SOL only limits the collector from getting a judgement against you.  They can sue you and it is YOUR responsibility to prove to the court that the debt is beyond the SOL.  Though it imay be beyond the SOL, it still affects your credit score in the form of inquiries on your credit.  You still owe the debt.  You can choose not to pay it, but there are consequences.  Go to ftc.gov and check what I have said.  It's there in plain english.

And so many of them have gone away on their own. One I sued for an FDCPA violation and got a nice check. I'm fixin' to sue another ... and a third is also teeing itself up. This is fun, and profitable too. But I wouldn't use any of the money to pay any of the collectors. Kinda defeats the purpose.

Has anybody noticed that Eric Holder has stated openly that he won't go after any systemically important bank or megabusiness, no matter what the crime? And no crime here, I just owe some measly thousands. Impunity. If it's for the big guys, it's for the little guy too.

It's not a trick, but it's entirely possible to do more harm than good when paying old bills. Bills so old that they don't show up on your credit can show up as paid late if you pay or arrange to make payments, reducing your score all over again.

I have been getting about 7 to 8  calls a day from this # 8773945975.  Which is annoying and I am disable and elderly.  I can not be harass like this.  Someone should put a stop to this insane harassment.  No one in a civilize country should have to put up with annoying calls everyday and all night.

This company called me 5 times so far today the 21st of Sept
and 2 times yesterday. They are a pain in the neck.
They never leave a message.

Even if the debt is out of your states limitation rules, they are still able to call and mail you to try to collect the debt.  They cannot sue you becauswe of the statute of limitations.  However be ward that if you do make any kind of payment it starts the debt collection clock all over again and then they can sue you.

The people calling from this number is Carson-Smithfield.  They are a debt collection agency-one of the worst.  They have been known by other names in the past and when they get sued they change the name.  They call me 3-4 times a day and I already have told them maximum 1 call a day only.  I even sent them a certified letter stating this fact which they recieved and I have the delivery confirmation in hand.  I have now contracted with a legal firm that specializes in suing these types of companies and they are beginning the process.  Thank god for the FDCPA.  I look forward to winning and getting a nice check from them.  

Got a call from this Number,  came up on Caller ID as  a TOLL FREE CALL,  no message left.

This number is Carson, Smithfield llc.  It is a collection agency for past accounts.  There staff is very rude.  If a person is making a monthly payment with no information sent each month, why should they get called.  They want payments every 30 days and if a person makes a payment on 11/21/13 ad it is 12/13/13 and they received a payment how is the persons acoount behind.  Will not answer a call ever again from them.  They can send mail if it is that important.  They also like to call phone numbers that have no significant use to the person owing them.

In order to legally stop the calls, you must send them a cease and desist letter by certified mail telling them to stop calling you.  This way your rights are protected.  If they call you after getting the cease and desist letter then they are in violation of the FDCPA and you have legal recourse against them.

I just changed my cell number so i was getting calls for whomever owned the number prior to me. I tried to explain that to them and they didn't want to listen. When they said they are recording the conversation I said that I was too.  They immediately hung up and I haven't been called since.  

Good point. Opportunistic, unscrupulous [***] collection agencies didn't exist prior to Obama taking office.  Dick Cheney probably owns 100 of these operations

I don't know who these people are, there are so many scams out there. I don't reply to something unless I get something in the mail, and I can verify if it's legit.

There are laws, you need to learn them. The president has nothing to do with it. Seriously you really need to handle your own business and stop with the OBAMA world crap. The FDCPA was in place long before Mr. Obama became President. Learn your rights and fight against the ones who deserve it.

These scum bag bottom feeders have a computer call me 5-8 times a day--I just ignore them and have no idea what rock they crawled out from under to harass me--do not even give these scam artist felons and criminals the time of day---just drop the call and put your number on the no call list...If there was a class action suite I would be glad to participate..

i'm with you they call and hang upon me i call them non-stop,haven't heard another word from them.

This number calls me at all hours of the day and I wish it would stop. I don't answer because I am unfamiliar with the number.
