In May 2004, we received a letter from Capital One proving that my wife's account was closed with a zero balance.  Since then Capquest and many others keep trying, every few months, to get my wife to pay this debt which apparently ranges from £90 to £180. Many years ago I sent them a copy of this letter of course and Capquest's view is that it is ambiguous - the words "zero balance" being apparently ambiguous. My reply has been to suggest that they take me to court and ask the judge to decide.

The moral of this story:  They never give up but, they never bother to go to court, and have no actual power (until they court and win) and neither do their "house call agents",who are not bailiffs and have no right of entry).  So if you owe this debt, do not admit this or talk to them (although they will continue to pester and pass the debt onto other companies), but instead take advice and work out how much you can really afford to pay back each month and then make them unhappy by paying the original company that you owed the money to and not the debt collectors.

Do not worry about their threats, they have no power and if they do finally actually go to court you will receive papers from a court which tells you first to take advice and gives you time to think, and if you owe the debt to settle out of court (make an arrangement to pay a bit each month) before a court hearing date is arranged.

And if you do not own the debt, spend time getting proof that you can show to a judge so that if (and we have been ready for this since 2004) it goes to court, you can show the judge (nice person, sitting in a small room around a table that seats 8 and who is on your side) why you don't owe this money and asking him to agree with you,

Finally, remember that these companies buy large piles of debts and then try to make you pay up (paying their staff bonuses if they get money out of you). Eventually they give up and buy another load of debts from somewhere else (and sell on the ones that they failed with),  They do not care about you only about getting money from you, So make them go out of business - never pay them, only pay the company you actually owe the debt to - and get receipts.

Miss Belll replies to M. Humphries
called at 8 am, waking me up and didn't speak.
I called back . Sian 6733 said they were DBSL which stands for Data Base Solutions Ltd. She said it was a company call. I told her she had called a private number not a company. She asked for my number, which I gave then told me she couldn't find me on her system. She apologised for waking me . I told her not to call again as I would report her to TPS.
