Your will is likely to be one of the most important documents you’ll ever make and is the only way to ensure your loved ones are properly provided for when you pass away. It is therefore important to get it right.
Unfortunately, an increasing number of people are falling victim to will writing scams that leave them both seriously out of pocket, and either without a will they can rely on or without a will at all.
Rogue will writers
Citizens Advice has warned people not be conned by adverts and cold calls from rogue will writers promising to make wills on the cheap.
‘Some so-called will writers are advertising wills for around £24 in local papers and cold calling people by phone just to get a foot in the door so they can go in with a hard sell. Once through the front door, the true cost begins to add up to hundreds of pounds and people are often required to pay up there and then,’ Citizens Advice said.
In one case seen by the Citizens Advice Bureau, unsolicited phone calls resulted in a home visit where a payment of £498 was made to a firm that the clients have not been able to contact since the visit.
Hidden costs
It’s not only bogus will writers that consumers need to be on their guard against. Consumer champion Which? has recently voiced its concern over the amount of legitimate will providers that do not provide consumers with a clear and transparent service.
In its report Which? said: ‘We were concerned that some will providers were recommending that they are named as an executor without properly explaining the cost implications’.
Executors are the people responsible for sorting out your estate and dealing with the paperwork after your death. Yet, whereas the costs of appointing a professional executor can be incredibly high and vary considerably, friends and family members can do the work for free.
The Office of Fair Trading (OFT) said: ‘If you decide you need a professional executor, you should check to see how much it will cost. Some executors will give an indication of the price, however the price may change by the time you die. Others don’t give a clear idea of price at all’.
Consumers also need to be aware of firms selling extra products alongside a will, such as funeral plans, equity release schemes and trusts.
Sadly, many providers are more interested in securing a sale than ensuring the product they are selling is suitable for the customer. This means if you aren’t careful, what began as relatively inexpensive could quickly turn into a bill for thousands of pounds for products you might not really need.
If you are interested in taking out additional products, always seek independent advice and shop around first.
What you can do to protect yourself
Peter Spillman, council member of the Institute of Professional Will Writers, stressed the importance of seeking professional advice.
‘Clients aren’t to know what the right will for them is. People should have all the pitfalls of the will pointed out and alternative options given, so they can then make an informed will’ he added.
However, it is important to remember that will writers aren’t properly regulated. This means it is up to you to do your own homework and research potential will writers thoroughly.
Find out if the firm belongs to a professional body. Most firms belong to one of three – the Society of Will Writers (SWW), the Institute of Professional Will Writers (IPW) or the Society of Trust and Estate Practitioners (Step).
A spokesperson for the Legal Services Board said: ‘The consumers most likely to avoid falling foul of rogue will writers will be those who do a full check over the details of the service they receive – including the complaints policy, written quote and the details of any bundled services’.
You should also check the firm has insurance in place so that if you make an upfront payment and the company goes out of business you will still get your will written’.
Citizens Advice meanwhile advised: ‘Explore all the options. Check with a few local solicitors to find out how much they charge. You may have access to legal advice through an addition to an insurance policy which might cover the costs of a solicitor preparing or checking a will. If you are a member of a trade union you may find that the union offers a free wills service to members’.

“We have read the statement from Grant Bowles and believe that he is trying to recover funds from Gerald, However, if the company is in liquidation we doubt that this money would be recoverable for some time.
We now believe that the Legal Assistance T/A National Legal Assistance 07528993 as gone into Liquidation and the Official Receivers called into Mercury House last week and removed everything that was remaining, files, computers and anything of value. This was done without warning!! Probably so Gerald, Anthony, Joy or any other members of staff could not remove further evidence.

For anyone that worked there feel free to email us you may think that it is not important but small details can lead to bigger issues.
We don’t believe that Grant can do anything further for anyone, if this was the case then why hasn’t he been to the Authorities? As he worked very closely with Gerald and has been to many drinking establishments with him. He must have known something that would help with the investigations. Hope that this goes some way to answering your questions Leanne, why the justice system fails? Why has it been going on for so long? It is because people protect Gerald the question that should be asked is why?

It is absolutly insane how they get away for so long with this there are to many get out clauses for all rogue traders. What is the world coming to when it works in their favour. Even if they serve some time all of those affected will not see a penny of the money back an ppl like him will just continue somewhere else under new id's when free.
