    An advice firm must pay redress to a client it advised to give up a guaranteed cash sum and annuity rate, transfer into Sipp and invest in illiquid storage units.
    The client, Mr F, had a pension worth just over £50,000 and told the advice firm – Anthony William Morrin – that he wanted to invest a significant proportion of his portfolio into “cautious assets”.
    He was advised to to transfer his pension plan to a Sipp and invest £22,500 in Store First and £28,754 into the Vanguard Balanced Fund. The adviser did not set out the guarantees lost upon transfer in the suitability report.
    The transfers later lost the client money and his complaint was referred to the Financial Ombudsman Service.
    In its final report the FOS says the advice to transfer the pension out of a plan that had a guaranteed cash sum and guaranteed annuity rates was inappropriate and that Anthony William Morrin did not explain these would be lost on transfer.
    The ombudsman also says the advice to invest in Store First was inappropriate because returns were not guaranteed and there was a liquidity risk.
    Ombudsman Adrian Hudson says: “If Mr F wished to go ahead and invest in the Store Pods he should have been asked to sign an insistent client agreement confirming that he knew what the loss of the GAR would mean and that the Store Pods could be difficult to realise if he wished to sell them.”
    Hudson says Mr F should be put back into the position he would be in if he had not transferred his pension plan.

    However, he did recognise there may be an issue selling the Store First investment and ordered Anthony William Morrin to buy the asset itself if this is the case.

    According to the FCA register, the advice firm has applied to cancel its authorisation.

    Just a point of clarification. Wefindanypension.com Ltd, one of whose directors was TW, did not come into existence until about nine months after the sales operation at Goodlass Road started operating, at that stage under the name Untold Horizon Ltd. Wefindanypension.com Ltd was incorporated about two months before the Capita Oak money started to be invested in Store First.

    There are lots of things that only become apparent when you plot everything on a timeline. You then start to see where certain actions crossed the line legally and exactly how things played out. How short a timescale a lot of this was done in and that there were three clearly separate groups of people doing different parts of it in relative isolation, relying on commission payments between the parties to make it all work.

    1. Hadley: devised the schemes advised by Fowler, and on the technical side by Ward.

    2. Talbot and Chapman Clark: running the lead generation and sales, also latterly pre-processing the transfers.

    3. Bill Perkins and colleagues: processing transfers, completed by Ward's company (and possibly others).

    It also becomes apparent that this could have got a lot worse if further pension schemes had been set up after Capita Oak was "full".

    That was way back in 2010, before Chapman-Clark was showing up in any of this, but at the same time as MIke Talbot was working for / running the sales operation for Dylan Harvey.

    Transeuro advertised that it was doing lead generation for investment products so it looks like this was Talbot's thing, or possibly a financial lifeboat for others involved in Dylan Harvey.

    The decision to get involved in pension sales seems to have happened in the summer of 2011:

    Here is the (redacted) timeline for the beginnings of Capita Oak.

    My guess is that the decision to invest in Store First took place around August 2012, which explains why TW got involved in promoting it through Wefindanypension.com Ltd.

    Which begs the question:

    Where did Hadley get the money to buy the house?

    It could not have come solely from commission payments on the transfers as he needed to use some of that to pay his staff and office costs. 2% of £10M is only £200,000 and I doubt he would have even got that. He must have been a beneficiary of some other commission or kickback deal on the investments.

    This is the only possible explanation.

    Which means that his decision to invest in Storefirst was based on personal gain and not any duty of care as a trustee of a pension scheme.

    This is one where some of the FOS ruling could have been more explicit. What were the guarantees ...a 2.8% annuity rate? Hardly worth bothering with.
    An insistent client declaration. ..? Compliance tells us they're not worth the paper they're written on yet FOS says should have got one...
    Hardly helpful...that aside,"cautious assets"...?

    Really good stuff. Makes it clear Hadley was the controlling mind. Just a few minor points: 1. decision to get involved in pension sales happened third week of June 2011 2. Capita Oak trust deed was signed by Fowler and Ward's gimp Anthony Salih (who forged Karen Burton's signature) 3. Hadley got the money to buy the house from Whittaker (part of the overall deal cleverly concealed by Whittaker's lawyer https://www.jwksolicitors.co.uk/about-us/meet-the-team/craig-hollingdrake/) 4. Hadley was behind Thurlstone who did the 5% loans which he paid out of his commission from Whittaker (supposedly untraceable) - other than that a gold star! :)

    You can prove a signature was forged but hard to prove who by when the person mentioned above, under oath, said it wasn't him
