If you are in debt and can barely meet your essential bills, Rent/mortgage, lights, gas, water, car ins., phone, internet, and food...then you should not try and settle with debt collectors until you are in a better circumstance to do so. Lets say you are barely making your essential payments scrapping by, if you get sick and miss one day and cannot pay even one of the listed bills above then do not make deals or arrangements of any type with bill collectors. Why? Because when you make a deal with a credit collector for a percentage of what you actually owe, then you are going into a verbal contract with them and trust me they are recording every word. Say this debt was already on your credit report in collection status for 1 year maybe two. Let's even say you have already made 5 to 6 payments of $45.00, that is their lowest standard payment they usually try to talk everyone into, so lets say you paid 5 x $45 = 225.00 paid towards a commitment of $600.00 but the original debt was $1200.00. Okay now, your payment due date is approaching and you cannot make the agreed $45.00 payment. Guess what happens? 1) You have broken the contract and any verbal agreement you previously made is now voided and the original debt is now back in play minus the $225.00 in payments minus any fees charged to make the agreement so now your back at square one probably still owing a debt $1100.00 because $125.00 went to the agreement fee. Lets not forget when you made a verbal deal with this collector you reaffirmed the debt with the collection agency who is now the debt holder. So that 5 years left you had on your credit report for the statutory of 7 year limitation is now reset to 0 years and 5 months. So not only did you break your back trying to pay the $225.00 but you have not made a dent in the debt, you have reaffirmed a debt and screwed yourself royally. All for what? Because your phone rings? Because you feel you need to answer it? People get real, you are in a financial crisis if credit collectors or calling you. The least of your problems is how many times your freaking phone is going to ring. 1) Change your phone number, you know how to call friends and family to give a new number. 2) Go online and pull up all accounts that are in good standing and give them your new number and make sure you opt out of any selling or giving your info to 3rd party bs. You have no extra money so you do not need to hear from their sister/brother companies. 3) If you do not want to change your number and you would rather hear it ring off the wall than to do a little work, then get ATT phone service and use there account management features to weed out all the the unwanted bill collectors. 4) do none of the 1-3 and just do not answer the phone. By law all collectors have to stop calling by 9 pm. If you see a number call your phone after 9 pm answer it find out who they are then proceed to tell them they have just violated the debt collection laws and that you are going to report them and file a complaint. I guarantee you, they will hang up before you even finish that sentence. Nine times out of ten they will never call you after 9 pm again. If they do exercise your right and file a compliant against them for real. The point to remember here is, if you cannot even pay bills that is essential to your daily living without struggling, why would you agree to pay a bill you know that you cannot pay. It's already a debt on your credit report, it has already done the damage. Trying to fix it when you are still struggling to feed yourself is not the answer...you are throwing away money, because you will eventually be late or miss a payment and void the verbal contract, you are only setting yourself up for more stress and a reaffirmed debt. Let the freaking phone ring, push it to voice mail, do what i call the "one- two punch", hit the answer/talk key, then the hit the end/off key. Bam bam no ringing no talking no voice mail. How easy was that? Mute your ringer, set a standard rig tone for all unknown numbers if you have a cell phone. That way, you know someone other than friends or family is calling you. Any how, if I can meet this guy in front of FBI, I will be please to do to settle or sue him and his company he works for, once for all.
