A WEALTHY businessman has lost an employment tribunal after it was ruled that he had kissed and groped a teenage employee despite his wife being in the next office.
Donald MacLeod, 44, a director of the family firm DM Design Bedrooms Ltd, of Cumbernauld, was yesterday ordered to pay £1,070 in compensation to a telesales canvasser, Lindsay Wallace, 19, for unlawfully sexually discriminating against her.
Mllionaire businessman had asked to see the girl’s tattoos before the tribunal heard how he tried to kiss her and put his hands on her bottom.
At an earlier hearing in May, MacLeod admitted asking her for a kiss in exchange for a piece of wood, but claimed Miss Wallace initiated the advance.
Miss Wallace, from Eastfield, Cumbernauld, had asked MacLeod for a piece of wood in July last year. As they went to collect it from the warehouse, he inquired about her tattoos.
Miss Wallace, who has a tattoo on each arm, three on her hip, and one on her thigh and ankle, added: “He asked to see any ones that weren’t on show. I declined.”
After finding a piece of wood, they returned to an office within the building.
Miss Wallace continued: “He then approached me, tried to place his hands on me, put them around me, then on my bottom. I backed off and asked ‘How do I get out of the office?’ I was confused and very upset.”
MacLeod denied Miss Wallace’s version of events. However, he conceded that he did ask the teenager for a kiss, before insisting that she then made an advance on him.
In a written judgment yesterday, the Glasgow tribunal ruled: “We had no hesitation in preferring the evidence of the applicant to the evidence of Mr MacLeod. We made a close examination of the demeanour of each when giving evidence. We considered Mr MacLeod’s demeanour to be somewhat evasive.”- Caller: D M Design Ltd

I received the following back from the ICO after complaining to them formally, and requesting further information under the 'Freedom of Information' Act. Please excuse the length of the reply, however it makes interresting reading. Specifically 2 points:
1) See how the number of complaints about DM Designs Ltd is increasing month on month.
2) See how few complaints are responded to by DM Designs, and how few direct complaints are taken seriously by the ICO. Surely this is YOUR time to make your voice heard with the ICO, make loads of complaints to them, ask lots of questions under the Freedom of Information Act, and keep up the pressure on DM Designs. Here is the ICO reply to my questions.....

I am writing further to our email dated XX April 2011 in which we acknowledged your request for information to the Information Commissioner’s Office (ICO).
As previously explained we are treating your request as a request for information under the Freedom of Information Act 2000 (the FOIA).
As you have asked a number of questions in regard to “DM Design” for your ease of reference we will deal with each one in turn.
“How many times have the TPS informed you that they have written to the company in response to a complaint from a TPS registered individual?
How many times have the TPS informed you that they have failed to recieve a reply within 2 weeks as required?”
Firstly it would appear helpful if I clarify that the ICO receives information on a monthly basis from the Telephone Preference Service (TPS) in regards to complaints made to them. The information which we receive has the name of the organisation, the name of the person who has complained, the date, whether or not the company has responded at that time and a brief note of any response from the company (which in some instances can be as brief as simply saying “human error”). The information which we are provided with does not contain any contact details for the company.
For your information the ICO receives information from the TPS usually in the middle of the month after the date of the information. We do not receive updates from the TPS as to whether they subsequently received a response from a company at a later date.

The table below shows the number of entries for “DM Designs” for each month that we hold records from the TPS, and also shows how many of those have been recorded by the TPS as “no response”.

Please be advised that we do not hold information from the TPS for February 2008. We do however hold a table from TPS for the period 25 October 2007 to 31 January 2008 and I can confirm that there are 3 entries for “DM Designs” all of which state “no response”.
“If the TPS have had a response from the company, have they agreed to cease calling TPS registered individuals?”
It is not clear from this part of your request whether you mean “agreed to cease calling TPS registered individuals” as a whole or the specific subscribers who complained to the TPS. In the event that you mean all TPS subscribers as a whole we do not hold any recorded information which would answer this part of your request. This is because the information which we receive from the TPS does not state whether companies have agreed to cease calling all TPS subscribers as a whole.
However if you mean the specific subscribers who complained to the TPS I can confirm that five of the responses which they appear to have received from “DM Designs” do contain a note which indicates that the subscriber’s telephone number has been suppressed.
“How many individual complaints have you received directly about the company?”
We have conducted a search on our electronic case management system using the name “DM Design” and in answer to your request please be advised that the ICO has received eight complaints made in relation to the Privacy and Electronic Communications Regulations 2003 (the Regulations). For your information our system contains cases going back to 2004.
For your information the outcomes of these complaints were as follows;

For your information the outcome “Closed – enforcement not recommended” is where it appears that an organisation has failed to comply with its legal obligations under the Regulations but the ICO does not intend to take enforcement action.

In answer to this part of your request please be advised that the ICO has written to “DM Design” regarding six of the complaints which we have received (the ones closed as “enforcement not recommended”). In each instance the ICO has reminded the company of its responsibilities under the Regulations, advised them that they appear to have failed to comply with their legal obligations and the ICO has asked that they suppress the subscriber’s telephone number from their marketing lists.
“How many times have you contacted the company informing them that they have broken the law?”
In answer to this part of your request please refer to the answer to your previous question above.
“What is the result of your communication with the company?”
We do not hold any recorded information which would answer this part of your request. However as the subscribers have not made further complaints we assume that the company did suppress their telephone numbers.
“What is your next step to stop the company from breaking the law and harrassing telephone subscribers who are registered with the TPS?”
We do not hold any recorded information which would answer this part of your request.

After listening to him for an hour,he mentioned the company he worked for & where they are based.This triggered alarm bells, as I had previously had run ins with the company about the numerous amount of nuisance calls we were receiving.I asked him to leave, which he seemed reluctatnt to do, so I rang the local Police & they advised me to ring Trading Standards!- Caller: DM Designs

Said something about money vouchers totalling £800 + being on offer if I answered 3 questions. Told him that I wasn't interested whatever it was about. He accepted this politely and rang off. Didn't get round to telling him I'm TPS registered, but I suspect it wouldn't have made any difference if I had.

Sometimes trace on line if i can be bothered. but it's usually someone I've never heard of prob. trying to sell something..Would never waste money calling them back though!!

I admire your guts in trying to defend your practices on this forum, although you'll never get a fair hearing here! But if you don't think that your company's activities are wrong, I suggest that you read the legislation on 'cold calling', and ask yourself why the Telephone Preference Service was set up. (I must admit I ask myself, why it hasn't been replaced with something more effective.)
Alternatively, you could give us your own telephone number, so that we can demonstrate to you how harassed many people feel when their lives are incessantly interrupted by cold calls from companies such as yours. Perhaps then you will understand.
