- meThere is much that i can say bout that. I have already said that if you do not ask a comapany not to call you then you do not have any legal comeback or a leg to stand on. Any complaint you make to Ofcom or the data commisioner will result in one thing first and foremost. They will get in touch with the company responsible and will advise that they have received a complaint from Joe Bloggs about costant phone calls. They will then ask the company to remove thatperson from the contact list and telephone dialler and to inform them when that has been done. I the first instanc all they will do is exactly what you should all hav done in the first place. If and only if these telephone calls then continue after this do you have any legal leg to stan on with rgard to taking further action. AS i have said i work in complaints so i know the procedure. If anything you should be listening to what i am saying as i am actually ( although i dont know why) trying to help you by tellling you the course of action to take. But you all seem concerned with going to another website to try and find information to then tell mei cant say anything about that. No sort of legal action or any other for that matter will happen if the request has not been made to remove from diallers already. Read my previous psts beofre you make comments. And read what i said about the things homeserve cover. I have already said you may already be a customer of theirs and not even know it.
So wher did the data commisioner tell homesrve to get off then highlander. They are not on a bus. What will have happened is exactly what i said at the top of this post.
Why dont you all now go and find (as you seem to enjoy playing with google to find all sorts of info) out if what i have said is right and them come back and play clever d**k. No rules are being broken and any further action can ONLY be taken after the request for calls or maillings to stop has already been made. If you dont tell Homeserve you dont like it then they wont know that and will continue. - BrianFrom the previous seven pages of this thread, which contain a lot of negative comments regarding Homeserve's activities, it is plainly obvious that they are making silent calls to the general public.
Now, if you were to visit the Ofcom website:-

Bigger organisations than Homeserve such as:-
The Carphone Warehouse
Abbey National plc
Barclaycard
have already been warned of this illegal activity and there are also several cases listed where the offenders have been fined up to £50,000 for their crimes.
What I would therefore like to know from the above poster (me) is .....
So what makes you think that Homeserve is right and Ofcom is wrong ?

Please click on them and have a read. - meIf you read the website properly you will see that it says if a company is making a silent call then you should be able trace the number and the company is reuired to leave a short recorded message. ow from previous posts isnt tat what homeserve is doing. Therefore accordin to the ofcom and data commisioner websit homeserve are working in accordance with the law. Brian that is from ofcoms website and yet you conveniently seem to have not read that part. I have said previously that instead ofwasting your time having a dig at me and trying to find more info to use against me you could have used your time better by emailling homeserve at th address that someone has already posted customerrelations@homeserve.com. I am somebody who works in the complainmts department of an isurance company and yet you are to arrogant an pompous to listen to the advise i am tryig to give you. If this is how you are then i hope homeserve do keep clling you and making your life miserable.

I'm generally complaining (and informing people of the law) regarding Homeserve's disgraceful working practices and if you choose to support Homeserve for whatever reason, then so be it.

i suggest that you read my previous posts before you make your uneducated guess's. When you have read them then come back and tell me what i have already told you is my connection with homeserve.And judging by homeserves customer base it seems that tey make enough money that the staff dont need to try and save their jobs. And highlander, do you really think i am going to tell you that. You are probably sad enough to set up a forum for that one then. And do you think i am going to responsible for that one starting. I am not that stupid. All i will tell you is that it is car insurance. There now maybe that should stop all the assumptions that i am a homeserve employee. If i worked for them i would not be stupid enough to post on here as you are all jumping to conclusions anyway. If i worked ther i would be saving my job by not making some of these posts which i will admit may have been out of line at times.
If you are informing people of the law then why do you have nothing to say about the information i put in the last post abut what it says on ofcoms website. Running the risk of sounding cocky and big head now, as you say this is to inform people, then i am just the person who's advise you should be taking. I know how it works and am simply trying to inform you of what to do to stop it. My sister asked me to take her number of our system at work. It took me 2 minutes. That is how easy it is. But you seem to prefer to scour the internet to try and find something to say it is illegal. After you post your next thread send an email to HS and then tell me what the outcome of that is. Instead of saying that it is illegal why dont you call homeserve and then you too can tell people how easy and effortless it is. f you call to complain then they are not allowed to try and sell you products on a complaint call. It is you who is afraid to admit you are wrong that has assumed that without knowing the facts. There is a saying " a little bit of knowledge can do a lot of damage". And in your case you do have a small amount of knowledge.If you had read my previous posts you would know that i am a customer of homeserve. You just find it hard to accept that somebody actually likes their service. Ironically while you are all moaning about them i found this website whist trying to find homeserves number as i had misplaced my policy documents and wanted another copy. You are right i am not being harrassed by them. Again if you had paid any attention to my previous posts you will see that hte reason they do not call me is because i asked them to remove me from their sales list. This phone number (01922 420057 - the one everyone on this thread is complaining about) isn't even on their website ! - Homeserve EmployeeThe reason you fools keep getting calls is because you dont bother to answer your phones or when you do you just put it down or rather rudely keep talking over the agent on the phone. We are just here to do a job as im sure most of you are. It is our job to speak to you and when you put the phone down we have to put you in for another call or we are acting against the regulations of the FSA. As for being on the TPS if you have given us your number then the TPS can do nothing to stop the calls coming through. Once you ask for the number to be deleted it is usually done within 2 days.

Cocked up a bit now havent you. You are an internet forum lawyer who possibly trawls these forums to see how many people will believe you when you say everything is illegal. All i have posted on this site is advise for pepole to listen to if homeserve are bothering them. You instead try to tell people that legal action is the best bet. I have already stated that in the first instace Ofcom or any solicitor will only write to homeserve and ask the calls to stop. It will only be taken further if it does not stop after this point. Everybody can write that letter themselves but the imformation you are providing is pointing people more in the direction of paying a solicitor about £45 to write that letter for them. And you are saying that Homeserve do wrong to people. The problem you have is that i am not agreeing with what you are saying and you do not like it.

Basically, Ron asked me to join in the discussion and then take over whilst he went on his Caribbean cruise.
I'm pretty sure that he reported Homeserve to Ofcom because they are illegally making excessive "silent" or "abandoned" calls.
