporters get involved, especially at the network affiliate level. Just keep your cool, know your rights, know the law, report anything and everything you can to the attorney general, document everything you can, and consider using the media to your advantage. Works far more often then you will know.

- anonSame thing.... I've been through this before. There are too many of these types of fraudulent so-called companies out there. They take old debt records, one's you've already paid off, but attempt to scare you into believing that you never really did pay off these debts. They say anything, like that you'll be arrested, go to jail, etc. Which can't happen. The worst that could happen is be served to appear in court and at that point, a judgement could be ordered to have your wages garnished or be ordered to pay off debts, if they are even legitimate.
Don't be scared, although I know, easier said than done. Someday, these wrongdoing scammers will be shut down and will have to pay themselves. I mean, afterall, Karma is not so nice.

We need to put a stop to this!! - TACMA man named Joe Cicero called regaurding an old account. He refused to speak to me and would only speak to my husband who is not on the account. I never spoke to person before but he continued to threaten me with wage garnishment and serving of papers. He refused to give me the account number he was referring to or to fax or send a copy of the bill he claims I owe. He wanted us to hand him thousands of dollars. Upon calling back the company, Eastern Asset Mgmt, he hung up the phone on us several times. He should not be allowed to practice his profession if that is what you call it.

I have a recording of one of there employees posing as an attorney and threating me...guess what they want the recording. You can not charge someone with theft for not paying credit card debt nor can you have them arrested....and in the great state of North Carolina you can not garnish my wages for credit card debt.

- Jaime SI rec'd a call at work from a Ms. Lound stating that she was calling on behalf of Attorney John Nicolia. They were going to file a civil suit with my County if I did not return their call promptly. I did call her and low and behold, her voicemail was full so I could not leave a message, 9/24/09. In watching the video issued by the BBB, I learned that many times, these people are collecting for a Pay Day Loan. Although I did receive a pay day loan, I have not paid it back in it's entirety because the terms were ridiculous and were not explained to me correctly. I have written letters to them and so forth and never got a response. I even stated to them that I would be willing to make payments other than what they wanted and it was not good enough for them.. Are you kidding me? 90% of American's are not paying debt due to the rough econimical times that fell upon us! Here I am making an effort and they tell me no!! Seriously?? I'm assuming that Ms. Lound is calling in reference to this loan. I know that I cannot be arrested for not paying debt. If they want to take me to court I say go for it cause I have everything documented!!

- MelissaSo I used to work at a cash advance place, and on a daily basis I had to make collection calls. As the one doing the collecting it was hard for me to understand how people would agree to pay something, then not pay it, then give me attitude about it. After several months of working there I started doing some calculations. After 7 advances people would basically be FORCED to not pay. The equivlant amount of money they were allowed to borrow would eventually be eaten in fees they pay bi weekly on the advances by the 7th advance.(MY DISTRICT manager confirmed this for me later. CASH ADVANCE PLACES HAVE A MONTHLY ACCEPTABLE AMOUNT OF CHARGE OFF bc they KNOW people cant pay after a certain point. SO DUH people couldnt pay. I started to realize there is some ethics behind loaning money and that a company should not knowingly lown money people clearly can not pay back, let alone the advance place is preying on people irresponcible with money in the first place. I do not work for them anymore bc of these bad ethics, there is a difference bw helping people and preying on people.....
The amounts people can be loaned should be half of what they currently allow.
Now to my point of writing this.... I received a call from someone from Eastern Asset Management for my BF debt. The check he bounced was bounced 3 days ago, and today he received a call saying he was being supenoued to court and criminal charges were being pressed against him. BS..... NO COURT would accept that any earlyier than 30 days, and when I had to file against people for non payment, the court frowned upon anything lesss than 90 days AND the person had to be refusing to pay, so if the person paid sometihng pon theyre debt then we coulndt pursue them.
SO what I want to know is what cahs advance place is stupid enough to have these lieing peices of crap do there collections. It will accomplish nothing, and not only that but the crap he said on my BF voicemail is all LIES and illegal to do and I know bc of the fair debt collection laws... you can not speak to other people about there debt either , in which this person did!, and I KNOW because Ive actually collected debt and filed on people!
Go through whatever agency you actually owe and VERIFY your debt was sold.It woulndt be sold earlier than 30 days. Check your credit report for thedebt they say you owe and ask for a letter, courts require a written notification for the debt people are being filed against for , and check with the courts (you can even do this online) to see if they can even take you to court.
Also , report threatening calls, they are illegal,
and EASTERN MANAGEMENT!!!! Your collecting procedures are what MAKE DEBTERS FEEL ENTITELED TO NOT PAY THERE DEBT. I have filed 2 police reports, 1 incident report with the phone company, and filed a complaint with the FTC. Everytime they call I tape each conversation. Then I block the number. I always ask for them to send me documentation as to the bill they say I owe. THEY NEVER DO. They have threatened to have me arrested, they have threatened that the police were on the way to serve me with papers for court. I have NOT been served with any papers in three years. You've got to be kidding me. When is the FTC going to do something about these people?

