Caller claimed to be from a law office and that I had charges filed against me. The caller said if I didn't call back the law firm would proceed with legal steps. It sounded like a scam and I did not return the call. Thank goodness for answering machines!

I got the same message on March 2.  They didn't say who they were trying to reach.  Sounds like a scam to me too.  I deleted the message.

Got a threatening phone message from a "Miss Andrews" at Brown, Andrews, and Scott.  Claimed that they had my name and SSN regarding some unspecified issue.  Claimed that if I called them back that day, they put in my folder that I was cooperative.   Message was entirely generic and did not mention my name or any of my particulars.   Undoubtedly a scam, did not return call.   The phone number they used was one for which my name is listed, but no business is ever transacted, so impossible that I coudl owe anyone money.   No doubt a scam to try to get easily intimidated people to pay them for false claims.

I have been getting waged garnished for almost a year now from this company and my professional business license was suspended for 3 years and and wish I had the opportunity to be able to pay this company back for what they agreed to accept as an out of court arrangement back in the day. You two can do with what you want to do but I would settle anything that they are calling me about only because now I am charged with theft and fraud and have to deal with this garnishment for alot more than if I only settled out of court with them. If you do not know a company that is calling you and do not feel they are legit, then you can go to http://www.dos.state.ny.us/corps/bus_entity_search.html  and search their Business Entity Name at any time. If they are listed as a company doing business then they are a true and real company. The company name for which you two are complaining about is Brown, Andrews, and Scott llc they are a large firm based out of NY and use an attorney network to be able to file suit upon you in any state. I would also check your local and state criminal check fraud laws and that is what you could face if found guilty in your state under penal code 609 for check fraud. Do as you two wish but you will lose in the long run and then have them say I told you so. Good luck. Before you complain on this site for anything about an agency I would consider who and what I owe then pay it back. Payday loans are no joke when taken to court upon. You two will eventually find out as I believe both of you are ignoring the debt and them. This is no longer collections and if they have your case then they will eventually get you to pay. If it is with them or in the courts hands either way you will have to eventually pay their debts. Do the right thing and do research but do not hesitate to make an arrangement with them because they will file for suit and then you have no choice but to pay and it will be at a much higher price. Hope this helped the two of you out. If not they will see you in court eventually as it happened to me.

Please make sure everyone who gets a phone call from any debt collector first of all makes sure this is a true debt and not a scam.  All debt collectors have to follow the Fair Debt Collection Practices Act (FDCPA).  The federal Fair Debt Collection Practices Act (FDCPA), 15 USC §1692-1692o, says collectors cannot use abusive and deceptive practices.
The federal Fair Debt Collection Practices Act (FDCPA), 15 USC §1692-1692o, says collectors cannot use abusive and deceptive practices.
The Fair Debt Collection Practices Act (FDCPA) allows individuals and class action plaintiffs to sue in federal or state court within a year of the violation. Under the FDCPA, if you win, you may recover actual damages plus up to $1,000. Attorney fees and court costs may also be recovered. Members of a class action may recover actual damages plus a total of $500,000 or one percent of the net worth of the debt collector.

Attachment A to this guide, www.privacyrights.org/fs/fs27plus.htm, may have information about collection laws in your state.

There are many private practice attorneys who specialize in assisting consumers who have experienced violations of state and federal debt collection laws. The web site of the National Association of Consumer Advocates, www.naca.net, provides a directory of member attorneys. The search process enables you to find attorneys near you and to specify those with debt collection experience, http://members.naca.net/findanattorney/.
The following practices by a debt collector are in violation of the Fair Debt Collection Practices Act:

•claiming to be an attorney or government employee when it is not
•sending you documents that look like legal papers when they are not
•stating that forms sent to you are not legal documents when they are
•saying that you committed a crime
•saying it will garnish your wages or sell your property if it is not legal to do that
•saying it will sue you, if the collector doesn't intend to sue
•not being truthful about the amount of money you owe
•saying you will be arrested if you don't pay the debt
    •threatening you with violence
You may file a complaint with the Federal Trade Commission (FTC), sue or both.

I'm so sick of people doing whatever they can to get out of paying their bills.  That is whats wrong with this country, i paid mine off, I know I owed it and I was faxed a validation notice and a release.  Just because all of you people havent gained employment in 3 years and are complete scumbags does not mean that every debt collector calling you is a scam.

This company Brown, Andrews, and Scott LLC(Upstate Debt management) is a scam. They have changed their story about my "fraud" several times. They have threatnend me with jail(a deputy is coming to pick me up) No deputy by that name was in the sherriffs department. Nothing listing the so called attorneys name either.  I think these people believe everyone is an idiot. I have seeked an attorney and will be filing a civil suit against them. The next communication from me to them will be a person delivering a supena.

I think that it's sad that debt collectors have to go to such measures to make you scumbags pay your bills. Instead of retaining an attorney furious d, why don't you just pay your goddamn bill.

furiousd replies to I PAY MY DEBTS
I dont owe a bill and will never pay this company money. I have even reported them to consumer affairs. Dirty measures are not legal. If this was a true debt then it would be handled as such.

Ia got the exact same message! And, a couple of months ago they called saying "Defendant, ......" I called, and they claimed I owed for a Payday Loan, and that they have me on tape, and would file with the court if I didn't pay. I explained to them that when I got the loan I intended to repay, and that they would have to prove that it was my intent at that time to defraud. I then asked them to send me proof, and the guy got mad and started yelling.  I hadn't heard from them again until today. I don't think it's a scam, but do agree that they try and intimidate people because they know they can't use the criminal justice system to get payment.

The thing is, they cannot use the criminal justice system to obtain payment!
