There are good trusts and there are bad trusts. Good trusts are part of a process used by legitimate estate planners and their clients to control the disposition of assets, avoid probate, reduce administration costs, save estate taxes, and preserve family wealth for future generations. This article is not about the good trusts. It is about bad trusts.
Companies that churn out “standard” living trusts or any other kind of trusts sell their services in seminars, and by telesales Without any concern for your overall estate plan, these companies often try to sell you a trust in a “one-size-fits-all” package. This can have a detrimental affect on your estate plan and may result in the transfer of property to the wrong heirs, while costing you a great deal of money in preparing the trust agreement.
In most cases, such companies purport to use the services of an solicitor, but usually, the solicitor is only a front man for the company and does not play any part in the creation of your estate plan or trust. Also, such companies often make false claims about the benefits of a trust, in particular, they exaggerate the beneficial effect of a trust when it comes to asset protection, Deceptive trust companies can be spotted in a number of ways:
• They often sell trusts through seminars or through telesales, without giving you any way to check the credentials of the sales person or company.
• Watch out for “sound alike” names confusing their services.
FINAL WORDS OF ADVICE – Any trust should be created only after a thorough review of your tax, estate, and personal goals. You need to talk with your team of professionals perhaps an accountant or financial advisor to make an informed decision on whether to create a trust.

Until I found this site I really felt we were the only people who had been scammed by Minster Legal Services, it has been quite an eye opener to realise how many other people have been affected. We have contacted a journalist who is writing a piece for her publication specifically naming and shaming Minster Legal Services and I intend to do everything I can to make as many people as possible aware of these villains. It is appalling that they are still allowed to continue to trade and open new companies constantly. It is to be hoped the new regulations for will writing companies come into place as quickly as possible to put an end to the misery these people cause. I have not joined the link you gave me as I live in Hull where they were cold calling lots of people last September, don't know if there are others in this area who have ended up with legally invalid documents.

This company called my mother who has dementia, regarding Care home fees, and that she would have to sell her home to meet the fees , if she went into care. This left her exceedingly distressed, and caused her sleepless nights, and endless phone calls and visits from relatives to give her reassurance. This company selling techniques are abysmal, and cause needless wory to elderley people, and thay were in breach of TPS rules, don not use them

My parents were cold called by Express Law (even though they are TPS Registered!) and they rather foolishly signed up to their will making service at a unbelievable cost of £845!
As soon as my mother told me i knew it was a con job.
My parents are in their late 60's and are both of sound mind,the person who visited them was called Paul Hunt.
They said that he (Paul Hunt) was exremely charming but my mother had her doubts,she actually refused to sign the paper work but felt pressured by my dad and Hunt the "salesman" and eventually signed.
My dad insisted on the 7 day "cooling off" period to think about the deal.
I heard about this scam and immeditely sent them an email (on dads behalf) to cancel the order,naturally they never replied.
Up to press my dad has rang them three times and has not had any sort of meaningful conversation from them.
Unfortunately the 7 day period has now ended and i fear that my parents will have lost their £845.
Incidently,my dad rang his credit card company and found out that they (express law) had taken the payment from the credit card the very next day.
As you can imgine my parents are extremely distraught,companies like this need to be stopped NOW as all they do is inflict misery and suffering on general law abiding ,hard working people.
I will be contacting trading standardsand Rogue Traders in the very near future

received a call from 08454753555 it was a very friendly lady calling on behalf of COMMUNITY CARE she said they had a lady (called CHRISTINE HODGKINSON I THINK ) in my area who would call to discuss my plans for the future regarding MY PROPERTY in the event that i may end up in care. I WAS A BIT INSULTED AS I AM JUST 49.Anyway i said it wasnt convenient and would she give me the phone no. so i could arrange a later date.Of course i wont be .PLEASE BE VERY WARY AN OLDER PERSON COULD BE TAKEN IN EASPECIALLY USING THE COMMUNITY CARE TITLE.These people think they are so clever please be even cleverer DONT BE HAD.KIND REGARDS.

patsy Thankyou for your comments. All of the aforementioned cold call and say that they are making awareness of the Community Care Act and that the Government will force you to sell your home in order to pay for Residential Care Fees if you need to go into Care at a later point in life. They then arrange a home visit and try to sell you products that are faulty and for a substantial amount of money.
We are pleased that you refused the appointment and wont be rearranging it. Please keep spreading the word for people not to accept these appointments and with the help of you and the rest of the public, we will stop these Rogue Traders.

