    Yes Bob I am receiving.  I in fact do not work in PR, I am on the sales team and as such do not get paid for posting messages on websites and if anybody DOES get paid for that, let me know!  And no, I'm not going to say anything is confidential between us and FP, if you wanna go check it out, go for it.  And your so called "prediction" pretty much covered every outcome of my response, so it was more a generalisation really, and Bob, what exactly should I confess to?  You seem to be under the disillusion that I am a manager or something there, and I'm not!  I have nothing to do with how the place is run but if you think there is something illegal going on there, then the onus is on YOU to report it, as you seem to be convinced there is a need for legal action.

    lol everyone who has had personal dealings with that company is aware that there are illegal goings on in there

    Proper business procedures are not followed, illegal substances used on the premises and people paid cash in hand thus avoiding paying tax and national insurance, which carries a hefty penalty if caught

    I know the company has been reported to various different places, and it comes as no surprize that its finally being investigated

    So Russell I dont see why you're continually bothering to respond and slap back for amanico when its plain for the eye to see exactly what the company is like, you are making a total fool out of yourself.

    Of course you don't! How could I be so foolish? You just sit up night after night, without pay, weekends included, replying to anyone wicked enough to slander your esteemed employers. Such nobility and commitment in this cynical age, it's enough to bring a tear to the eyes. (A tear of laughter, in my case, I'm afraid.)

    As I predicted, and largely because there isn't anything confidential - or anything at all - between you and FP. FP is, after all, an organisation which prides itself on its high ethical standards. (You may wish to look up "high" "ethical" and "standards" in a good dictionary.) The thought of being connected with a squalid outfit like yours is enough to fill them with horror. You can either withdraw your - not "your management's", but your - previous remark about a "link" between you and FP, and do it here, within 24 hours, or expect to hear from their legal department shortly. I think it's called a "passing off" action, or something similar.

    Action against you will be mostly regulatory, rather than legal. As you know.

    Bob, you may wish to look up the words "sarcastic" and "[***]"  I do get paid you idiot for doing my job (which I don't do at weekends) and how are you so certain that we don't deal with FP?  Funny how I have my own login details to their UK Adviser site and have sold 6 policies through them today.  And we hear from them all the time when they pay us the commission for selling their policies so maybe you should find out for certain who we deal with before you go around passing your own word off as gospel.  Both Amanico and Insurance Express (under the trading name Clare Brokers Ltd) are on the FSA register so if you go on the FSA website you will see us there and you will also notice that no action has ever been taken against them

    I'm delighted that you have confirmed that "the link" which you asserted between yourself and FP is that you sell their products. And "the link" between my local corner shop and the Kellogg Corporation is that the shop sells Corn Flakes.

    Unwary readers of your posts might have supposed that the "link" which you asserted between Amanico, your squalid little outfit, and FP, might have involved something a little closer. Your confession might just save you from the legal action I threatened you with. Clearly, you possess some low animal cunning, if not exactly intelligence.

    But I do remain impressed that you, as a mere humble toiler in Amanico's fields - not the owner, not the Managing Director, not the PR Director, paid no more for your efforts - nevertheless stand here valiantly in Amanico's defence. Some might think it surprising that the owner etc does not post here.

    Some might think - steady yourself, old chap - that this is because you have been lying when you say YOU are NOT the owner, etc. Well, that's the world we live in; some people don't believe all they read on the Internet.

    Yes Bob, it is a similar connection in the sense that Kelloggs are well aware that their products are being supplied to and sold in said corner shop.  The real point I was making however is that you can't just go onto the website and start setting up insurance policies for people, you need to be given login details by FP and they obviously trust us enough to do that.  I'm a bit confused about this legal action though, what exactly am I supposed to confess to?  Are you threatening me or the company with legal action?  I know what you mean about people not believing what they read on the Internet and I think its funny that they think I'm one of the bigwigs there and can actually change anything about my name being dirt just for working there.

