    also i should have mentioned, that even if you did take out a lone, then it is a 95% chance it is non enforceable, most loans taken out before 2005 are no enforceable because the paperwork is wrong, and most of them were miss sold.
    so next call you get ask them to send you a copy of the debt agreement(by law they have to if you request it), they wont send it, and remind them that its a non enforceable debt they are trying to claim, and its there stupid fault for buying crap debts from companys who made errors, although in your case jit you have no debt, so will be quite amusing if they do send you a copy of the credit agreement.as non should exist :O)

    Have you gone bankrupt? Im really considering this but have a house with secured loan 4 kids a car etc probably a little equity not much though, unsure if we will be forced to sell house

    no i have not gone bankrupt yet, i am waiting for 1 of my debts companys to make me bankrupt.
    i dont see why i should pay 500 quid when i am the 1 who is skint, let the debt company pay it.

    but i would say if you really are in a bad way and bankruptcie is the option you have chosen, then seek legal help.
    but it is worth trying, you may not loose your house, as you have kids and to make them homeless would be an infringment of the childs human right, its worth trying, uk laws are crazy as [***] now so you never know what the airheads in parliment have come up with, not to forget the braindead zombies in the european council who make even more stupid laws.
    the best thing to do is go see someone who can give you the do's and dont's. at the end of the day you are taking a chance. and you need to be aware of the posatives and the pitfalls..

    hope you get it sorted soon, and keep your house too, its not unheard of.

    I just had a call from this number it is capquest obviously from what i can see. But i'm reporting this what happened earlier when they called me and by the way yes i am paying a pud off a month which they are getting so why call me you ask? Well the story is like this basically they called me to confirm my date of borth im like ???? what you've been taking money of me for the past year and a half. but no they are expecting me to send my passport yes my passport through the post to them which i am not going to do i will go through cab and fax it and they agreed and they gave me no number duhhhh. anyways these people are getting their money so why the hell keep pestering me im sick of it now im taking it further cos basically they are just pushing their luck tryingto get more money well hey mate im still on the same income i was on b4 and even though their getting their money they keep and keep harrassing me so watch this space guys i got my 4th baby due in a week or so you wait until after i will be takeing these ass***** to court cos ive had enough and im gonna do them for harrassment i think anyone else who getting harrased like this even though their paying should think about court too and no i wouldn't bother being polite to them they talk to me like crap today and i spoke back like it to them an all had enough this debt company is getting sued and im getting my money back watch this space :)

    Do not pay them a penny!
    The time has past for paying back the debt!
    The time limitation is 6 years and as long as you haven't payed a penny in them 6 years you don't have to pay a penny
    And as its not even your debt your not even expected to contact them back
    I had a debt over 6 years old and when i quoted the time scale the debt was quashed

    I had a call from these dumb persons (being polite)
    And i didn't know who they were so i zapped them with my TrueCall machine
    Now when they ring it starts out telling them that i do not wish to receive calls from this number
    And if they keep on calling it gets nastier and nastier the response they get off my TrueCall
    And the best thing about it is my house phone doesn't even ring!
    They can't ring withheld or anonymous either because the TrueCall intercepts the call and tells them i do not accept either of them types of calls!

    had a call from theses guys. I just look the numbers up on this website and store the numbers on my phone. Then i know whether to answer or not. makes life so much easier. Don't get stressed by these debt collection companies they get fed up after a while and another company takes over.

    Capquest have been ringing me every day between 2 and 5 times a day for 2 weeks now. They sent me a threatening letter saying if I didn't respond by a certain date they would take further action, and that the matter of my debt will not go away. I'm scared but I ain't takin their calls or replying to their letter. I offered to start paying £20 a month towards my credit card debt TWO years ago and was told it was unacceptable, they wanted £140 a month. I said that was impossible and haven't spoken to anyone since. I've offered two lenders repayments at a reduced rate and both refused! So I dunno what else I can do, they just keep passing my debts on to other collection agencies who threaten me for a while then give up and pass it on to another agency ad infinitum.

    This is a load of rubbish.

    1) You DO NOT have to inform them that you are recording the call.  No such obligation exists.
    2) Nobody, anywhere is "entitled to 30mins fell legal advice" and that some solicitors might offer this is of no consequence.  
    3) Debt collectors have no right to enter your house, even if you did give them a key.  You are confusing debt collectors with bailiffs and even then, doing a very poor job of it.

    In short, you're a fool and your advice is wrong.  

    I suggest nobody reads this, much less pays any attention to it.

    had a call from Capquest but unfortunately for them I have Truecall and have Zapped both this and their other 01252576438 number (no doubt they have others that I look forward to adding to my zap list!)

    Calls started about 2 days after a letter I had from them

    Unfortunately for these 'people' they have been sold a pup as I have a court order detailing that no debt exists with the original OC (who have of course chosen to unlawfully sell the 'debt' to Capquest)

    I see court action coming their way if they continue their harassment

    you must work for a debt company!!
    i spoke with my solicitor today after reading this post, she advised me to tell them when i record any conversation, as she said it would prevent them trying to say she was a 3rd party(whatever that is) and i had 30 minutes free with her to, i also called 4 other companies in my area and all of them said i could have a 30 minute consultation at no cost.but i would have to wait until next week, or i could come in on saturday when they hold a free clinic
    guess your just 1 of them people who just has there head in the clouds.(i was going to use a different word, but i am a lady)
    there is always one on every forum and it seams to be legal-1 in this forum, maybe you need to go get a proper education

    These people are now becoming a nuisance as they are making persistent telephone calls now on Saturdays to my mobile phone as well as a landline depite these numbers being registered with the TPS - Telephone Preference Service. A measure I suggest you all consider

    Remember that this oufit has probably bought debts from another source so ask youreslf the question - do you have any contract with them?

    Like others they will have a job getting blood out of a stone!

    Got a letter from Capquest this morning:

    "Prior to the start of legal proceedings various checks and validations are undertaken to establish facts around your current circumstances.

    During this process it has been established that there are no outstanding County Court Judgments registered against you at the above address.

    We are highlight this to you as a matter of urgency. If we need to start the legal process and a Judgment is obtained against you, this may have a damaging affect on your ability to obtain credit both now and in the future, as a Judgment will remain on hyour credit file for 6 years and may affect your credit score."


    Blah blah blah for a bit, then:

    "All we ask is that you make contact on 0871 *** ****, before 06 Oct 10. No contact by this date will result in your account moving forward to litigation."


    I'm seriously bricking it. I don't have much money - got a baby on the way in December, very little savings and low income. I don't want to end up in court. I'm not sure what to do. Can anyone advise me? Is it looking likely that I'll be taken to court if I don't respond?

    Got another letter this morning saying they will begin proceedings on 10th October unless I get in touch by the 6th. Is it true that if I make any offer of payment they have to accept it, even if it's low, like £20 a month towards a £3500 debt?

    They say in the letter that I can offer a repayment that suits me but I've heard that before and offered a similar monthly figure which was rejected (that was for a different account).

    If anyone knows the score, please advise.
