Anyone know whether the BBC plans to cover the issue of people being persuaded into costly offshore "pension schemes" beyond the reach of the FSA or other regulators? They touched on it in Panorama "Where did my pension go?" in 2010 (http://www.youtube.com/watch?v=rS36OlVCY5s), but now appear to consider the company whose methods they partially revealed in that programme as a source of financial expertise. Devere Group representatives have been interviewed on six separate occasions by the BBC in the past few months (http://www.youtube.com/user/deveregroupchannel).
That must say something about current standards of journalism at the BBC.

I am involved in investigation into a major UK mis sell of an occupational QROPS currently which frankly beggars belief.
My view is QROPS have a place but really just before you know where you are going to retire and in which offshore location, otherwise leave well alone.
If you are UK res and intend to stay that way, really it is not meant for you and if you enter a scheme which becomes overturned you will potentially be liable for a 40 to 55% unauthorised payment charge with at this stage minimal redress.
The fees in the case I am working on are out of this world and the ability to change trustees and juristictions and holding banks absolutely alarming.
The sale of offshore products in my view generally is very poor and QROPS potentially a scandel. - QROPS| 3 repliesCan HMRC really be expected to keep pace with all the offshore scammers offering QROPS scams? HMRC includes plenty of warnings about QROPS in the first page of its QROPS list (http://www.hmrc.gov.uk/pensionschemes/qrops.pdf).
1) the schemes on the list notify HMRC that they qualify, not the other way around:
"This list is based on information provided to HMRC by non-UK schemes when they notify HMRC they meet the conditions to be a QROPS."
2) schemes on the list are not approved by HMRC:
"The list is not to be taken as a recommendation for a particular scheme or product. Nor should it be taken that any scheme featured on the list is approved or backed by HMRC."
3) the list is not complete:
"Absence of a scheme name from the list should not be seen as a statement of scheme status."
4) schemes on the list must continue to check that they meet the conditions and inform HMRC:
"Pension schemes also have 30 days to inform HMRC they no longer meet the conditions to be a QROPS and that they need to come off the list. The conditions have changed over time so schemes need to ensure that they continue to meet the conditions to be a QROPS."
In many cases, QROPS seems to be a byword for a scam. Would be interesting to know how many QROPS products are with companies based in jurisdictions which offers high standards of protection to investors not living in that jurisdiction. - OLd Bloke replies to QROPSAll pretty far points that I agree with, except .......... when the changes came in, in 2006 HMRC relied on providers to work within a "concept" if they at that time had put it into legislation properly then it would have been clear all round, they didn't and as such the abuse, loop holing etc. started. Frankly they remain unclear about the rules to this day as per the only test case against ultimately Credit Suisse.
We are working with the UK's leading Counsel on this and frankly it is still very cloudy and there are further actions that are likely to happen so further changes may be made.
Clear legal comment has been made about the lack of HMRC clarity even when their opinion was sought. That is an interesting point you will make and may be useful thank you.
The problem with loop holers and fraudsters in my ow Old Bloke view is that generally they get away with it and usually the money is well gone. If caught as usually the power that be, police, trading standards, regulators and Uncle Tom Cobley and all are so stupid and slow and display very little interest, the costs of legal action and end outcome are usually not worthwhile.
I think that in truth we get shafters and shaftees if you follow my drift and then a mixture of good guys that generally are not as slick as the Shafters and are left with a pile of [***] to pick up and a client that continues to be disgruntled.
