"Rat Catcher" I guess there are a lot of companies with different addresses... It is a shame that the site KW pointed to had numerous addresses for numerous companies with very similar names. Unlike most on this site, "I admit I made a mistake!". Perhaps the rest of you should learn from that?

So do you really want to even entertain these so called specialists of their field con artists.

They have had over ten years to get it right, but they keep failing miserably.

I have been away on holiday but I am now back. I'm delighted by the mass of new data and developments that have been incorporated within this thread by KW and the regulars. If you cannot locate your will, it is best to have a new one written, ensuring it properly revokes the earlier one. If a friend or relative has had a will drafted by the company and has since died ...

If a Director of a defunct company was named as Executor and/or Trustee in your will ...

"You probably would not want them to be so now and so it is safer to have a new will drafted choosing different Executors and Trustees. You can merely execute a codicil to amend any aspect of a will but it is probably safer to execute a new will."

If you have a Lasting Power of Attorney ...

"Ensure that the person named as attorney is someone you can completely trust. If you are in any doubt have a new one drawn up."

If winding up has already started ...

"If winding up of an estate has already commenced by an Executor who is no longer able to carry on the process because they have died, or are in prison for example, or are just unwilling to do so then you, as a Beneficiary in that will, can apply to the court for a different Executor to carry on the task."

If you just don't trust your will ...

"Have a new one executed. Peace of mind is important. If your will was drafted by a company who are or were members of the Society of Willwriters contact them to find out what protection they have in place to assist you."

If you have had your joint tenancy severed ...

To all Readers you may already be a victim of this crime, or you may have just received the call/letter in which case we are sorry if we are too late to help, but for those who maybe saved the scenario of the scam is as follows:
1 You will receive a telephone call from a very nice sounding person.
2.They tell you that they are trying to raise awareness.
3.They scare you into believing that you may lose your home to care fees.
4.They tell you that the Government is responsible for this.
5.They say that they don't agree with this.
6.But don't worry as them at Express Law Ltd, or National Legal Services Ltd will tell you how to avoid this.
7.They tell you that there is a Consultant in your area.
8.They say the advice is free.
9.They arrange an appointment with you.
10.They send you a letter to confirm the appointment, then they visit you and that's where the scam begins.

This is one example of people who have been distraught about receiving cold calls by people purporting to be Will writers. One elderly gentleman sat through hours of conversation with a 'consultant' who would not leave the property until he had a cheque for £700 for a Will and a Lasting Power of Attorney, even though the client had not asked for the Lasting Power of Attorney. There was also no compliance with the cancellation of contracts made in a consumer's home or place of work regulation 2008. Fortunately the elderly gentleman had the capacity to go down to the bank and cancel the cheque.

Example of more Bad Practice.
A Will was prepared by a Will writer which against the clients wishes gave a large cash gift on the 1st death rather than on the 2nd death and would have therefore left the surviving spouse short of money if It had not reviewed in time.
