    Depending on your state, find out your statue of limitations are. Statue of limitations is a legal term used to describe the time a complaintant has to file a lawsuit against you. Most states are between 3 to 6 years. Also, you will have a negative credit score for up to 7 years passed your last payment. If you wait three years, pay again, the 7 years starts over. But after the 7 years, the original creditor by law has to remove it negativity from your credit report.

    Creditors by law can call you for the rest of your life. If you owe a debt, it must be repaid. However, you can write a simple Cease and Desist letter stating that you dont want any more phone calls from said company. MAKE SURE THAT THE LETTER IS SENT THROUGH CERTIFIED MAIL. Once they recieve that letter (You will be notified upono receipt) they have by law, one more time to contact you via phone. Then thats it. However, if you fall under the statue of limitations, they will more than likely take you to court, if not, you'll enjoy peace and quiet.

    First time from this number.  They never let the phone ring long enough to answer IF I was going to answer.  I just look up the number and put it on a blocked list so my phone never even shows they've tried again.  They filed suit against me for a debt that is almost at statute of limitations (which I don't even owe them, it was a charged off debt they bought for pennies on the dollar), I filed motion of discovery, motion to strike affidavit and a bunch of other things.  In the motion of discovery I required 15 or 20 different things such as original agreement, proof that I owed Portfolio, etc.  The day after the lawyer got it he requested the case be dismissed.  DO NOT PAY THESE PEOPLE NO MATTER WHAT THEY THREATEN YOU WITH!!!  Ignore them, if they file suit, FILE AN ANSWER AND A MOTION OF DISCOVERY!  By law they have to provide you with the documents you request when it comes to your debt!  They continue to call and threaten people and get money from them because they won't stand up for themselves and get scared.  There is nothing to be scared of.  I almost did the same thing until I began to investigate my rights!

    Just got a call from them AT 9:17AM.  Been keeping a log of all unwanted call.  This is the first time this number appeared. I Did not answer. I don't answer unknown calls.  I do not answer personal at my job.  We are not authorized to do so.  They can call my cell if the have the number, which I don't think they do.  The can leave a message or better yet,  stop calling my work with that BS.  I don't need anything they have to offer.  This is annoying.  Probably the same people that have been call every morning but from a different number because I will not answer call from numbers that are out of state or 1-800 numbers I do not recognize.

    Your are right that Social Security can be garnished, only up to a point though.  By law, $750 of your monthly income is exempt from garnishment.  In some cases, it would be more hassle for the collection company.  Only 15% of the amount beyond the $750 can be collected.  In many cases, a person who is on Social Security will die before the entire debt is collected.  I ended up with student loan  debt because of the predatory practices of a for profit school.  To this day, I have not been able to pay anything towards this debt and it's been nearly 10 years.  I just don't answer phone calls from numbers that I don't recognize.

    Received a call from a very rude young man - didn't catch his name.  ID came up as Portfolior on caller ID.  Caller called me by my incorrect name (was married over five years ago) and insisted that I have a $2200.00 balance from a Capital One account that I NEVER had.  I told him I had received no correspondance from the company he claimed to be with and asked him to mail me a copy of the debt records.  He asked if he could email or fax, I refused and told him by mail only.  He kept insisting that I set up a "financial hardship" payment plan for $50.00 a month.  He started yelling, I told him that he could mail proof that I had this account (NEVER DID) and then I would speak to him.  Complete and total fraud!

    this company continues to call us and our son at a different number.  they claim we have a debt of 3,000...which either of us do not.  they continue to give us the wrong birth dates as well at last 4 on social security number.  we even told them to send us something in the mail...they have a different address on file??? we give them no information

    These people keep calling me from different numbers. Caller ID always says Portfolio recovery or portfolio. Everytime I pick up, its silent, and they eventually hang up. They tried calling once before all of this, asking for my wife, by her first name only. When I asked what they were calling for, they said debt collector. I asked my wife if she knew who these people were, she replied no. I then started asking questions. They didnt know her last name, and wernt willing to give me any more info. i told them to [***] off and never call back again. Now they call 3 times a day, hanging up on me. To be honest, i think they got her number online somewhere, and her first name from our voice message service. The same people called one time asking if she wanted to register for a psychology program. She refused with out saying she is already a Dr. How do I put an end to this?

    These buffoons have been calling My cell and asking for my Husbands' name. When Iaskk Who's calling? They ask am I? I ask them What is this concerning? They say We cannot tell you that information. I tell them It IS my business.They ask if I Am his Wife, I reply Yes I am. They say it is to Collect a debt. I ask What debt and from Whom? hey tell me a Capitol One Credit Card Acct. I tell them Nice try, He does not have nor has he Ever Had a Capitol One Credit Card acct. And to Not bother me again with this nonsense. Good news, I got a couple of weeks quiet by not hearing from them. latest news, they have now called my cell 3 xs in 24 hours. I had read this Is a Scam and so I do Not give them Any information about Either of us, no B-Days, no addresses, no other #s At All! And then I hang up! I don't bother with blocking the #s, instead, I simply save the # to my Contacts in my cell with the name of Bogus Bill Collector and then when they call, I know Exactly who it is and Do Not Answer and they NEVER leave a message. good Luck to all( but Not Them,SCUM!).

    Portfolio Recovery Assoc Sued by Missouri Attorney General

    Portfolio Recovery Associates has been sued by Missouri AttorneyGeneral Chris Koster. The complaint alleges that the companies repeatedly used unfair and deceptive practices to collect debts in violation of Missouri state law. According to the petition, these violations included:

    •Purchasing debts discharged in bankruptcy, with the intention of attempting collections;


    •Attempting to collect debts from the wrong alleged debtor, and refusing to stop collection efforts when the consumer denies owing on the account;


    •Attempting to collect debts that are well beyond the relevant statute of limitations (note, these are often called “time-barred debts”;


    •Inducing consumers to pay on accounts that are already paid or discharged in bankruptcy;


    •Threatening actions that cannot be taken, such as garnishment of social security;


    •Refusing to identify themselves or the account being collected and continuing collection efforts;


    •Refusing to provide proof of the debt when requested to do so by consumers, and continuing collection efforts;


    •Repeatedly calling consumers after notification that the alleged debtor is not at that number or residing at that location;


    •Repeatedly calling consumers' employers after being advised to cease the practice;


    •Submitting false credit reports, and refusals to remove the reports after notice;


    •Assessing interest and fees that are not owed;


    •Filing lawsuits against consumers without documentation to support the case; and


    •Filing false or misleading affidavits in Missouri courts, and,


    •Violating state law in their attempts to collect debts.

    The company (which you may also see referred to as "portfolio recovery services") will have the opportunity to respond to this suit, and we will post any public response we find.

    I have been receiving calls each day for about a monthn now.  I stopped answering my phone.  I was about to pay until I realized that the bill is 5 years old which means that the debt will fall off my credit report next year.  I can do something else with that money like feed my family.  Hope they realize that it's hard times for everyone.  Debt has no limits so they too will be faced with the same thing they are doing to others.