Suit claims attorney sold use of his name to debt collectors so they could threaten and intimidate consumers

BUFFALO, NY (May 6, 2010) - Attorney General Andrew M. Cuomo today announced his office has sued a Western New York lawyer who sold debt collectors the use of his name, which the debt collectors then used to intimidate consumers by threatening bogus legal action. The action is the latest in Attorney General Cuomo’s ongoing probe into unlawful debt collection practices.
Cuomo’s office sued Williamsville-based attorney John P. Nicolia after an investigation determined that he collected $141,000 in fees in return for allowing debt collectors to threaten consumers across the country by using his name and his law firm’s name. In reality, Nicolia never provided any actual legal services for the debt collection company, Eastern Asset Management.
“The lawsuit alleges that this attorney knowingly allowed a debt collection firm to use his name to threaten, intimidate, and harass consumers, while he sat back and profited without having to do any actual work,” said Attorney General Cuomo. “Our investigation into illegal debt collection practices has uncovered layer upon layer of abusive acts, and we will continue to root out the bad players in this industry.”
An investigation by Attorney General Cuomo’s Office determined that Nicolia, despite being paid $69,000 in 2008 and $72,000 in 2009, has no records to show that he provided any legal services to the debt collection companies. However, the collectors employed his name repeatedly - with Nicolia’s knowledge - in attempts to collect debts:
* Collectors who called the consumers to collect on the debts claimed that they were calling from, or working with, “the Law Office of John Nicolia.”
* Collectors sent standardized “settlement” letters citing non-existent judgments to consumers believed to owe debts, claiming “…our legal counsel, John Nicolia, Esq. may review the status of your particular case at anytime.”
The debt collection company, after invoking Nicolia’s name, often falsely stated that the consumers:
* Had lawsuits filed against them
* Would have their driver’s licenses suspended
* Would be charged with a crime
* Would be imprisoned or lose their property if they didn’t pay
Attorney General Cuomo’s lawsuit seeks a court order barring Nicolia from allowing debt collection companies to use his name, as well as imposing significant civil penalties against Nicolia for the violations.
The federal Fair Debt Collection Practices Act and the New York State debt collection and consumer protection laws prohibit the following conduct: posing as an attorney, threatening lawsuits or other legal action which cannot be taken, saying a consumer committed a crime or will be arrested, and talking with third parties except to get location information. The law further requires collection agencies to send a written notice within five days of initial communication with the consumer explaining how he or she can dispute the debt. If properly disputed, the collection agency must stop all collection attempts and send verification.
Since commencing the statewide initiative in May 2009, Cuomo has shut down 14 debt collection and affiliated process serving companies and required others to reform their deceptive practices. His office has also garnered criminal convictions against 10 collectors who engaged in especially egregious and threatening actions against consumers. The investigation is ongoing and lawsuits against several other collection companies are pending.
Cuomo urges consumers to visit www.NYDebtHelp.com to learn their rights. The site allows victims of debt collection and debt settlement companies quick access to the Attorney General’s office to file complaints, and outlines the stages of the Attorney General’s investigation.
The matters are being handled by Assistant Attorney General James Morrissey under the supervision of Deputy Attorney General for Regional Affairs J. David Sampson and Special Deputy Chief of Staff Mitra Hormozi. - dsrtdomme replies to mcI just googled my name dsrtdomme and this came up. I found it curious so I clicked on it. I see I got 2 nasty responses.
I looked up this phone number back in 2008 and said on this site what happened. When this guy called me I was scared. He said a subpoena would be coming to my house. When the first one didn't show I rested fine. He tried the same trick a second time, the subpoena never arrived. This place has not called me again. We are now in 2011.
