- Santired replies to RONThis is something consumers aren't aware of... the trick of selling a collection to another agency so that it appears on your credit report forever... you can callenge this! Contact the reporting agencies as they are bound by the originating note date and when it goes into default. Other then IRS, student loan debt or BK... 7 years is maximum that it can be reported on your credit report. If you challenge something on your credit report as havin max'd out the 7yr limit. The agengency then challenges the agency that is reporting a negative rating to prove they own the debt and the original documentation... the company then has 30 days to provide this information and if they can't support this information that the debt is below the 7yr mark... the neg rating is automatically removed!
These collection agencies are not god ad can't ruin your life forever... no matter what they like to think! You all should also be aware of the statute of limitations of debt in your state. Its usually between 4-6 years (though in some states it can be more or less). Once you've passes the limit you can demand that agency stop contacting you!
As for Santander... they're a real piece of work! I too have had my loan sold to them and they've made my life hell ever since. My loan amount is still really high after 4 years of payments! I've asked for a break down of my payments (which they have to provide). They've added an additional $536 in "fees" but have yet to explain what they are and will not provide me info on where these fees originated from... I've asked for a copy of the original note (proving that they have the ability to legally collect on my car note) and of course... they haven't provided any of this. Whether my caqr payment is on time or not is irrelevant to them... they call 6 times a day.. 7 days a week!
I've done some research on Santander Consumer USA... their main US office is based out of TX but they're actually a subsidiary of the Bank of Spain! I guess they think they'll save their country's banking system via the backs of Americans. Santander is not a financial institution but a collection agency but they claim the protections of a bank... this is how they get away with what they do! I've been keeping a detailed log of all their calls... keeping copies of phone records and a detail of everytime I've spoken to someone so that I can take this all to a lawyer... as our states AG and the FTC hasn't done s*** about this companies bad business practices!
Also... my husband had some serious hours cut so we went to them for a "loan" modification... after months of back and forths we finally got the paper work and in the paper work it says... "this laon modification only affects the payment amount and does not change anything else from your original contract"... yet the very next statement I received shows my maturity date extended for an additional 6mos... the same amount of time of my loan modification! This too is in my "to sue them" folder!
One last item in their bad practices... they've recently begun charging $11 of their online payment feature that used to be free... another way to gouge us! So I shrugged when I saw this the first time and tried to pay... the "system" would accept the payment using any of my banking info... including my debit card and my husbands payroll card! So I started mailing in my payments! I first started mailing them in early to try to avoid these calls (though at times it doesn't matter if they have my payment or not to help avoid their harassing calls)... when I mailed the payment in earlier... they would send the payment through electronically over drafting my acct... if I mail it in on my payment due date...(I have a 10 day grace that they don't recognize and charge me late fees from the day after my due date... also illegal!)... they sit on my payment for 3 weeks so they can charge me a daily late fee! So I've had to start sending in my payment via registered mail so I can have a record of this as well!
Their business practices range from unethical to out right illegal and people need to start compiling information to sue them... class actions are hard to start.... it might be easier to find a consumer lawyer... a shark willing to work on consignment and then sue the pants off these creeps!
A collection co is only allowed two calls per day! Each call outside of that can produce up to $1000 per call in fines and the other stuff they do is also tied to discouraging penalties! The only reason they keep getting away with this is because not enough of us have sued them! I know complaining about them is cathartic but we need to now take action! There's a class action law suit in TX being worked against Santandar but you have to be a resident of TX to participate. Two other legal firma that I'm aware of that are compiling a class action against Santander is the law office of Gary Green and David & Norris LLC... you can google them and google "Class Action Santander" and you'll see pages of results!
I'm also not sure... but the fact that they've changed some of the tenants of your original contract... such as ignoring a grace period and charging late fees may be illegal without the signing of a new contract and/or your consent... also I'm wondering how they apply most of your payment to interest... pushing your maturity date out... there may be something there!
I also think that they purposely attempt to ruin people's credit ratings so that you are stuck with them and can't refinance your loans with someone else. I've recently switched over to a credit union... I'm working with them to refinance these last 10 months (my orignial maturity date was 1/2012 but somehow my new maturity is 9/2012 and they can't explain why... this can't be legal!)
I apologizes for the length of this post and the typos... though it important to share some of this info! We need to do more then just complain... we need to take action! The more of us that join class actions or start their own law suits... the quicker we'll push this company out of our lives! The bank of Spain is trying to get a bailout via the backs of Americans anf I don't know about any of you but I'm sick and tired of our country kneeling at the throne of corporate profits above all else! If corporations are people... then bad behaviour needs to be punished and these folks only understand is money and bottom lines! Let's kick them in their "bottom lines" all the way back to Spain!

SANTANDER CONSUMER USA - They start calling the day the loan is due - told them I have a 10 day grace period - they said not with them, that was with CitiGroup when they owned the loan - told them they have to honor the contract I signed. I refuse to deal with these people anymore, they are relentless, rude and do NOT honor anything they tell you when you try to make arrangements with them. With the economy as bad as it's been, we have fallen behind, but continue to make full payments, and now they are worried about late fees? Yah, like they won't bury those into the loan payoff balance. Here are a list of number that I have recorded so far that they use, to call me like 10 times a day on my cell phone.
