Am to call to get a refund...this is stealing and not on! - AimeeEVERYONE!! Text STOP ALL, if you test STOP like they tell you to this DOES NOT work. Also get your mobile company to block the number since I posted above I have had no further texts on Fridays (today!). No response, unsurprisingly, to my direct complaint to Sure to win but phone pay plus registered my complaint and said;

I am writing to advise you of the outcome of your complaint to PhonepayPlus.
As you may be aware, PhonepayPlus supervises both the content and advertising for premium rate services. PhonepayPlus develops and applies a Code of Practice (“the Code”) to the companies which operate premium rate services (providers). These companies are bound by their contract with the Network operators or Level 1 providers to comply with the requirements of this Code.
In response to your complaint about this service, the Executive commenced an investigation.
Investigation
The Executive received 107 complaints about the ‘Mobile Candy’ and Peachy Win’ subscription competition competition service.
The Service operated under two brand names, “Mobile Candy” and “Peachy Win”. The Service offered consumers the opportunity to answer questions, which gave them the chance to win an Apple product, such as an iPad, in the bi-annual prize draw, and the chance to win £100 cash each week in a second prize draw. Subscribers were also given six random numbers with the opportunity to win a £25,000 lottery draw each week. In addition, some consumers were sent a promotional text containing an introductory offer of 50 Lotto syndicate lines.
Adjudications
The case subsequently went before a Panel for adjudication and its decision was that the service was in breach of the Code of Practice.
The Executive alleged that the service had contravened the PhonepayPlus Code of Practice (12th Edition, September 2011) (the ‘Code’) and raised the following breaches under the Code:
· Rule 2.3.2 (Misleading); alternatively
· Rule 2.3.3 (Consent to Charge);
The Tribunal upheld the breach of consent to charge. The revenue generated by the service fell within the high range of Band 2 (£250,000 - £500,000). The Tribunal’s final assessment of the breaches was serious. The Tribunal issued a Formal Reprimand, a fine sanction of £60,000 and a direction for refunds to be made to all consumers who claim a refund, for the full amount spent by them for the service, save where there is good cause to believe that such claims are not valid, and provide evidence to PhonepayPlus that such refunds have been made.
