It can be helpful if you are registered with TPS as one of the questions they will ask via email is "Are you registered with TPS?"
They will ask you for your phone number which National Moneysavers called you on.
Also explain your situation as they are effecting your job, then they will review your complaint and contact you. - Annoyedis it not about time these ignoant people were taken to the cleaners. I work nights and they ring at least twice a day and say nothing when I answer the phone. What is their problem???

When I called the number back, the pre-recorded message said it was National Money savers and that they would call back. Well, now I know the caller ID, I shall just ignore it!!

- Private Eye| 2 repliesJust to let you all know some helpful advice - National Money Savers, unfortunately is not breaking any laws.
They obtain your details when you make a purchase on the high street or online - the tick boxes at the bottom referring to third party information releases is then passed onto companies like NMS. So therefore indirectly by not opting in / out correctly you are giving consent for market research calls to be conducted.
TPS service is kind of a waste of time in relation to this company and other similar companies purely because officially they are not selling you anything, they dont ask for payment details they are asking research questions, and information thats it. This is therefore classed as a market research call - the TPS FAQs actually state they cannot stop market research calls.
NMS is trying to complete a survey which if you let them most the time takes less than 5 minutes :)
It can lower the amount of cold calls you get from other companies - because if you go through the survey and say 'NO' to most of it then sponsor companies know your not interested and therefore will not bother you.
If you say 'Im busy' they will pop you on call back.
If you say 'Im not interested' they click the corresponding button however that only applies to that one survey not all of them so you are likely to get future calls from them or similar companies.
If you shout, being rude, or just hang up on an agent most of them will simply hit call back just because you've been rude to them, that annoys them so then they want to annoy you.
HOWEVER - if you are nice to them and friendly and say 'please remove my details from your database' most of the agents will do exactly this.
Raising complaints against this company for nuisance calls will do nothing - sorry to that guys and gals but its true. They are not officially breaking any laws.
To summarise my advice is for you to:
A) Be nice to the agents - if your friendly they'll be friendly back
B) Try the survey out - it could lower the number of cold calls you get
C) Choose your words very carefully when talking to an agent they will pick up on any little positive thing you say
D) Be honest with yourself and admit that this maybe your fault your getting market research calls in the first place by not ticking / unticking opt in statements.

"Dear 'Val'
Further to your recent complaint against National Money Savers (McDowall Media), the Commissioners met recently and discussed the cases brought to its attention in relation to this company. The DMC had received six complaints against this company over the last few months. Concerns had been raised in relation to calls received from National Money Savers to TPS registrants and in some cases those consumers were passed to other third parties against their wishes. The complaints were upheld in relation to TPS regulations (clauses 21.18 and 21.20); responsibility for suppliers (clause 3.15); and the requirement to comply with relevant legislation (clause 3.14).
McDowall Media agreed that the Commission could access data recorded with the Telephone Preference Service (TPS), and the volume of complaints logged with TPS. The investigation highlighted issues around consumer consent and the ways in which failure to comply with the Code and related PECR regulations can result on complaints over unwanted calls that people register with TPS precisely to avoid.
The Commissioners concluded that the company was in breach of Code rules that prohibit calls to TPS registrants unless the company has express permission to make that call. This was not happening with data purchased from third party suppliers and there seemed to be similar questions over the degree of “opt-in” by people on McDowall Media’s own database.
Given the fact that this activity was at the very heart of McDowall Media’s business and, therefore, the high volume of calls made, the Commissioners were particularly concerned over the lack of documentation, safeguards and record-keeping of data and the call-permissions associated with it.
There were, however, strong grounds for mitigation in information sent by McDowall Media to the Commission prior to adjudication. The Commissioners believe that the actions taken or promised should bring them into Code compliance and dramatically reduce the level of complaints received.
The Commission has reprimanded McDowall Media and reminded them in the strongest terms of their obligations under the DMA Code of Practice. The Commission has made clear that it expects to see a significant reduction in the number of complaints received to the TPS. If this does not happen the Commission is likely to revert to a further investigation, possibly culminating in a more serious action. McDowall Media has been asked to review their arrangements and provide the DMC with a full report of actions taken as a result of the investigation, together with details of their handling of any outstanding or additional TPS complaints. The Commission have asked for the report on actions taken within one month and for a further review of the TPS complaint levels and handling of TPS complaints on 1st November or as soon as possible thereafter.
As is usual with all cases which are formally investigated, a summary will be published on the DMC website – this is undertaken in all cases where there is a formal adjudication whether or not breaches are upheld. The outcome is subject to any appeal from McDowall Media.
I do hope the above conclusions are helpful, and may I thank you for raising the matter with us as it is only through complaints such as yours that we can effectively monitor companies operating in the direct marketing industry.

Firstly if the person says 'not interested', 'no comment', etc. it should indicate at the person who receives the call don't want to talk to you and your company should delete their number.
Secondary, I just received a email from DMC upholding my complaint as National Money Savers did not check the names and numbers received from third parties that they are TPS registered.

Did you see how many people had picked up the 'phone to find no-one on the other end? Did you see how many people had been talked over when trying to tell them they were not interested? Last of all, have you read the message from the DMC?

If you have, you should notice the following regulated bodies:- 'DMA', 'TPS' & 'ICO'.
If your employer done their job properly and followed the rules in the first place you should not waste your and other callers time with the cold calls.
