    This is one of those times where we need a Goverment Agency to close these scam artist down. They do not put any money into your account they steal money from you and you have to close your account. They have ripped people off for $100's of dollars and how do these foreign [***] keep operating in the USA? The best thing to do now is not to deal online with none of these so called PayDay loan companies. They get your banking info and spread them around the world.If you noticed they keep sending you to another website to fill out the same info. Then some guy or girl calls you and say they need more info for the lender to approve you!!

    I told them that they overdrew our account and it just wasn't $30 It was three very small withdraws of get this, $.01, .01, & .03 and since they already overdrew our account with the $30 we were charged for the other 3 small charges.  A total overcharge of $144.  If we have to we'll file a law suit with everyone who was scammed by this company.  I think we might be able to get a class action together.  What do you think.  You can email me at stonerattlesnake at netzero dot net

    Was checking my bank statement online & noticed $30.00 had been electronically taken out of my acct by Funding Assurance. Had no idea who they were & called number listed. I got the same story I've read everyone else has. I told them I wanted my money refunded & they said it had been. It hadn't so I was told to send a copy of my statement showing the charge & send it to a given fax # & someone from billing would contact me. Fat chance in hell of that happenning! Nor would I want to send them a copy of my statement. How is this Company staying in business when so many people are being scamed by them?

    Checked my account balance this morning to find two transactions from this place funding assurance. One was for a 5 cent deposit and another for a 1 cent withdraw. I assume they were testing the account. I called them right a way and told them I was calling my bank to not allow another transaction from them to go through. Ended up being a bunch of bull. Hoping to not have anymore problems. Time will tell.

IM ALREADY FILING DISPUTE PAPERS WITH MY BANK AND MY NEXT STEP WILL BE FILING FRAUD AGAINST THEM AND TO FILE A COMPLAINT WITH THE FTC AND THE ATTORNEY GENERALS OFFICE, MINES AND THEIRS!! CALLING THEM AS WELL AND LETTING THEM KNOW LEGAL ACTION WILL BE TAKEN!!

    The same thing happened to me. Took $30 dollars out of my account without my permission, called the number provided on my online banking twice and was on hold for 40 minutes. The next day I got my service manager to call them because I work for a bank and could not figure how they got my account number. She talked to Stephanie who talked to me and was avoiding my request for a refund, even tried to give me to talk to a consultant.I asked her why did they take the money and how did they get my account, she said it was for some membership when I applied for a loan, I told her that I did not applied for a loan. She kept saying that I was preapproved and that they could deposit money into my account. I finally lost patience with her and told her either they give me a refund or I will report you for doing unauthorized debits on peoples' accounts. She finally got the picture and gave me a confirmation number and that my $30 will be credited in 3-5 business days. I will be definitely watching for this and once the money is back in my account, I am closing it and opening a new one with a password. Worthless pieces of crap! I don't ever consider them human beings nor have respect for people like this when they cheat hard working people out of their money.

    They are evidently getting all of our banking information from something we filled out and they were given the information as we were interested parties......ie: someone is selling them our information....since we ignored their e-mails or they went to junk

    they then choose to as the woman told me on the telephone see if our accounts are real.......... they have switched from debiting small amounts to crediting small amounts, which likely saves them some legal crap

    They put 5 cents into my account maybe I got it before the $30 gets stolen and I reported it to Wells Fargo...........who were very nice but seemed to be under the impression I had agreed to it. Which I did not since I have never heard of their company.

    I DO FIND IT INTERESTING THAT THE "FBI" FINDS TIME TO SEARCH OUT PEOPLE TRANSMITTING ESPN FOOTBALL GAMES ONLINE TO PROSECUTE THEM AND CLOSE THEIR SITES BUT LOOK AT HOW LONG THIS COMPANY IS ALLOWED TO DO THIS.....AND HOW MANY HAVE REPORTED THEM TO THE BIG BANKS ALREADY......EVIDENTLY REPORTING THEM DOES NOTHING...... AND NOBODY IS EVEN ATTEMPTING TO STOP THEM.

    THOSE CHARGES COME AND GO FROM SOMEWHERE ????????????????

    YEP - They got me too.  I didn't even complete an application!  I've called them and they put me on hold, then hang up on me.  They also have another #: 888-507-1740.  They've charged me .01c .03c .03c and $30.00 - when I called them to find out what was going on - they couldn't speak fluent english, and didn't understand me when i asked for "Who Authorized This" - they said "Nobody", it's just our fee for your application.  WHAT APPLICATION - I DIDN'T FILL AN APPLICATION OUT FOR THEM???
    SCAMMING EVERYONE IN AMERICA - I'm also reporting this to the Better Business Bureau, the General Attorney's office and my Bank is also putting them under Investigation with the Fraud Unit here.

    I have no problem with foreigners who work for a living....... but the people on the phone have no power to stop what is going on, that is obvious.

    the MALE operator tells me they have to get out what they put in.......5 cents went in and now they test my account 1 cent at a time awaiting to get the $30............

    Tim, I agree 100%.  In this country if you mess with any company or individuals that have money behind them, the government will go to the ends of the earth to destroy you.  If you screw with the little guys like us they don't give a damn.  They're must be literally 1000's of complaints about this outfit but nobody can do anything?  BS.  I guarantee if Warren Buffett had the same $30 debited from his billions this place would be shut down 10 seconds after he made a phone call.

    This was posted on some other board about unauthorized ACH withdrawals, it has to do with recovering the money from your bank if you are given the run around.  It may help if we have to go this route because it sounds like the banks are unresponsive.  We might have to do a little more research but it sounds accurate.  Hope this helps.



    Rules for unauthorized electronic funds transfers

    You have two separate and overlapping levels of protection from your bank .

    Regulation E = for the FIRST 60 days after the first statement showing unauthorized transactions.

    NACHA = for the MOST RECENT 60 days

    Any unauthorized transfer in between these two periods is a negotiation between you and the bank that took your money.

    The first is Regulation E. Section 205.6(b)(3) which states that there is no consumer liability for unauthorized transfers not involving an "access device" (such as a debit card) that occur within the first 60 days after the first periodic statement showing the first unauthorized transfer is issued. Your bank is responsible to you for the unauthorized transfers during that time period.
     Whether they can recover anything from the unauthorized other bank is not your concern.
     If your bank can show that they could have stopped the unauthorized transfer if you had reported it during this timeframe, they are not responsible for any additional transfers under Regulation E.
     Furthermore, there is NO TIME LIMIT for asserting a Regulation E claim.

    If your bank does not volunteer to return the money that was taken before that 60 day period expired, tell them you are making a "claim under Regulation E Section 205.6(b)(3)." The typical CSR at the bank will probably give you a blank stare or give you some patronizing explanation of why you are wrong. Stand your ground and work up the chain of management. Contact the bank regulators for help.

    You also have rights under the NACHA rules that will allow you to get your money back for the last 60 days. The NACHA rules say that if a consumer submits a "written statement under penalty of perjury" within 60 days of the date the transaction was settled, the bank must reverse the transaction.
     Note there is no requirement for an investigation. Your bank must reverse ACH debits from consumer accounts during the last 60 days if you submit a WSUPP, no questions asked.

    These NACHA rules are separate rights from the Regulation E rights. The bank should have a separate form that they probably informally call their WSUPP form. If the CSR has no idea what you are talking about, ask them to call someone from their EFT department.

    They cannot charge you a fee to exercise either your Regulation E or NACHA rights.
