Third call in two days! Greener Future recorded message. We're TPS registered and continue to receive these nuisance calls day after day. Thinking of getting rid of landline but no doubt would then receive on mobile numbers.

I have now been called 10 times in total by these people. As I am able to block the number the phone doesn't ring but I wonder how many more times they will ring - 20, 30, 40, 100? It's completely unacceptable.

The Information Commissioner’s Office (ICO) has served a monetary penalty of £90,000 to a company that has blighted the public with thousands of unwanted marketing calls.

DM Design, based in Glasgow, has been the subject of nearly 2,000 complaints to the ICO and the Telephone Preference Service (TPS). The company consistently failed to check whether individuals had opted out of receiving marketing calls – in clear breach of the law - and responded to just a handful of the complaints received.

In one instance an employee refused to remove a complainant’s details from the company’s system and instead threatened to “continue to call at more inconvenient times like Sunday lunchtime”.

The monetary penalty is the first the ICO has issued for a serious breach of the Privacy and Electronic Communications Regulations (PECR) relating to live marketing calls. This latest penalty comes after the joint owners of a company, which was responsible for sending hundreds of thousands of spam texts, received penalties totalling £440,000 in November last year.

The ICO has informed two more companies that it is intending to impose significant penalties over breaches of the law, with a final decision likely in the coming weeks. A further ten companies are subject to ongoing investigation for cold-calling and sending spam text messages.

Information Commissioner, Christopher Graham, said:

“Today’s action sends out a clear message to the marketing industry that this menace will not be tolerated. This company showed a clear disregard for the law and a lamentable attitude toward the people whose day they were disturbing. This is not good enough.

“This fine will not be an isolated penalty. We know other companies are showing a similar disregard for the law and we’ve every intention of taking further enforcement action against companies that continue to bombard people with unlawful marketing texts and calls.

“All of this work has been made possible thanks to the information we are receiving from the public, which has assisted our investigation team in identifying the companies making these calls.”

The ICO and OFCOM, who are responsible for regulating silent calls, work closely together and will be publishing an open letter to the marketing industry reminding companies that they must comply with the legal and regulatory measures in place. Failure to do so will lead to enforcement action, with the ICO able to issue penalties of up to £500,000 for serious breaches of the PECR, and OFCOM having the power to issue penalties of up to £2,000,000 over breaches of rules linked to abandoned and silent calls.

The ICO has setup a online reporting tool which people can use to send us the details of any unwanted marketing texts and calls. View the reporting tool, which has already received nearly 140,000 responses since it was setup in March last year.

This number calls every single day, including today, Sunday. I have reported on the ICO website twice now. Fveryone else who gets unsolicited and unwanted calls need to do the same. If you don't then thew will continue to get off with it.

Thanks Facts, nice to see the ICO actually doing something for a change.  Just shows you what the power of the people can achieve given enough encouragement.

Want your calls stopped if there is no other way ?  - tell the ICO.

I am receiving a lot of calls from this number, and when I answer, the call is terminated.

Got a call from this on Sunday. Listended to message from "Eco Energy" who install Solar Panels. Decided not to press 8 to be removed, instead pressed 1 to talk to someone. Recordng said I'd get a call within the hour. I didn't. Tried to call number today to remonstrate with them, as I have been TPS registered for years, but number goes dead. This is obviously a way of getting round call screening / blocking equipment. I've reported to TPS as nuisance call. I always try and report them, even when I tell the caller I am TPS and they apologise saying they'll take me off their list, as it is the only real way to punish them, Last month TPS and ICO made their first prosecution in the UK, DM Designs were fined £90 for cold calling, see below link.

Silent call then cut off.

Despite being ex-directory & on the TPS I have been receiving  daily calls from 07584627389/01415304547 from "Greener Future".  This despite asking for them to stop on numerous occasions.

As I am off work for the School holidays I decided to arrange an appointment with the sales rep who was surprisingly  "in the area and could visit me within 2 hours".

After explaining to him that I'm ex-directory, on the TPS and that its illegal to receive automated calls without my permission I was informed that "I hadn't updated the TPS registration which is only valid for 6 months".

Maybe the way forward is to waste their time as much as the waste everyone else's.  Everything else seems ineffective.

Eco Energy who are calling is nothing to do with http://www.ecoenergyscotland.co.uk/ This company is having loads of people contacting it. It even says on their contact page that it's not them.

We need to find out who it is but it is not Eco Energy Scotland trust me I have spoken to them and the ICO directly

Did the Sales rep visit and by any chance give true details of the Company to you.       For the record, it was a lie when he told you that TPS Registration needs to be renewed.      Your number is either registered or it is not.       The TPS website will quickly confirm whether or not any number is registered.      Mobiles can be registered too.

Hi guys can someone contact me in private and let me know the number they were contacted on and the date as we are in communication with the phone company who owns the number but they need to run a trace call which means they need to have a destination number and the date would be helpful to speed things up. Once used I will personally destroy all of your information. If you could email me directly and not post any private info on this blog thank you. The sales rep was from Penicuick.  The marketing company claimed to independent and offered me a choice of three double glazing firms, Weatherseal, Penicuick and another.  Only Pennicuick was available that morning.  

I asked for details and was told they have been trading for over 40 years - a check on companies house revealed they have been trading since 2008 only.  Lots of negative  comments about them online see:

Did the marketing company give out their name at all??

Here are the people that are calling you http://myhousegroup.net/ They own Zenith, Weather seal and many more. Call them up and get your details removed. This is the company pretending to help with your bills etc

Thank you for posting the comment to confirm that those nuisance calls are NOT FROM EcoEnergy Scotland Limited. We have had endless email/calls from the public about the cold calling assuming it had to be us.
It now looks like we are getting to the bottom of it, with the company My House Group apparently in the frame.
They own Penicuik, Zenith and many more of the same ilk.
The ICO recently imposed a fine of 90k on DM Design for the same thing, hopefully the culprits this time will receive the same fate.
They will also be hearing from our solicitors.

I have been receiving hounding calls from this company from an out of area number either silent or a rude guy at the other end. I've had countless calls sometimes into 10 a day

Today I did some digging and I called the hq and went off on one at the customer services dept threatening tps etc they claim they have removed my number lets just wait and see!!

Everyone call them on 01606866500 ask for customer services then if everyone calls then they might learn there lesson!!

I got this information direct from the telemarketer in Glasgow after demonstrating a fake interest in their product.