    In response to the comment from Mark, yes, being registered with the FSA DOES actually mean something.  Enlighten me, exactly who and what am I?  You obviously DON'T know that much about me and anyone that does knows for one thing that I'm not gay for starters.  And I can spell.

    I first found this website after a guy on the phone told me about it so I decided to check it out.  Believe it or not folks this is not all I do in my spare time its just something I look at when I'm on my computer and have a minute to spare.  At first I wasn't too bothered but then when my colleagues started getting personally insulted I decided to defend them because for one thing there's no need to insult individuals, and second they're just everyday people trying to earn some money to get through college and they happen to work for a company that some of you don't like.  Yes, some might think it strange that the owners don't post on here, and judging by some of the replies I'm getting it would be pointless anyway because no matter what you say to people, there are those that will blindly believe whatever they want to believe and nothing will change that, and I agree with you Bob, that is the world we live in.

    By way of reply to your questions, I refer to your previous assertion:

You may sell FP products - although I gather that there is some doubt as to whether you have ever actually done so - just like Patel Bros sell Corn Flakes, but have no "link" otherwise with Kellogs. I understand that FP's legal advisers are even now considering whether you have improperly sought to associate your squalid little outfit with their highly reputable organisation.

    Plainly, any reputational loss which they might have suffered if anyone believed that FP was in any real sense "linked" to Amanico, in any way shape or form, as your assertion might be taken to imply, would be actionable. Think of it as corporate libel, and you won't be far off. Who would want to admit to being "linked" to a bunch of turds like Amanico?

    As to whether the action would lie against you personally or Amanico (or both) this would depend on the link between you and Amanico - a subject of considerable interest. Bear in mind that IP addresses can be checked and are admissible in evidence. You may also wish to obtain indemnity guarantees from Amanico (written, I'd suggest rather than verbal; you know what they are like better than I do).

    You make interesting points Bob.  I like you, I can actually have a proper debate that is set aside from childish remarks and throwaway comments, something that is sadly rare on this site.

    One thing though, you say you have doubts as to whether we have ever sold FP's products, but dont actually say where your doubts come from...  It is plain that you have been informed by someone else yet you dont say who.  Is it just personal speculation or is it something more concrete?  And another small point, speaking of corporate libel, what about slander?  There are numerous posts on here accusing Mandie of being a drug addict which could also be taken into consideration, being harmful to her reputation, not to mention defamation of character.

    Coming back to the point of FP not wanting to be linked with Amanico, would you not say that they would have taken action before now?  Amanico are now in their 5th year and to me it seems that if FP were that concerned then they would have spoken up before now, although if they are indeed doing something about it then I'll keep you posted.

    As for the link between me and Amanico, it is purely nothing more than being employed by them, and if any kind of investigation was carried out, this would be proved.  I think that also applies to IP addresses, although I'm not sure what point you were trying to put across there.  I'm posting from my home laptop bearing in mind that most of the Internet is blocked at Amanico excluding yell.com for looking up doctors or clinics and Best Deal for confirming postal addresses.

    You are either a bit slow or deliberately obtuse. If you sell FP products or those of any other insurer, your connection, link, or whatever with FP et al is in effect purely that you sell their products (amongst many others). As you have admitted.

    However, if you seek to pass yourself off as part of FP, or as being in some way preferentially "linked" to them or some such, (other than as resellers of their products) and that is not the case, then they can and - if economic - will sue you, on the grounds that; they have not licenced your claims; and, knowing what an unscrupulous outfit you are, would not have; and that your claim to be "linked" with them has caused them serious reputational damage.

    It is therefore of no consequence that you have been selling FP's products for 5 or 50 years. The novelty is that you claimed a "link" between FP and Amanico. It will be for the courts to decide how that claim - and any negative consequences of it for FP - should be interpreted, and how the value of any negative consequences should be assessed. Your responsibility for any damages - as the poster of the claim - will be determined by reference to your position, responsibility etc in Amanico.

