EVER wondered how those massively irritating firms that call you out of the blue get your phone number?
It's thanks in part to companies like Phruit Limited, which describes itself as "industry leaders in the provision of lead-generation services."
Translated, this means that after using underhand ploys to get your details, it passes them onto businesses selling everything from mobile phones to will-writing.
Phruit even passed on the details of people who had registered with the Phone Preference Service to opt-out of marketing phone calls.
It also used a sneaky trick known in the trade as "sugging" - marketing or selling
under the guise of carrying out research.
Now the company, run from Newark in Notts by Philip and Charlotte Lightfoot, has been suspended from the Direct Marketing Association.
"Membership of the DMA is a clear indicator of a company operating to the highest standards, standing for professionalism and trustworthiness," said Scott Logie, chair of the association.
"Our code of practice is the cornerstone in our efforts to build and maintain political, commercial and consumer faith in direct marketing. Therefore, any company that fails to operate within these standards brings both the association and the industry as a whole into disrepute. It is for this reason that we have no choice but to suspend Phruit from membership."
George Kidd, chair of the Direct Marketing Commission, said: "It's vital that we uphold the high professional standards that define the direct marketing industry. Our recommendation to suspend Phruit from DMA membership clearly illustrates the seriousness of failure to comply with the Association's Code.

Phruit Ltd – complaint about direct marketing

This case related to telemarketing activity undertaken by Phruit. The Commission investigated following a complaint from an individual consumer who was registered with the Telephone Preference Service (TPS). The consumer had been contacted with the offer of will-writing services having previously been contacted by Phruit in what seemed to be a lead-generation exercise carried out in the guise of research. The investigation involved contact with the original complainant, a review of TPS and other web-based complaints and an attempt to validate compliance with TPS cleansing. Over 100 complaints involving people who had registered with TPS were attributable to Phruit directly or to companies using their data. The Commission had access to over two years of dialogue between the DMA’s compliance team and Phruit that was anchored in ongoing concerns over TPS compliance and the misrepresentation of research.
Based on the evidence presented – including a number of admissions by the company – the Commission reached a view that the company had been misrepresenting itself as a researcher when making calls that were really designed to sell goods or services. The practice was found to be the cause of the considerable number of public complaints over what was seen to be Phruit’s cold-call marketing. This, in turn generated subsequent complaints when UK firms used Phruit data and called TPS subscribers in the possibly misplaced understanding these people had opted-in to receiving marketing calls. While Phruit responded in part to some questions the company failed to provide key data and information over its TPS practices and its commercial arrangements.
The Commission found Phruit in breach of the following provisions of the Code – 21.18 and 21.20 on TPS compliance and data cleansing, 3.11 under which Phruit has a responsibility for compliance by suppliers and 3.18 on “sugging”: marketing in the guise of research. The Commission decided this was a very serious case involving fundamental code provisions on TPS compliance, misrepresentation and the failure to ensure contractors were code-compliant. The Commission proposed membership of the DMA be suspended for a period of at least one year and that the lifting of this suspension thereafter be conditional on evidence from Phruit of action taken to ensure compliance with the Code of Practice. I did get suspicious when they wanted my card number and that I would have to contact my bank to cancel the payment to the other company, he then quoted the first four numbers of my card, I then told him that I do not give this number out to anyone over the phone. He tried to convince me that this call was genuine telling me the next numbers on the card should start with 23 or 37. I then told him that I would have to think about it I asked him for a internet address which he gave me he also said I could look them up in companies house and have me the company number. I looked this company up on the internet and noticed the unfavourable notices. So really is this company legitermate or not

Anyway, its usually better to try calling the company to resolve a problem. This is always what your bank will tell you before they initiate any kind of charge back. - Observer replies to InsurerSince trading standards in Bournemouth and Dorset started taking the dozen or so scam Sky warranty and insurance companies based in the area to task over their sales techniques, a vicious turf war seems to have broken out between them.
What's complicated matters further is that a number of the kids employed in their call centres have realised how easy it is to set up similar companies and make a quick buck. These guys appear to be such a company.
As far as I am aware, the only company to be trusted is the official Sky partner, www.skyprotect.com That is if you believe in these pointless warranties and insurance. - Unhappy customerCalled the fsa asking about these guys, they told me they are not regulated by them and do not give them my card details.