They cold called my mother and visited her selling Trust/Power of Attorney, unfortunately before I could put a stop to it she had handed over alot of money (more money than the job was ever worth, as we have found out), we have tried to get the money back but of course they are not complying. This company have called my elderly and somewhat confused mother now on 2 occassions, sadly while I was out.
Not only did they confuse and alarm her with talk of going into care, they also seemed to be trying to talk her into selling her flat and stated (not requested) that they would come to visit to assess the place.
Happily she had enough wits about her to refuse this.

Jon Thankyou for your comments. We're not aware of that number, it must be a number that one of the telesales people uses to make the calls, as it's not recognised on who calls me.
In the defence of Express Law, it is not their usual practice to convince the Elderly and Vulnerable to sell their homes. They may have said the Government could force your mum to sell it, if she had to go into care and that they would come and visit with free advice and tell your mum how to stop this from happening and to protect herself.
Nevertheless we've heard from unhappy consumers via e-mail about some of Express Law's bad practices and there reluctance to deal with their local Trading Standards Office.
We understand about your concerns and you and your mum did the right thing in doing your research, stay safe and always check things out.
If you need further advice on protecting your parent's assets go to CAB, or a reputable Solicitor, Financial Advisor or a Will Writer that is registered with the Institute of Professional Will Writers (IPW).

Following being cold called, My mother paid £2500 to this company up front. She was taken in by the nice suit and business card and professional appearance. Internet research has revealed they have no professional indemnity insurance, they are not qualifies solicitors/ lawyers and are not bound by the same code of practice. It transpires that qualified solicitors will draw up a similar trust for approx £700. However unlike with this company, you won't need to pay solicitors up front and they have codes of practice that don't allow them to select and cold call vulnerable old people.

Will writing / prosperity trust scam
Nottinghamshire Trading Standards would like to advise residents of a new scam and to remind them to stay vigilant when dealing with unexpected telephone and personal visitors.
Residents have reported being cold called by telephone by sales staff who then go on to worry pensioners into setting up an appointment with a rep about their concerns over the potential cost of future care home fees.
The trader claims that they can set up a ‘family prosperity trust’ for you in order to avoid your house being sold to cover your care needs in later life.
The sales staff convince residents to sign up by exploiting a scenario that is of great concern to pensioners and then arrange an agreement for a trust document to be drawn up to protect the resident – costing from anything between £1000 and £3500. It is believed the document may not be as watertight as marketed, thus potentially leaving the householders property still at risk to the problem the trust is supposed to guard against.
If you have recently received an unsolicited call from a trader matching this description please contact Nottinghamshire Trading Standards on 01623 452005 or email trading.standards@nottscc.gov.uk.

A fear of dying or going into care has spawned a growing and, as Money Mail has uncovered, disturbing industry.
Unscrupulous financial advisers are getting away with fleecing vulnerable pensioners — often for their entire life savings. Sam Dunn and James Salmon investigate.
Going into care can be a stressful time for those moving into a home. It can also be a huge strain on families, who have made the heart-wrenching decision that their parent, or elderly relative, is no longer able to look after themselves. But this also makes pensioners vulnerable to unscrupulous salespeople.
(Vulnerable pensioners: On average care home fees are £2,163 a month, leaving elderly people and their families to worry about how to pay for them)
These vultures play on their fears of selling the family home, or seeing it snatched by the council to pay for care costs, or of dying without a will, or leaving the family with huge funeral costs.
A major part of the problem is the sky-high cost of care homes and the worry families have about how this will be paid for — and whether you can get financial help from the State. On average, care home fees are £2,163 a month.

CARE FEES AVOIDANCE SCAMS
Some companies prey on pensioners’ fear of losing their home when they go in to care. They claim to be able to stop the sale of a home to pay for care fees by putting it into a trust.
These unregulated firms claim this will protect the home from being sold to pay for the owner’s care fees as, since the house is in trust, it will effectively be disregarded.
However, local authorities have the power to void such schemes if they believe they were designed specifically to avoid paying the bills. Worse, this offer also tends to involve an upfront fee of more than £1,000, which the family won’t be able to get back.
There is no time limit on how far back a council can look to see if you gave away your house to avoid care costs. Part of the reason so many pensioners have been convinced to lock their money into investment bonds is because sometimes these can be exempt from means-testing.

RIP-OFF WILL-WRITING SERVICES
Most people want to ensure as much of their estate as possible is passed to their loved ones when they die. But the good intentions of many are often rendered worthless because they cut corners with will-writing services.
The Legal Ombudsman says thousands of largely older people are being ripped off by firms offering unregulated will-writing. It can cost between £60 to £100 to write a will — but some OAPs can pay hundreds for a similar service if they use the wrong law firm.
Adam Sampson, chief Legal Ombudsman for England and Wales, has called for action to be taken to ensure consumers are not left vulnerable by unregulated services. Many legal services, including will-writing, can be done by unqualified — and unregulated — individuals and companies.

