- LettieThis people have been calling me for 3 years asking for an "Angelica". They are not a scam because I've had friends and family of this girl calling for a year. She has been messing up her credit and giving my cell number out. Below is the corporate address, numbers (866 # is disconnected), fax and email. I'm talking to my attorney friend and we believe a lawsuit can be placed. I advise that you contact your lawyer or attorney and take action. 2 years of harrassment is too much.

sales@bayareacredit.com - LettieI sent the information you see above last night. Well, I contact them today and told me to give me the name and address on the account. They gladly gave it to me and in a matter of 2 minutes, i found the house number for them. I called back and gave it to them.
I spoke with a debit lawyer about pursuing a harrassment lawsuit. According to them, I have to send a certified letter to the debt company and give them about a 1-3 months, if they keep on calling and not honoring the letter than I can file a suit.
I told this to the debt company and them hearing the word lawsuit...changed their tune on calling me.

Fair Debt Collection
If you use credit cards, owe money on a personal loan, or are paying on a home mortgage, you are a "debtor." If you fall behind in repaying your creditors, or an error is made on your accounts, you may be contacted by a "debt collector."
You should know that in either situation, the Fair Debt Collection Practices Act requires that debt collectors treat you fairly and prohibits certain methods of debt collection. Of course, the law does not erase any legitimate debt you owe.
This brochure answers commonly asked questions about your rights under the Fair Debt Collection Practices Act.
What debts are covered?
Personal, family, and household debts are covered under the Act. This includes money owed for the purchase of an automobile, for medical care, or for charge accounts.
Who is a debt collector?
A debt collector is any person who regularly collects debts owed to others. This includes attorneys who collect debts on a regular basis.
How may a debt collector contact you?
A collector may contact you in person, by mail, telephone, telegram, or fax. However, a debt collector may not contact you at inconvenient times or places, such as before 8 a.m. or after 9 p.m., unless you agree. A debt collector also may not contact you at work if the collector knows that your employer disapproves of such contacts.
Can you stop a debt collector from contacting you?
You can stop a debt collector from contacting you by writing a letter to the collector telling them to stop. Once the collector receives your letter, they may not contact you again except to say there will be no further contact or to notify you that the debt collector or the creditor intends to take some specific action. Please note, however, that sending such a letter to a collector does not make the debt go away if you actually owe it. You could still be sued by the debt collector or your original creditor.
May a debt collector contact anyone else about your debt?
If you have an attorney, the debt collector must contact the attorney, rather than you. If you do not have an attorney, a collector may contact other people, but only to find out where you live, what your phone number is, and where you work. Collectors usually are prohibited from contacting such third parties more than once. In most cases, the collector may not tell anyone other than you and your attorney that you owe money.
What must the debt collector tell you about the debt?
Within five days after you are first contacted, the collector must send you a written notice telling you the amount of money you owe; the name of the creditor to whom you owe the money; and what action to take if you believe you do not owe the money.
May a debt collector continue to contact you if you believe you do not owe money?
A collector may not contact you if, within 30 days after you receive the written notice, you send the collection agency a letter stating you do not owe money. However, a collector can renew collection activities if you are sent proof of the debt, such as a copy of a bill for the amount owed.
What types of debt collection practices are prohibited?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact.
For example, debt collectors may not:
use threats of violence or harm;
publish a list of consumers who refuse to pay their debts (except to a credit bureau);
use obscene or profane language; or repeatedly use the telephone to annoy someone.
False statements. Debt collectors may not use any false or misleading statements when collecting a debt. For example, debt collectors may not:
falsely imply that they are attorneys or government representatives;
falsely imply that you have committed a crime;
falsely represent that they operate or work for a credit bureau;
misrepresent the amount of your debt;
indicate that papers being sent to you are legal forms when they are not; or
indicate that papers being sent to you are not legal forms when they are.
Debt collectors also may not state that:
you will be arrested if you do not pay your debt;
they will seize, garnish, attach, or sell your property or wages, unless the collection agency or creditor intends to do so, and it is legal to do so; or
actions, such as a lawsuit, will be taken against you, when such action legally may not be taken, or when they do not intend to take such action.
Debt collectors may not:
give false credit information about you to anyone, including a credit bureau;
send you anything that looks like an official document from a court or government agency when it is not; or
use a false name.
Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, collectors may not:
collect any amount greater than your debt, unless your state law permits such
a charge;
deposit a post-dated check prematurely;
use deception to make you accept collect calls or pay for telegrams;
take or threaten to take your property unless this can be done legally; or
contact you by postcard.
What control do you have over payment of debts?
If you owe more than one debt, any payment you make must be applied to the debt you indicate. A debt collector may not apply a payment to any debt you believe you do not owe.
What can you do if you believe a debt collector violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, you may recover money for the damages you suffered plus an additional amount up to $1,000. Court costs and attorney' s fees also can be recovered. A group of people also may sue a debt collector and recover money for damages up to $500,000, or one percent of the collector' s net worth, whichever is less.
Where can you report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General' s office and the Federal Trade Commission. Many states have their own debt collection laws, and your Attorney General' s office can help you determine your rights.