And what a rude bunch of individuals! What happened to treating people with respect and dignity. - Tess replies to Disgruntled customerHave just received a call from these people. Very pushy, very assumptive, firstly he gave me a phone number and told me that that would be the number I would need to call in future, gave me the first 5 numbers of my card number and tried to push me for the rest, told me that I would need to cancel the previous direct debit or I would be charged twice. When I refused to give my card out, he reeled off why they weren't a dodgy company. I asked how he had my details, he said they were in his system. I then just put the phone down. I called the number given, it went straight through to an answer phone.

Next door to SSC is SRS ( Satellite Repair Services) offering a practically identical solution / Service.
SRS contacted my mother back in Apr 2011 and sold insurance, solely intended for her satellite.
My mother agreed and supplied bank details. On the next months bank statement she discovered they had made and taken additional charges for her TV, which had not been agreed. Eventually the policy was cancelled in Oct 2011.
In November 2011 she receives a call from SSC, claiming to be a part of Sky Protection, not a separate company, offering cheaper insurance. NO BANK OR CARD DETAILS WERE OFFERED DURING THIS CALL.
This week we learnt that my mothers bank account has been debited, without her consent, for the full amount for the first of three yrs cover. The additional 2yrs cover would have been debited over the next 2 months.
I have made an enraged call to SSC, spoken to Alex Patterson, Allegedly the Managing Director, and to Jamie (Crispim), allegedly in Customer support, who angrily denied taking payment without authorisation. In fairness, most of the aggression displayed was by Jamie in customer support.
They claim my mother gave them her bank details, my mother strongly denies this.
When i quizzed further and suggested it was more than coincidence that a company set up next door should trade in the same market, as a competitor, could have passed on financial details from one business to another, I was very rudely told this was not the case. HOWEVER Jamie then advised that a lot of employers at SSC, including Mr Patterson MD, previously worked at SRS.
Simply a coincidence!?!, i think not!!!
I have now been told my mother will be reimbursed and her policy will be cancelled. Prior to making the above claims in regards to trading addresses and employees i was told in no uncertain terms this WOULD NOT BE THE CASE AND THE POLICY WOULD STAND.
I now urge everyone who feels mislead or indeed the victim of fraud as my mother does, to contact the link above to the fraud squad in Bournemouth, and to register their annoyance with Trading standards, FSA so that these rogue traders can de dealt with accordingly. - Paul PointerSatellite System care carefully word the sales pitch to make it seem as if they are an authorised Sky agency. In fact they never actually say that but it is very clearly the implied sense of what they say. Having realised the con, I called and wrote requesting cancellation but so far no confirmation has been received and more to the point no refund obtained. Definitley do not trust this bunch.

Thought that was the end of it, however I kept receiving calls from 08448 000405 which I ignored. Then yesterday I received a WITHELD number call. and answered it. Guess who ? yes !. This time from a lady called Alice, who said she was sky protection, and that I was currently paying £9.50 for my insurance, but now they could reduce the price to £6. ?? because they now had engineers in my area. I really thought that this was Sky Protect , who I am currently with. She spoke very quickly and also called me by my first name and 'love'. She said what I need you to do love is to contact your bank and cancel your existing , what is your bank name ?. I said I am not prepared to give you my bank details, so she repeated the whole sentance again, as if I was daft. Again I refused to give her my bank details, and she said how were they going to offer me this low price if I did not comply. I told her you can alter the existing direct debit at the bank , like all firms do if you are a customer with them. She said they could not do that , so I said you are not sky protect are you, and I do not have a policy with you, get lost, or words similar to that. Anyway PLEASE everyone be very careful, they are trying all sorts of ways to get you.

I phoned this company on the same day and was told it was payment for a 3yr. contract. I would not have agreed to this because i don't have that much spare cash in my account. Have received no documents or further contact since and want to cancel.
