- jamesI have previously bought sanderson blinds. Every night now for the past month I have received calls from 08005610056. I answer, they hang up. It is absolutely preposterous! But what can be done about this? I need some new blind cords as some of mine have perished (they are less than 2 years old), perhaps I should negotiate a decent discount on the cost of replacement given that they keep harassing me with unwanted calls.

http://www.companiesintheuk.co.uk/ltd/thomas-sanderson-blinds - Company magazine replies to MongoEmployee who engaged in offensive banter was not harassed
News
The Employment Appeal Tribunal (EAT) has upheld an Employment Tribunal's decision which rejected the majority of an employee's claims of harassment because the employee had participated in offensive banter and was good friends with his 'tormentors'.
Implications
This decision confirms that when Tribunals determine whether or not an employee has been harassed in the workplace, the employee's own behaviour and conduct at work will be relevant; especially if they have joined in any office banter. If, as in this case, the employee's participation is genuinely willing, is in itself offensive and they remain on friendly terms with their 'tormentors', then this may be sufficient to defeat any harassment claim.
However, this decision does not mean that employers should ever be complacent about the existence of office or workplace 'banter'. Employees are much more likely to raise grievances and submit Tribunal claims where they work in an environment where 'banter' based on or related to a person's sex, race, disability, age, sexual orientation or religion or belief is tolerated by management and is allowed to continue unchecked. The employer in this case may have successfully defended the majority of the harassment claims, but at the cost of several years of time consuming and expensive litigation, not to mention the bad publicity about its workplace. Even the Employment Tribunal described the employer's business as a 'truly horrid place to work'.
The safest course of action for any employer is to adopt a zero tolerance approach to so-called banter which relates to a person's or their friends or relatives sex, race, disability, age, sexual orientation or religion or belief. Employers should ensure they have an equal opportunities policy and that harassment is defined as an act of gross misconduct in their disciplinary procedures. Employers and line managers should, if possible, also be trained on equality and diversity.
Details
In the case of Thomas Sanderson Blinds Limited (Thomas Sanderson) v Mr English, Mr English worked as Thomas Sanderson's Area Sales Manager. Mr English is heterosexual and is married with three children. However on the basis that he had been educated at boarding school and live in Brighton, his colleagues began to subject him to homophobic comments (although they knew that Mr English was not gay). At a separate hearing, the Court of Appeal had held that despite the fact his colleagues knew Mr English was not gay and the fact he is not gay, Mr English was still covered by the Employment Equality (Sexual Orientation) Regulations 2003. Therefore Mr English could still claim that he had been harassed on the grounds of sexual orientation.
When the case returned to the Employment Tribunal to decide whether or not Mr English had in fact been harassed, they heard how he had been described as a '[***]' and articles had been written about him in Thomas Sanderson's internal magazine portraying him as a gay man.
However the Employment Tribunal also heard how Mr English himself engaged in similarly offensive behaviour. He wrote articles in Thomas Sanderson's magazines which the Tribunal found were 'riddled with sexist and ageist innuendo'. He had also been obliged to apologise to a woman for an offensive remark about her breasts. Furthermore, Mr English remained good friends with his 'tormentors' going holiday with one of them and visiting another in hospital.
Then in August 2005, another homophobic article was written about Mr English in Thomas Sanderson's internal magazine, which Mr English took offence over. After the meeting where Mr English's workplace performance was called into question, Mr English decided to complain by email about the homophobic conduct. Thomas Sanderson invited Mr English to a meeting to discuss his complaint, Mr English then resigned and brought a claim of harassment to the Employment Tribunal.
The Employment Tribunal found that with the exception of the August 2005 article, Mr English had not suffered any harassment because his own offensive behaviour meant that the conduct he complained of did not violate his dignity or create an intimidating, hostile, degrading, humiliating or offensive environment for him. Mr English appealed to the EAT.
The EAT upheld the Employment Tribunal's decision. The EAT confirmed that the Employment Tribunal had been right to ask about Mr English's own perceptions and feelings in order to determine whether the effect of the unwanted conduct was to violate his dignity or to create an adverse environment.
As Mr English and his 'tormentors' had engaged in similar conduct towards each other while remaining generally good friends, the Tribunal was entitled to reach the decision it did. - pat| 1 replyCalling 2-4 times daily then hang up when answered extremely distressing as my husband is seriously ill in hospital and they too use 0800 no to contact me so I am obliged to answer phone just in case its an emergency.

- Jim MaslenReceived a call from Thomas Sanderson blinds, told them I was registered for no sales calls and they said they would take my office number that they called off the list. When they pressed for a time when both my wife and I would be there told them I was not going to be talking to a foot in the door sales person who would not take not for an answer a put the phone down.

- JustinI kept getting calls today from Thomas Sanderson Blinds.
1st call: Noise of a call centre or busy office, then hung up before I could.
2nd call: Asking for a Mrs Louise Melish or something similar. I asked to speak to a line manager/team leader and, after being put on hold for a minute or so, explained that my number is TPS registered. She said yes she could see that and that she would remove my number.
According to Oftel, this number is operated by Cable & Wireless, whether it has now been passed onto another operator or is being operated by a customer of C&W (or whatever company C&W are now!) I can't tell without investigating further.- Caller: Thomas Sanderson Blinds

- AndyThey have rung twice today, on our home number, no idea how they got it, and no-one to talk to (busy office in the background, no talk directed my way).
Suspect they are waiting for my wife to answer as women are seen (note: not my experience) as easier marks.
Personally I take one of two approaches - make silly noises down the line, or wind them up by playing along and get on with whatever else I was doing at the time.- Call type: Telemarketer
- porsheOut of the last 100 calls to my phone this company has made 24.They are calling twice a day on my land line and twice a day on my mobile. Christ alone knows how they got the number. They are a real pest. This has been going on for months, you would really think they'd take the hint when we never answer.
If this was someone pestering me in the street I could do them for harassment. It's beyond a joke.
If there is anyone reading this from Thomas Sanderson, this is not the way to get custom, you are alienating potential clients. If I need blinds in the future I wouldn't go to you if you were the last company on earth.Your blinds must be really bad if you have to try to force people to buy them by bombarding them with calls. Get a proper job.- Caller: Thomas Sanderson