Will-writing rogues get regulated

At last people wanting a will drawn up are to have some protection from the rogues infesting this industry.
The Legal Services Board has announced that everyone who writes wills must now
be regulated. The decision follows an investigation by the board, which said it had uncovered "systemic problems".
"We found consistent patterns of sloppiness, simple errors and poor communication," it said. "Too often consumers were subjected to unfair sales practices.
"There have also been some well-documented examples of fraud and deception."
Maybe they have in mind habitual wills conman Gerald Barton. When we came across him 10 years ago, he'd been running the will-writing company JHD Associates, which collapsed, and thousands of wills were dumped in a barn.
His Nationwide Legal Services firm was shut down, the High Court hearing that it was
"scandalously run to the huge detriment of the public".
And last year his Minster Legal Services of Gainsborough, Lincs, went under and this time boxes of wills were dumped in the street. Regulation can't come too soon for the likes of him.
Chairman of the Legal Services Board, David Edmonds, said: "Ultimately, people must be able to write a will with confidence, not fear. For that to be possible, everyone offering such services must deliver a baseline of consumer protection. This is not about extending regulation for the sake of it; it is about maintaining public confidence in an important legal process; enhancing the environment for reputable providers; and protecting consumers at particularly vulnerable times in their lives.

KW - CatGI work for a charity supporting older people in West Yorkshire. Two of my service users - both vulnerable, have been called and had pressure put on them to agree to a home visit from someone who wants to help them to check that 'they have their affairs in order'. I actually went to the home of one of them to ensure that they were not fooled into parting with money for anything. The second ladys daughter rang 1471 and gave me the number which I rang. The company that answered are called Express Law. I asked the woman who answered why they are cold calling people and making appointments with older people who are vulnerable and have dementia and learning difficulties, to which she replied that people need help with making wills and managing their estate..

On-the-run fraudster Graham Haste jailed

A NORTH Yorkshire fraudster who spent 17 years on the run is today finally behind bars awaiting sentence.
Graham Nigel Haste, now 50, used a series of aliases and travelled between three countries as he tried to stop North Yorkshire Police finding out where he was.
But a former policeman tracked Haste through Spain and the Canary Islands back to Britain, where he was arrested again after first fleeing in September 1995.
Recorder Martin Bethel QC, who remanded Haste in custody while a pre-sentence report was prepared, said: “It is high time these matters are resolved.”
Retired Detective Constable Paul Somerville said the case showed that criminals on the run could never rest, no matter how long ago they committed their crimes.He now works as international liaison officer for North Yorkshire Police’s specialist operations unit and has other long-term absconders on his radar.
“With the contacts we have got now with the international police forces all over Europe, we are certainly able to track him,” he said. “Because he has family here, we always expected he would gain access to the UK under false pretences.”
Even though Haste, formerly of Leeds Road in Harrogate, set up a new UK base in Sleaford under a new name of Joseph Croft, that was not enough to hide him from the law. North Yorkshire Police had told every police force in the UK years ago that they were on the look-out for him.
Mr Somerville’s involvement in the case began in 1995 when, still a police officer, he investigated how Haste got two false passports under two false names to help him get out of the country instead of attending his trial at York Crown Court.
He faced charges of obtaining £11,700 finance by deception, evading repayment by deception, two charges each of driving a Jaguar while disqualified and without insurance and one of using a false number plate on the Jaguar.
He initially ran to Pureto Cabopino, a holiday resort near Malaga, Spain then later left there amid allegations that he owed 2,000 Euros in rent, and made his home in Tenerife, the Canary Islands.
But Mr Somerville was on his trail and Haste decided it would be better to move to Sleaford in Lincolnshire where he set up home with a family under the name Joseph Croft. Other aliases used during his time on the run included Graham Varszegi and Nigel Maximilian Devere.
His actions caught the eye of Lincolnshire trading standards, who called in Lincolnshire Police, and they in turn got in touch with North Yorkshire Police.
Haste pleaded guilty to two charges of obtaining a passport by deception, the finance and repayment deceptions, all four driving charges and the false number plate charge.
Charges of forging a driving licence, handing stolen goods and theft of a television which Haste denies were left on his file.

But the most recent is an alleged mugging, at knife point, on the Director (Martin Smith) of Express Law, apparently there were no witnesses to the incident which happened yesterday morning (Friday 19th October 2012) at their West Moor Park Network Centre, Yorkshire Way, Armthorpe office as Mr Smith arrived to work.
Alana Benson (The Office Manager) was believed to be all shook up. Whereas Ex-Policeman, Andrew Hesketh (also an Employee of Express Law ) was unable to shed any light on the matter.
Andrew Young the other Company Director will hopefully be able to assist the Police.