- BOBThey break the law on a regular bases. i don't even owe them money i filled complaints with the f.t.c. and the bbb and dist atty office the problem is as you can see from all the complaints the have they are never held responsible for there actions.. thats why they keep on breaking the law.. they have been calling me for weeks i keep telling them wrong num but they don't care.. the managers there are rude and they don't respond to calls when you call to complain people like ALLISON BROWN,, JOKE TAYLOR PENSONEAU Who is supose to be the manager but never picks up the phone..not to metion when you ask for manager they give you fake names. they just keep doing what ever they have to do to harrass people,they SUCK!!!

- Gina GThese people have called me for months, and countless times I've told them, I'm not the person they're looking for. Fed up with the harrassment,I managed to get the company name out of the agent, and I told them to take me off their list, as I am the wrong person, or I will press charges. That didn't work either. So now I'm going to send a certified letter, telling them to cease and desist calling me. And when that doesn't work. Contact my lawyer, or call the State attorney generals office.

- Chris KI also receive a call from 800-697-1234 asking for someone not at my address and the address they have is not my address. I asked to be removed at least 5 times, but still receive calls. I asked for their compnay name and was told "Bay Area Credit Service". I looked up the web site, www.bayareacredit.com/contact.htm, and called their 800 number. I spoke with someone named Carolyn who was able to see the call in her records and could tell I had asked to be removed. She said she would have my number removed from the "Dialer" and also put it on their "Phone exclusion list". Not sure if they will work or not.

Ph: 91 20 2423 1612 - LVSI again got a call from these dudes.(The last call was this wednesday. when I called back, they said they reached a wrong number).This time, I clearly explained that I was not the one they were expecting to reach (Some Andrea...).No matter how many time they call, they would end up reaching me and that I got this number radomly assigned a couple of months back by the prepaid mobile service provider TRACFONE. The dude said he would take the number off their list. Hope he stands by his word.

- O.Osometime last month, i received a call that is 777-777-7777, i thought it was weird but i picked up cell anyways. they got my name right. then they said i have to pay for milk delivery. in my mind i said what the heck, so i lied amd said i dont drink milk, i have no card to pay with, and i didnt order any. after that they said i can pay with a check and if cancel i have to pay to pay a fee also. i mean if i have no card how am i suppose to write a check? then saying hs boss would go crazy. it sounded like some teenager mayb with a heavy accent also. just a few mins ago, i was looking at my cell phone to see who is calling my and its the 1800 number you guys are talking about and no one said anything. i got the same phone number once before and also said noting.
im getting irratated -_- - Charles BellWe have been getting calls from this number for the last 4 or 5 weeks. They ask for information about my son i.e. where he lives, his address, and information about our relationship/knowledge about him. They have called twice in the last two days. We don't answer anymore.

- KWOThis number is Bay Area Credit; San Jose, Ca. A debt collection company with a call center in India, which explains the heavy "acceents". Google them. I have had them calling to try to collect on a bogus medical overcharge "debt" from Workers Comp insurance covered auto accident in 2002. I've tried to explain to these callers that the patient is not be billed for any overcharges under the Workers Comp regulations, but a lady named "Gloria" in India seemed to know to know our laws better. I told to quit calling, she said they would continue to call. I have sent a letter certified mail to Bay Area Credit citing FTC regulations under the Fair Debt Collections Act (google it for help with harrasing debt Collectors). These people continue to call and ALL FOR $50.00 AND A $4.10 SERVICE CHARGE. $54.10 must be a lot of money in India!

- Helen MartinezI received a call from a man with a very heavy accent asking me for Helen Martinez...I said that was me and then he asked me if my date of birth was in February of 1952. I responded no....but did not give my own date of birth...when I asked how he got my number which was my place of employment and asked for me by name he became nasty and said he must have the wrong Helen Martinez and slammed the phone in my ear.

I'm in. I thought when I began my investigation that I would be just taking them to court for around $10-$20k. But the information that I have read on here, has given me a paper trail beyond my humble expectations. They've called me 48 times in 1 month and 1 day. Up to 4 times a day.
I have Vonage and I typed in the number and 48 calls popped up, all times of the day. Didn't even have to count them, it told me.
The first time I was contacted I told them that I didn't know where the person was? Less than a minute later, the "Nut case" who obviously couldn't give a goody good hoot about USA LAWS. Mr India turned and called me right back!? I thought it was "Strange".
They end their speed dialing at just prior to their dead line of 9pm. and that would be ending at 8:59pm. Can you imagine 3 calls starting at 8:56pm?
Speed dialing someone has a law connected to it (I'll have to find it)
Either way it's too close(smarty's),and I've discovered some other realizations, from reading information on here. thanks guys and girls.

Another thing. File in the City that they are telephoning you in. NOT THEIRS. According to the police, this is where the crime of harassment is being committed.
