    Yes, Janet, that would appear to be the case.

    I received the following back from the ICO after complaining to them formally, and requesting further information under the 'Freedom of Information' Act.  Please excuse the length of the reply, however it makes interresting reading.  Specifically 2 points:

    1) See how the number of complaints about DM Designs Ltd is increasing month on month.

    2) See how few complaints are responded to by DM Designs, and how few direct complaints are taken seriously by the ICO.  Surely this is YOUR time to make your voice heard with the ICO, make loads of complaints to them, ask lots of questions under the Freedom of Information Act, and keep up the pressure on DM Designs.  Here is the ICO reply to my questions.....

    I am writing further to our email dated 11 April 2011 in which we acknowledged your request for information to the Information Commissioner’s Office (ICO).

    As previously explained we are treating your request as a request for information under the Freedom of Information Act 2000 (the FOIA).

    As you have asked a number of questions in regard to “DM Design” for your ease of reference we will deal with each one in turn.

    “How many times have the TPS informed you that they have written to the company in response to a complaint from a TPS registered individual?
    How many times have the TPS informed you that they have failed to recieve a reply within 2 weeks as required?”

    Firstly it would appear helpful if I clarify that the ICO receives information on a monthly basis from the Telephone Preference Service (TPS) in regards to complaints made to them. The information which we receive has the name of the organisation, the name of the person who has complained, the date, whether or not the company has responded at that time and a brief note of any response from the company (which in some instances can be as brief as simply saying “human error”). The information which we are provided with does not contain any contact details for the company.

    For your information the ICO receives information from the TPS usually in the middle of the month after the date of the information. We do not receive updates from the TPS as to whether they subsequently received a response from a company at a later date.

    The table below shows the number of entries for “DM Designs” for each month that we hold records from the TPS, and also shows how many of those have been recorded by the TPS as “no response”.

    Please be advised that we do not hold information from the TPS for February 2008. We do however hold a table from TPS for the period 25 October 2007 to 31 January 2008 and I can confirm that there are 3 entries for “DM Designs” all of which state “no response”.

    “If the TPS have had a response from the company, have they agreed to cease calling TPS registered individuals?”

    It is not clear from this part of your request whether you mean “agreed to cease calling TPS registered individuals” as a whole or the specific subscribers who complained to the TPS. In the event that you mean all TPS subscribers as a whole we do not hold any recorded information which would answer this part of your request. This is because the information which we receive from the TPS does not state whether companies have agreed to cease calling all TPS subscribers as a whole.

    However if you mean the specific subscribers who complained to the TPS I can confirm that five of the responses which they appear to have received from “DM Designs” do contain a note which indicates that the subscriber’s telephone number has been suppressed.

    “How many individual complaints have you received directly about the company?”

    We have conducted a search on our electronic case management system using the name “DM Design” and in answer to your request please be advised that the ICO has received eight complaints made in relation to the Privacy and Electronic Communications Regulations 2003 (the Regulations). For your information our system contains cases going back to 2004.

    For your information the outcomes of these complaints were as follows;

    For your information the outcome “Closed – enforcement not recommended” is where it appears that an organisation has failed to comply with its legal obligations under the Regulations but the ICO does not intend to take enforcement action.

    “What action have you taken directly as a result of such complaints from individuals?”

    In answer to this part of your request please be advised that the ICO has written to “DM Design” regarding six of the complaints which we have received (the ones closed as “enforcement not recommended”). In each instance the ICO has reminded the company of its responsibilities under the Regulations, advised them that they appear to have failed to comply with their legal obligations and the ICO has asked that they suppress the subscriber’s telephone number from their marketing lists.

    “How many times have you contacted the company informing them that they have broken the law?”

    In answer to this part of your request please refer to the answer to your previous question above.

    “What is the result of your communication with the company?”

    We do not hold any recorded information which would answer this part of your request. However as the subscribers have not made further complaints we assume that the company did suppress their telephone numbers.

    “What is your next step to stop the company from breaking the law and harrassing telephone subscribers who are registered with the TPS?”

    We do not hold any recorded information which would answer this part of your request.

    I'm registered with the TPS. Just had a call from a Scottish female claiming to working on behalf of Fraser & Foster and offering to enter me into a competition to win £1000 if I would just answer two questions. Caller hung up when I expressed disbelief. Number was withheld.

    I have got this call numerous times.   When I say that I am registered with TPS she replies that this is the first time that *she* has called me and it's not her problem.   I don't know what I can do.