    Mandie will have to look after herself, and any action by her would be an entirely separate matter. But I would advise that the expense of libel actions (based on written alleged defamation) makes them a hobby for the rich and famous only. Slander is based on verbal alleged defamation, and is damn near impossible to prove.

    This is not intended to be a full statement of the law, and you and she should take independent legal advice.

    I never said we were part of Friends Provident all I said was that we sell their products and have not claimed any other connection other than we have login details to their UK Adviser site and are authorised to create insurance policies for them.  I think if the courts were going to take into consideration what I have said on here, then they should take into account what other people have been saying about Mandie, and like you say, IP addresses can be traced back to whoever has been saying malicious things.

    It will be for the courts to determine what you intended the reasonable reader (on the Clapham omnibus) to understand by this.

    Don't expect ISPs to be co-operative without a court order. However, any company can monitor / record Internet accesses made by its staff using company IT and on company time. You would need to ensure that you had a login system traceable to individuals (eg Smartcards) and you should tell the staff that you are so monitoring in order to avoid subsequent challenges.

    There are a number of quite serious accusations around concerning Amanico's business practices, as you know. It would be as well to be able to demonstrate, beyond any doubt, that while things may have happened in the past (and are sincerely regretted), policies and procedures are now in place to ensure that there can be no repetition. And mean it. It's not a defence but it's mitigation.

    You can confirm all of the above with your legal advisors.

    First off, there's no such thing as a reasonable reader on this site (excluding yourself Bob, you seem to have a certain degree of intelligence and politeness) the majority of people come on here to have a [***] and moan about us so obviously they are going to be against us from the start.  

    And whilst it would be a different matter regarding comments made about the management, it is however a serious allegation to call someone a drug addict in a public domain.

    And yes, when we are selling FP's products we do all have individual login accounts and our own personal passwords so anything we do can be traced.

    I understand that there are a number of concerns over the business practises of Amanico Ltd, yet I am still waiting to see some hard evidence of such accusations.  If you could point me in the direction of any official evidence about these accusations I'd be more than happy to have a look at them.

    Businesses get sued all the time for doing things wrong and are fined accordingly.  Indeed, Friends Provident, whilst being a reputable company (those are your words Bob) have recently been fined £675000 for not handling mortgage endowment complaints properly.  But it does not usually take 5 years for that to happen.  I'm not saying that we are a perfect company at all, because I don't know every in and out of what we do or how we operate but I'm pretty sure that we have never had any kind of legal action taken against us before, and the day it is, that's the day I leave because I don't want to work for a company that does not follow procedures, however I'm not going to jump ship because of accusations made on this website that have no backing that I can see.

    Hi, If you call 0845 0560451 they will remove you from their database!  I obtained this number by ringing them back and hanging on for about 30 rings before listening to a badly recorded message.  Hopefully I've received my last call....

    Just having a look back through these posts and though I'd add my bit again.

    Russell, you're not quite right on the TPS issue. It is Amanico's legal responsibility to check the TPS list for numbers. You cannot hide behind the 'we were told they were all checked' argument.

    Also, even if you 'tick (or not) a box on a survey' the TPS list over rules this. You have to have given a specific instruction to a specific company for them to call you. Just try it with any reputable company that phones you. Once you say you're on the TPS they can't apologise and get off the phone quickly enough.

    However, as Mandy knows and quite proudly says, it is too expensive for Amanico to check the list, and as OFFCOM very rarely follow up complaints, it's a risk worth taking.

    What you have to understand is that Mandi and Simon don't actually care who they upset. It's all about numbers - if you phone enough people, then some will be stupid enough to buy the products (the products being sold aren't actually that good - I know - I have just been looking for insurance and actually read the small print) and that's where they make their commission.

    Yes they might be making serious money, but is it worth it for all the health problems they have and losing your family and real friends over.

    Think about it.
