    Need Some Help

    Sometimes, depending how long you've been in arrears, the best option is to allow the company to take you to small claims court.  As long as you file a defence, you will be entitled to a pre-conference hearing.  There, you can negotiate a settlement (full cash payment) or a payment plan and even request a reduction in interest payments.  Providing evidence to the judge of financial hardship, the judge may accept your proposal even if the company does not.  Also, don't freak out - collection agencies ALWAYS send out those notices as an attempt to force you to contact them.

    Here is what I reccommend - call them.  Tell them you can pay $1,500 right now and propose a monthly payment YOU can afford, not what the company wants.  If they refuse, allow it to go to court - BUT FILE A DEFENCE!  Document all communication with the company.  If you reach an agreement re: payment plan out of the courts, send them a registered letter detailing what you discussed and save a copy for yourself.  And then honour your agreement.  And always, always, always, save all communication from the company, and all correspondence you have sent to the company.

    From full-time employment, to ei, to social assistance, to part-time work in a span of 5 years (still searching for f/t work, even p/t work that would work with the schedule I have with the p/t work I do now -- can't get a job if you can't even get an interview!), credit cards went by the wayside, and interest just kept piling on.  Total credit card debt now is more than I was making f/t, and 3 times what I make a year.  And this year I lose one source of income for sure, two if my son does not return to school, so I'm going to be hurting...basically any extra I have each month must be put towards living expenses for the months when my income is very low (hours cut at beginning of each year)...right now I'm in subsidized housing, so that is ok, but that doesn't last forever, then I'll be screwed.  Basically, what I have to live on a year isn't enough for one person, let alone 2 people (I'm a single parent), so keeping a roof over our heads and food on the table is the priority.

    I spoke to a trustee in bankruptcy the other day.  He says I'm in a bad position because the creditors are calling (they've been told everything is to be in writing...but have had very little of that from them) threatening to sue (in fact, one is indicating they are going to commence suit - funny how it is the one with the lowest amount owing that is being the most aggressive in trying to collect), and I'm going to have less money coming in later in the year, making next year a very stressful year and it isn't even here yet!  Anyways, he said that yes, going for bankruptcy is something I should be doing, but not at the moment.  First of all, he said the creditors can only go after 3 things: a) property  - I have none so not an issue; b) seize bank account - since I changed banks to one where I don't have credit card debt, they can't do that; and c) garnishment of wages (which the trustee said is only 10% of your wages).  Even if they try to sue, he said it still takes time for things to proceed.  So until my back is against the wall, he says hold off as long as possible.  BUT, he said NOW (early part of the year) is NOT the time to file bankruptcy - if I were to file now, not only would I lose my income tax refund for 2012, but also my income tax refund for 2013.  But if I wait until I get my tax refund, then file, only my 2013 tax refund (which will be very little, as that tax year, I'll no longer be claiming my child as equivalent to spouse) will I lose.  Being that I'm looking at about $200 per month for 9 months to be in bankruptcy that I have to pay the trustee, he said I could use the income tax refund to pay the trustee, then unless my income goes over (surplus) in a given month during the time of bankruptcy, then I'm paid for the bankruptcy and can concentrate on building up savings to pay for my living expenses next January when my income is half (or worse) what it is later in the year.    So the creditors can do all they want because I'll be filing bankruptcy at some point this year.

    I worked for this company for many years. I feel it's important for you all to understand that management put so much pressure on their employees to collect or get fired. They are taken into a room every month and berated if they don't meet their targets. They work 10 hour shifts and still expected to work weekends. They expect you to live, eat and breath CCL. They break a lot of labor laws, not just collection laws. There is a very high turn over there. I'm a very polite, professional employee. I always treated the people I called with respect. But I found that they too could be rude and abusive. Imagine what your day would be like working for this company. Why did I stay so long? As a single mom I had to pay my own bills and was unable to look for something else due to the long hours I had to put in working for them. They finally pushed me to the point where I was so burned out I had to quit without notice. This company is all about greed. They don't care about your situation or about the people that work for them. Bottom line I would never work for another collection company again. It's too stressful. As far as paying your debt, bottom line is it's not your money. You have an obligation to pay it back. If there were no consequences for not paying your debt I don't think anyone would pay their loans. I know I wouldn't.

