- FREAKED| 7 repliesSo i was getting collection notices from this company for a while with respect to a debt i have with leons and citi. i have neglected to answer the calls and then i got a letter in the mail that said "notice of authority to file suit" i also neglected to respond to that. i was served with papers at my job at my work and never ended up going to the small claims court. it turns out since i didnt go i got somthing called a default judgement on my credit bureau and my wages are now being garnished?? are they able to do this?

- theTruth replies to FREAKED| 3 repliesmaybe you shouldn't have neglected the numerous times they had tried to get in touch with you/your rightfully owed debt, then you wouldn't be in the situation you are currently in. And of course they are allowed to do this! It went through the courts LOL. A default judgement is automatically awarded if you fail to file a defense. Garnishment of wages? Losing 25% of your pay must have been a rude awakening.
Lesson learned: avoiding your repsonsibilties and your rightfully owed debts will cause you more issues in the end. Hopefully others who come to this site to complain about calls will read what you are going through and choose to do the right thing...pay their bills. Or at least make an honest effort, return phone calls and explain why they cannot pay in the first place. That way, you don't wake up one day with a judgement on your bureau (for 20years may i add) and have to know that your payroll department knows all about your personal issues with abusing credit. The judges are usually lenient and would likely grant your motion and allow you to file a defence. Better act fast though! The longer you wait, the more unlikely it is that the judge will set aside the judgment.
- T replies to JKSh*tstain| 3 repliesWhat is extremely confusing to me is that you fail to understand one simple concept...without as you like to say "bottom feeders" no one would be around to collect unlocated funds that banks and financial institutions provide to the public. Which is quite necessary. I would hope that you have basic common knowledge to know that when people do not pay their bills and if there was no such thing as these "bottom feeders", your rates as a customer would sky rocket, and the economy would be severly affected. There is a reason collection agencies are around to contact debtors to make sure they obide by the contract they so willingly signed and pay their bills or at least make an honest effort by making monthly payments. Theres a certain amount of time alotted for someone who has been served to file a defense. If you fail to file that defense, the judgement is automatically awarded. Also, there is no such thing as setting aside a judegment!!! If you do in fact file a defense, a payment plan is put into effect where persons involved agree upon a certain amount to be paid monthly. Mind you, at this point in time you will not only be paying the amount of the debt but any other court costs and interest. If at any point the individual misses a payment and breaks the agreement, judgement is automatically awarded. Meaning, either 25% garnishment of wages or a lein placed against their property. If you work and own a home, they will go after the home first and foremost. If you are only empoloyed, garnishment will take place. Judgements also follow you no matter where you go.

- Tammy replies to JKThe crooks here is Citifinancial; CCL either works for or has most of their accounts from Citifinancial they jack up the amount you owe and expect you to pay it, I call their bluff and told them to take me to court and try and prove I owed the amount they said they knew they couldn't since I didn't own half of what they said I owed. Citifinancial is worst than a Loan Shark they are breaking the law charging more than double the amount that your borrow, people don't mind paying what they owe they just don't want to be ripped off. If these people claim you own more than you do call their bluff to take you to court they know they don't have records to back up their claim and that its against the law to charge more than 60% interest on anything. Pay what you owe not what they want. Please don't borrow from Citifinancial people they are corrupt and you will never finish paying them off. I borrowed 10,000 over 5 years ago, never missed a payment and I still owe them 9,000 rip off.

If you account is for money owing from Citifinancial I was advice you to file a former complaint againt them with the Ontario Government thats what my plans are. I am also going to contact the lawyers that sued Money Mart and won, I think if there are enough people filing complaints againt Citifinancial they might just get whats coming to them. - cll as348lesgot a call from them they had contacted a friend from a club that im in and told him it was papers for the club for me and if he knew where i was. when i called them the guy was freeking out on me and i told him i was going to sue them for telling someone thats not me about my buissness now i have the president of the club asking me what its about thanks alot a$$HOLES .he kept yelling at me so i hung up he called back 4 times then called my parents house saying he had documents for me what a dick. i called back and asked to talk to someone else and it was thesame guy he just said his name was diffrent. i asked if i could make payments and he said no and i have a couple of days to scrap up thousands of $ so im trying my best to do what i can no work means no money what can you do.

Our situation is pretty unique; card is in my wifes name, has not worked in 4 years, is not planning to go back to work anytime soon, is a stay home mom, and has no intent to ever need her credit profile as husbands record is flawless. Like other posters, Janice refused to make arrangements for payment on the first telephone call, demanding full payment within 48 hours. According to the Ontario Consumer Protection Act, they are required by law to make arrangements and accept payment from you.
These "agents" are really untrained representatives who are paid to bully people on the telephone. Yes, if you have an outstanding debt, you should certainly pay it. But you do have rights and deserve to be treated fairly. - OBVIOUS replies to FREAKEDYes they are able to do this. You neglected your responsibility to pay your debt. They can take up to 25% of your wages and 100% of your commission if you are making some. You should have responded to the calls and letters you could have Settled your debt.

A collection agent calls people who refuse to pay back money THEY took from the bank. Its not a giftcard from a bank giving you money to spend. It is money you are borrowing and THEY neglect to pay it back. If someone borrowed thousands of dollars from you and said oh oops cant pay it back now would you be okay with that? I dont think so. As well when you borrow money you pay it back monthly in small amounts and you have to neglect on that for ONE YEAR for it to go to collections.
Oh and they make more then 2 grand a month.. Just saying. As well if the person who owes money has family or money issues they make arrangements to fit their needs.
