- Ian Lyngklip replies to AnonymIn some instances a debt collector will dial your number when they are trying to reach someone else. This happens either because the number is new to you or because there has been a mistake in data processing of a phone number, and that mistake finds its way into a "skip trace" report.
Either way, many collection companies will limit the ability of their collectors to remove a wrong number, even if they have been told not to call.
The best way to stop this is by sending a a written demand that they cease communications. I have posted sample letters on my web site’s law library. http://www.sue4abuse.com/library.html (Letter 3)
The Fair Debt Collection Practices Act (FDCPA) requires that they honor written requests like this, and stop almost all communications. If you send a letter like this, you should do so by certified mail, return receipt request, and keep a copy of the letter together with the return receipt.
If they keep calling after that, your best option may be to have an attorney help get their attention or pursue claims under the either the Fair Debt Collection Practices Act (FDCPA) or the Telephone Consumer Protection Act (TCPA). At that point, you will have the documentary evidence you need to bring a strong case. (the letter your sent)
Your can find other FDCPA and consumer protection resources on my web side. www.sue4abuse.com

- AmberGot a call from this company telling me that they are going to take me to court for not paying a bill. Turns out they were sending paperwork to an address I have not lived at for over 10 years! If they had picked up this debt from where they said they did, they would have gotten the correct mailing information for me. Not to mention they refused to give me an account number for my debt (unless I submitted payment first), they refused to accept the payment amount that I offered to give them (said I wasn't paying enough up front), and they refused to send anything to my current address to show proof of this debt (again unless I paid up front for it). They wouldn't even give me a web address so I could check them out. They wanted me to pay by credit card over the phone, wouldn't give me a mailing address so I could send them payment, the list goes on and on. I have been dealing with these ppl for 6+ months now, and they keep making threats. They will be talking to my lawyer if they don't stop harassing me. I have recorded some of the calls where they are refusing to give me info on my account and refusing to accept payment because it isn't enough. Let's see how they hold up in court with that evidence. Sick of this company...

- Amber replies to Imogene| 1 replyI admit that I do have a debt to pay, but I get pretty pissed off when they continually call me, I offer to pay part of the debt because I cannot afford to pay it all at one time, and they refuse to accept my offer. Do not call me about a debt if you will not accept payment for that debt. At least I am trying to make it right. I am not trying to get out of paying debts, but at the same time, I will not put my children out of a home by paying all up front with no paperwork, no account number, nothing.
Sometimes it's not about someone trying to get out of paying debts, sometimes it's more about the company's unwillingness to accept payment on that debt. I believe that there should be some better legislature surrounding this. 7 calls a day from the same debt collector who is not willing to accept partial payments on a debt is outrageous. Being called 'worthless, loser, irresponsible', etc. by someone whom I have yet to meet about something I have offered to pay many times is ridiculous! Hey debt collectors, I am a person. I have a family to support, just like you. Only I don't have to cut others down to do it. Does it make you feel like a big person to treat others like that? Rude... - SuzanneMy daughter has been receiving calls from this number....4 in the last 2 weeks. She's had her number since December and is only 13 so no one from any toll free number should be looking for her.
I called the number and the company is WRS. I'm not sure what they do, but following the prompts I pressed "2" to speak to the next available rep or supervisor. I explained my daughter keeps getting calls from this number and she asked me what the number was. She then pulled it up to see that they have been trying to reach someone named Jesus. Anyway, she was very kind to note the account and remove the number.- Caller: WRS
- Interesting... replies to Imogene| 2 repliesFunny how this DEBTOR as you call it, has never received a state check, and have had ONE SINGLE Bank account which I have had for 15 years, and NEVER over-drafted. Imogene, some of us are actual people who are being harassed by companies you are protecting for doing nothing wrong. I have received several calls this week from multiple companies ALL ASKING for someone I have never met, or heard of. Please tell me the "Right thing" to do when I have repeatedly asked to be taken off their list since I have NO DEBT in collections? You seem so bright and seem to KNOW IT ALL so please tell me what I should do???
- nunya2 replies to Aprilat least he PAYS his debts, and works is not on STATE help!
- imogene2 replies to Interesting...| 1 replyCall them ask nicely to take you off as you do not know these people, or if you do tell them why you do not have contact with the person.. If you just scream and curse and hang up, that tells them you may be the debtor.
- Kathy Simms replies to imogene2I actually had forgot about my bank over drafts when I received a call by a very nice lady named debbie. I was concerned because I had just gotten married and wondered how she could find me, but none the less, she was nice, explained to me that this could affect us getting a home someday because I was in checks alert. we (debbie) and i managed to come to a settlement on the debt (which was not that high), she let me set up a payment plan and it will be paid off in a month. I am really happy that I could get this taken care of. Thanks debbie
- James Hudson replies to Amber@Amber, you obviosly know that your balance is due in full. now offering someone $5 a month on a $500 or so balance makes no sense. If someone owed you money, how would you like if they made payments to you over the next ten years? Does'nt make good sense does it? I personally as a debt collector would hall you to court and garnish your wages. Now you just made a small debt a lot more and added attorney and court fees to it, smart? Make it a priority, pay it and move on...that simple.

- Sarah replies to ImogeneI know for a FACT that I have no debt, and have NO reason to be getting these calls. It's rude people like you that make all the rest of the collectors have a horrible name. Grow up and try to not be so rude. Some people aren't living off STATE CHECKS and are responsible, yet have debt.
Do the right thing and don't be so nasty. - maybell replies to cashier| 1 replyby law if you ask if they are a debt collector, they have to tell you.. or they will say accounts receivable but really they do have to say yes if you ask. second.. most debtors use the tactic of 'I am not giving you my ssn ' which they already have the entire numb as the bank gave it to them...If you TRULLY are NOT the person or know the person then just say FDCPA states if I ask you NOT to call you then they have to abide by that. they then have to contact you via mail. If you are the debtor, just make arrangements to pay the debt, most are recent.. and they are just going to grow... statutes do not stop the collection activities.. it just stops them from being able to take you to court. but you will stay in check systems. if they sell your debt to another company then you start over again for 5 yrs in chex systems
- tolduso replies to maybellAn April 1 New York Times story on the rising number of court-ordered garnishments told the story of Sidney Jones, a maintenance worker who took out a $4,097 personal loan in 2001 from the subprime lender Beneficial Virginia:
He fell behind, and Beneficial sued. Mr. Jones did not appear in court. "I just thought they were going to take what I owed," he said.
By default, Beneficial won a judgment of $4,750, plus $900 in lawyers' fees, with the debt accruing interest at 27.55 percent until paid in full. The bank started garnishing his wages in March 2003.
Over the next six years, the bank deducted more than $10,000 from Mr. Jones's paychecks, but he made little headway on his debt. According to a court order secured by Beneficial's lawyers last spring, he still owed the company $3,965, a sum nearly equal to the original loan amount. - JessI believe that they have changed their number to 800-667-8424 or added it. I keep getting calls from this number saying that they represent World Recovery Services.

- Debt Collector replies to AprilCan you say idiot? Its called local touch/local tap, able to pull a number from a local area code and use it to call from, getting more pickups because its a number from YOUR area. And also. The number could be unused by the other company, or could be a transfer line. I know more then one business can use a single phone line, Idiot.