    The Commissioner has no powers to punish an organisation for a breach of the Regulations. His aim is rather to achieve compliance with them. In light of this we have written to DM Design reminding them of their obligations under the Regulations and explaining the action they must take to comply in future.... We will, however, keep this case on file. In the event that you receive further calls from DM Design please let us know in writing, quoting the reference number above. Where appropriate we will pass your complaint to our Enforcement Department for them to consider formal action.  Where an organisation seems to be persistently breaching the Regulations we can take further action to compel them to comply. "

    Thank you for your correspondence regarding the receipt of an unsolicited direct marketing telephone call from DM Design.

    I apologise for the lengthy delay in providing you with a response.  We are currently receiving a high volume of correspondence and this has meant that we have not been able to respond as promptly as we would wish.  

    The Information Commissioner advises on and enforces the Privacy and Electronic Communications Regulations 2003 (the Regulations). These Regulations cover the way organisations market subscribers by electronic means (for example using telephone, fax, text and email). Marketing can include the promotion of goods, services, aims or ideals.

    Regulation 21 of these Regulations does not allow unsolicited live marketing telephone calls to be made to a number if:

    ·        it is registered with the Telephone Preference Service (TPS), or the Corporate Telephone Preference Service (CTPS) and/or

    ·        a specific request has been made to the organisation not to make marketing calls to that number

    These rules do not apply if you have told the organisation that, for the time being, you do not object to such calls being made. The TPS is for individual subscribers and the CTPS is for corporate subscribers.

    From the information provided it would appear that DM Design has contravened the Regulations.

    The Commissioner has no powers to punish an organisation for a breach of the Regulations. His aim is rather to achieve compliance with them. In light of this we have written to DM Design reminding them of their obligations under the Regulations and explaining the action they must take to comply in future. We have also given them your telephone number and asked them to suppress it from their list.  This should take no longer than 28 days. After this time you should not receive further calls from them.

    We will, however, keep this case on file. In the event that you receive further calls from DM Design please let us know in writing, quoting the reference number above. Where appropriate we will pass your complaint to our Enforcement Department for them to consider formal action.

    Where an organisation seems to be persistently breaching the Regulations we can take further action to compel them to comply.     If you are registered with the telephone preferance system our policy is to be polite and kindly remove them from the database. This involves writing your details on a TPS sheet and giving them to our MANAGER who is responsible for removing TPS from the masters before photocopying them. I understand that employees will violate the system, but for £4.92 an hour having to get a certain amount of 'Bites' to get out for a cigarette or for a refreshment wouldnt you? Most of the employees are barely out of school but would you not rather see them working than sponging off of the dole? In the current climate there are limited jobs for people who have or havent got any qualifications but as i says earlier there are people that violate policies but for the people who take their jobs seriously and only work there to make ends meet spare a little sympathy and kindness for us and we'll do the same for you :)

    This number called tonight. Said it was a company called " Maxwell and Miller". and not to worry it was not a sales call but a postcode competition. They asked for me by name and asked if I was a home owner. then my postcode but i said I was not interested and she said OK and hung up.

    i worked for this sham of a company in kircaldy, started as a confirmer where u r handed a sheet with peoples fone numbers and post codes and how old theyr kitchen/bedroom/bathroom is and u have to fone the numbers these ppl dont know they are going to get a call, they took a call the following day by sum1 called a biter using a sheet from a phonebook a ruler and a highlighter, just asking them to answer a few quick questions . The confirmer has to then lie through their teeth and promise who ever is on the phone that they have been selected for voucher number 7 and they get a free plan and design and it isnt a sales man that calls, bull sh*t!! if they are speaking to an older person they have to find out if they have a private pension as this gets the sales man in there door and can do finance, i find it disturbing this company gets away with this, as that is some1s gran or grandfather theyr gettin preyed on. It is a sham i worked there for a very long time, confirmer manager confirmer manager, they dont even know wot theyr doing, one of the mangers has very bad hygeine and everone laughs at her, one manager sleeps with all his teenage staff, one feeds her staff pro plus to "keep them alert" the main pathetic man behind these Ian Loggie is a creep and sleeps with all the woman he can and they think they are going to get a "career" out of this.He has been sleeping with the admin girl which is plain for all to see even though she has a husband a child.  The company is a shambles the staff (managers) are a joke!! shame for these little kids that take the job on not knowing what they are getting into. The call centre should be closed down, its not even a call centre its a upstairs building with 2 rooms and some telephones and sheets of phonebooks!! disgrace.

    today very Scottish lady says they are Maxwell and Miller and are not selling me anything.  When asked if I could verify my postcode I asked why and she very rudely just hung up.  No mention on kitchens, but I think she sussed I might not be a push over.
