ESTATE PLANNING FRAUD - There are good trusts and there are bad trusts. Good trusts are part of a process used by legitimate estate planners and their clients to control the disposition of assets, avoid probate, reduce administration costs, save estate taxes, and preserve family wealth for future generations. This article is not about the good trusts. It is about bad trusts.
Companies that churn out “standard” living trusts or any other kind of trusts sell their services in seminars, and by telesales Without any concern for your overall estate plan, these companies often try to sell you a trust in a “one-size-fits-all” package. This can have a detrimental affect on your estate plan and may result in the transfer of property to the wrong heirs, while costing you a great deal of money in preparing the trust agreement.
In most cases, such companies purport to use the services of an solicitor, but usually, the solicitor is only a front man for the company and does not play any part in the creation of your estate plan or trust. Also, such companies often make false claims about the benefits of a trust, in particular, they exaggerate the beneficial effect of a trust when it comes to asset protection,
Deceptive trust companies can be spotted in a number of ways:
    • They often sell trusts through seminars or through telesales, without giving you any way to check the credentials of the sales person or company.
    • Watch out for “sound alike” names confusing their services.
FINAL WORDS OF ADVICE – Any trust should be created only after a thorough review of your tax, estate, and personal goals. You need to talk with your team of professionals perhaps an accountant or financial advisor to make an informed decision on whether to create a trust.
You can’t take it with you and you can’t change your mind, so draw up a professional will and trust. Thankyou for reaiding

Until I found this site I really felt we were the only people who had been scammed by Minster Legal Services, it has been quite an eye opener to realise how many other people have been affected.  We have contacted a journalist who is writing a piece for her publication specifically naming and shaming Minster Legal Services and I intend to do everything I can to make as many people as possible aware of these villains.  It is appalling that they are still allowed to continue to trade and open new companies constantly.  It is to be hoped the new regulations for will writing companies come into place as quickly as possible to put an end to the misery these people cause.  I have not joined the link you gave me as I live in Hull where they were cold calling lots of people last September, don't know if there are others in this area who have ended up with legally invalid documents.

PEOPLE BEWARE!!!!!!!!!!! if you want medical advice you go to a qualified medical practitioner, if you want your car fixed properly you go to a reputable car mechanic with qualifications, if you want an electrician /plumber you make sure they're registered with the body that regulates these people and not just someone who talks a good talk
So when you want a Will or similar services why go to some company or organisation like the ones mentioned or even The Society of Will Writers who claim to be non profit making but rip everyone off!
    They are all the same.

Next time you want something legal taken care of go to a proper law firm registered with The Law Society!!yes a proper law firm not like the one Express Law in Doncaster claim to be , The Law Society  have no record of them and they are lying to the public saying they are an established law firm     how low will you go  ANDREW YOUNG AND MARTIN SMITH???   http://www.expresslaw.org.uk/index.htmlCaller: WILL WRITING COMPANIES

    Message to clients

    SAGA LEGAL SERVICES/MINSTER LEGAL SERVICES

We wish to warn clients about the activities of these unregulated Will writers who have been trading on the reputation of the Saga Group (which provides services for the over 50’s) and which have been targeting elderly people with unsolicited personal calls persuading them to sign up to various legal services and obtaining substantial payments in advance. We have personal experience of this because one of our own clients in the area was unfortunately persuaded by one of their smart and well-trained salesmen to part with a cheque for £4,500.00. Her instructions had been cancelled but they have failed to return the monies. They have informed us that the sole proprietor has died and that the activities of Saga Legal Services have been transferred to Minster Legal Services, which operates from the same address.

The Saga Group has informed us that they have received information that over 50 individuals have been misled or duped into handing over money. They have reported the matter to the police and Lincolnshire Trading Standards. They instructed their own solicitors to write a “cease and desist” letter and they strongly suggest that our client insist that the police prosecute the people involved.Caller: MINSTER/SAGA/NATIONAL LEGAL ASSISTANCE

    Hi
Minster Leagal Services took £2,000 from my mother-in-law to prepair a Family Prosperity Trust. They sold this as a solution to her assests being used by the state should she end up in care. They failed to respond to a request to cancel the arrangement even though this was done within the 7 day cooling off period and have not produced any or the agreed paperwork or made contact in the last three months. They have not responded to telephone calls, emails or letters sent which is a reasonable indication they are not a trustworthy company. Our local trading standards office have told us the company is to be wound up and there is little chance of seeing any of the money again. They expect the company to be reborn under a new name and expect they will continue from where they left off. This firm survives on making elderly and vulnerable people part with money and they should be avoided.
The previous postt seemed to give reasurance that Minster Leagal Services seemed ok! but this is not our experience.

There's a lovely photo of Jonty Trotter (John Louis Trotter) and Graham Carr on page 3 of this newsletter which you may wish to print so that you can cut it out and keep handy when visiting elderly neighbours.

    http://www.wintertoncouncil.co.uk/pdf/wscf_newsletter_apr_2010.pdf

The April 2010 article mentions that they are from "Minster Legal Services" of Gainsborough, specializing in Wills and also mentions that "Of course there is a charge if you decide to take up their offer". Furthermore it states that "For free home visits please contact Graham Carr at Minster Legal Services by telephone Gainsborough  01427 619525 or by email info@minsterlegalservices.com". I really must try them...

This company called my mother who has dementia, regarding Care home fees, and that she would have to sell her home to meet the fees , if she went into care. This left her exceedingly distressed, and caused her sleepless nights, and endless phone calls and visits from relatives to give her reassurance. This company selling techniques are abysmal, and cause needless wory to elderley people, and thay were in breach of TPS rules, don not use them

My parents were cold called by Express Law (even though they are TPS Registered!) and they rather foolishly signed up to their will making service at a unbelievable cost of £845!

As soon as my mother told me i knew it was a con job.

My parents are in their late 60's and are both of sound mind, the person who visited them was called Paul Hunt.
They said that he (Paul Hunt) was exremely charming but my mother had her doubts, she actually refused to sign the paper work but felt pressured by my dad and Hunt the "salesman" and eventually signed.

My dad insisted on the 7 day "cooling off" period to think about the deal.

I heard about this scam and immeditely sent them an email (on dads behalf) to cancel the order, naturally they never replied.

Up to press my dad has rang them three times and has not had any sort of meaningful conversation from them.

Unfortunately the 7 day period has now ended and i fear that my parents will have lost their £845.

Incidently,my dad rang his credit card company and found out that they (express law) had taken the payment from the credit card the very next day.

As you can imgine my parents are extremely distraught, companies like this need to be stopped NOW as all they do is inflict misery and suffering on general law abiding ,hard working people.

I will be contacting trading standardsand Rogue Traders in the very near future

patsy Thankyou for your comments. All of the aforementioned cold call and say that they are making awareness of the Community Care Act and that the Government will force you to sell your home in order to pay for Residential Care Fees if you need to go into Care at a later point in life. They then arrange a home visit and try to sell you products that are faulty and for a substantial amount of money.

We are pleased that you refused the appointment and wont be rearranging it. Please keep spreading the word for people not to accept these appointments and with the help of you and the rest of the public, we will stop these Rogue Traders.
