    Statute of Limitations Defined

    The debt collection statute of limitations refers to the time period window that a creditor or debt collector can legally sue you to collect. This period can range from 3 to 10 years, and varies from state to state.
    After this time period lapses, a creditor or collector can no longer use a court to force you to pay for a debt. The time period starts on the account's last date of activity.

    Activity means taking any action with respect to an account, such as making a payment, making a promise of payment or entering into a payment arrangement. Any activity resets the clock to zero, no matter how much time had passed before the activity.


    Time Limitations on Debt Collection Statute of Limitations

    Bankruptcies can be reported up to 10 years, and tax liens up to 15 years.
    Some debts don't have a statute of limitations, such as child support in some states, income taxes and federal student loans.

    It's also important to point out that even if the statute of limitations expires, it only stops a collector from winning a judgment against you, if you can prove that the statute has truly expired.

    What the Statute of Limitations Does Not Do
    •Prevent the debt from showing up on your credit report. This is determined by the credit bureau's time limit allowed.
    •Keep a creditor or collector from filing suit against you. They probably can't win, but they can file suit.
    •It doesn't erase the debt. You still owe the debt, if its legitimately yours.

    Difference Between Statute of Limitations and Credit Reporting
    Not to be confused with the time limit for credit reporting, which is the time period that credit bureaus can report delinquent debts on your credit report. Most types of accounts can be reported 7 years from the delinquency date.

    Types of Agreements Covered by A Debt Collection Statute of Limitations
    •Open-ended Account- Revolving lines of credit with varying credit limits and balances. Credit cards and equity credit lines belong in this group.

    •Promissory Note- A written contract spelling out repayment terms, such as interest rate, number of years to repay, late payment penalties, etc. Mortages fall into this group.


    •Oral Contract- An oral agreement to repay, but not written on paper. This is still considered a legally binding agreement, albeit more difficult to prove.


    •Written Contract- You've signed a written agreement to repay, along with the creditor's signature. A car loan is a good example of this type of contract.

    I have recieved a call from  800-851-9631. Was told they have been trying to contact us but did not say who, me or my spouse. I was told to call Nacy Miller back at a 1-800 # This is the second time I have revieved this call about 3 months appart. Who are these people , are they legit. My husband applyed for overseas jobs, and i googled Drs technolgies and it said they were a defense contractor. Is this them or is this some kind of scam he says he did not apply for a job through DRS technologies, So is this the fradulant collection agency every onr is talking about in these posts. What can we do to stop these calls. I don't want to change my nimber, we have had this same # for 17 years.

    They have called my number 12 times just today alone.  I don't answer the phone;  I have them on Call Block and they still keep calling back.  The Call block gives a report of who tired to call that I have blocked.

    This is ridiculous and I wonder can you file harrassment charges against them.  I owe them nothing.

    Have told them I owe them nothing and they keep calling back.

    This people need to start sending statements home, I will not answer to no one that I do'nt know.
    More less pay them money over the phone. Please mail details along with account number of debt owed,  to my knowlege I do not owe this company nothing.

    First of all you get a dumb recording telling you to call this number back so I did for the simple fact that it say's " If you are ____________ (usually they give a name but not this recording) please call Nancy Miller @" then whatever the number is. When you do this however you get some very ignornant person on the other end.  These are the  RUDEST people that I have ever spoken to on the phone, they do like to hang up on you when you want to know what or who they are....then the person they call for doesn't even live here, never heard of her either. I'm hoping they removed my number from their system if not they will be reported to law enforcement for harrassment....this is ridiculous!!!!!!!!!!!

    They DRS, call all the time and when u ans they wont talk. You call back and they say they want to talk to somebody that does not or ever lived here. Then they hang up on you! Why is this allowed?Our number is an a DO NOT CALL LIST! but it doesnt stop them.Its like every other day or so. Must stop.

    Apparently this has been going on for a while, noticing reports going back to 2008.  It would be nice if some kind of action was taken against these swindlers.  They have called us 20+ times over the last couple of weeks.

    I get calls all the time from this number.  I suggest anyone that is harassed by this company do what I am doing, call them and don't talk to them.  You will be put in their queue, live person will come on eventually but you are not there, it will waste some of their time and then you will go back into queue and this repeats forever until you hang up.  It is a 800 # so doesn't cost a thing.  (oh yeah, not claming this idea, someone posted it earlier but it works, been doing if for couple of days)  Ties up my landline but I use my cell for most things anyway.

    We bought a new house recently. We have a new phone number that is completely unlisted and unpublished. Somehow this "DRS" got our number. I assumed random calling, but they did in the end give our names! How they got this info is beyond me! So they've been calling and I don't answer 800 numbers, especially if I don't recognize them. There is no name, just the number. I put them on call blocker but the phone will still ring once and then block it. They call a lot and every day more calls. Today, they called 7 times by the afternoon. I got sick of it and called the number. I spoke to someone rather quickly. I immediately asked what the name of the company was. The guy with the NY accent said "DRS". What is that, I asked? He asked if I got a phone call and I told him I got SEVEN! He said, oh. Is this the name of XXX and XXX XXXXX? I said, NO, even though it was because who the heck are these people and how did they get my unpublished number and names?? It's kind of creepy cuz I pay to have our info private. He just kept saying he'll take us off the list after verifying our number and I kept asking what is DRS. He said it didn't matter since he's taking us off the list. I said that it DID matter because I have a feeling I'm going to get more calls. He said no I wouldn't and hung up. Well, let's see cuz if I get one call I'm calling the authorities! Sounds like this "company" is a spam and I'm creeped out that they know who we are even though our info is private! How much work did it take to get our info? Did they call family members? Or was it way too easy to pull it up? I'm creeped out!

    I got a call from these people too!  About 20 calls in the last 2-3 weeks.  When I answer, however, they hang up right away.  When i call back, they are never open!  It's funny, the number they call from is 800-851-9631, and the return phone number is 800-807-4106!  I can't wait to talk to someone there so i can show them really how "ignit" i can get.  Obviously, they think people are stupid!  Some are, and it's a shame that they can scare people into believing that they're a real business.  It's also sad because apparantly, they've been doing this for quit some time.  Where is the LAW when you need it!  Do Not Give These Scam Artists Any Personal Information!!!!!!!!!!!!!!!!!  It's your bad if you do!!!!!