    I just got off the phone with a lady with the name of Paulina from CCL and although I owe money. She was very pleasant to talk to. I even enjoyed my conversation with her.
    If you people borrowed money from a friend, wouldn't you want to pay it back? Why is a stranger or business any different? With the settlements they offer, the interest if removed as well as some of the purchases.
    No ones likes to pay back or what not. After the money is gone, it's hard. Trust me I know. But what's the right thing to do? I'm dropping 15k for my mothers debt tomorrow. Think I enjoy that? Not so much. Grow up.

    Ok sure this is from a company that claimed to CIBC calling my parents house looking for someone with the same last name? If you weren't  deceitful you may get some respect. Also I have called on my parents behalf to cease the calls from their house and the calls continue for someone who is related to them,  shame on you.

    I have 2200 credit card debt with MBNA that I fell behind on. I was paying but not enough to catch up to the past due amounts. According to my credit report they sold/written off the account. I was getting phone calls from CCL leaving me voice messages that I could barely make out. Then I receive a letter from CCL saying they bought the debt from MBNA and to pay within 10 days. I sent a registered letter requesting to only be contacted by mail and asking them to validate the debt as the amount seems higher than what it should be. I also mention if they can verify the amounts and the debt I would be willing to make payment arrangements. They send another letter that says if I don't pay within 10 days they will commence legal action. Another letter comes with "the authority to file suit". I responded again reiterating what I asked for in the first letter. Then I get a letter that says "statement of account" which shows interest. I still don't have any proof that they are actually legally allowed to collect the debt or that the debt was actually sold to them. They are also ignoring my requests for payment arrangements and want full payment. I honestly want to pay the debt if they would be willing to work with me they just seem to want to threaten legal action and expect me to pull the full balance out of thin air. Who would just pay a debt because someone says they are now entitled to it without providing you any actual proof that they are?!?!

    Beware of this company. 905 715 7399 It may be a legitimate debt collection agency for Ontario but we are in BC and we are getting all these messages from them telling us we need to call right away about some overdue payment.
    First of all we have never lived in Ontario second we are 6 years into bankruptcy. We have not had a CC of any kind in 10 years.
    ALL of our debts are finished. We made all of our payments.
    We even called our financial officer who went through the bankruptcy process with us to see if something was missed and she assured us that we owe NOTHING to anyone.
    This may be a real debt collection agency but they are trying to scam us so be careful.
    Know your debt history really well before proceeding with these guys.
    Legitimate places can run scams too.

    a collection agency can contact you they need to send you a written notice through regular mail (email doesn’t count).

    This notice must include:

    the name of the person or business that says you owe them money (known as the creditor)
    the amount of money that the creditor says you owe
    the name of the collection agency and a statement that the creditor has asked them to collect the debt
    After sending the notice, the agency must wait 6 days before they can contact you in person or by phone.

    After their first conversation with you, an agency can’t contact you more than 3 times in a 7-day period without your consent.

    “Contact” means the agents must actually speak with you, email you or leave you a voice mail. If you don’t answer the phone and the agents don’t leave a message, it doesn’t count as a contact. A letter sent by regular mail also does not count as a contact.

    A collection agency can’t:

    contact you on a Sunday, except between 1 p.m. and 5 p.m.
    contact you on any other day of the week between 9 p.m. and 7 a.m.
    contact you on a holiday
    use threatening, profane, intimidating or coercive language
    use undue, excessive or unreasonable pressure or harass you
    charge you any fees

    I am a private investigator and have done numerous investigations on these guys.

    They threaten you and use illegal practices . DO NOT pay these LOW LIVES.

    My clients will be suing them for these illegal practices.

    I would defiantly like to be involved in a class action suit with this company. My wife received numerous calls where vmail was left by Sean Morrison in a one day period while at the same time I would get telephone calls with no messages left, and then finally Morrison left a threatening message on my cell phone. I immediately contacted Morrison who spoke to in a condescending tone demanding that he receive the total sum of $16,303 from me in a 25 hour period or the matter would be passed onto the courts.  I advised Morrison that I had not received any documentation and requested for on to be sent which was refused.   I complied fully with Morrison by confirming my contact information and even giving my email address to him. I stated that I would make payment arrangements with him which he refused offering me a onetime offer for a total of $12,500 if I used a Broke which he had suggested, surly a friend, and the payment could be held off until Monday.
    The next day Morrison once again telephoned my wife and with no satisfaction telephoned my place of employment with no just cause.
    I have emailed CCL a complaint letter stating what has been done prior to filing a complaint with the Government of Ontario.
    Something has to be done with this company.
