- John Rushbrooke replies to Paul| 3 repliesHi there, I am a financial adviser for another company acting on behalf of a client who agreed in a telephone conversation with these people some 12 months ago, to transfer his pension schemes to them. Other than an initial letter confirming funds received from original provider and the 5% fee they charged for the service, he has had no other correspondence. It appears Capita Oak were the broker and have transferred the funds to a company called Imperial Trustee Services Ltd in Beckenham, Kent, a company that have had 4 different directors in the space of less than two years, no phone numbers can be found or web address and the documentation from them, which is minimal to say the least, is not at all professionally presented, as goes for Capita Oak documentation. It is not of the quality you would expect from a legitimate company. I will be speaking to my compliance dept and I expect they will be referring the case to the Serious Fraud Office.
Simple rules, never do business like this over the phone. You need to make sure you are dealing with a legitimate company, ideally see them in their office or at your home/work address if trustworthy. Make sure you get a full Service and Cost Disclosure Document from them (SCDD and Terms of Business/Client Proposition document) this is an industry mandatory requirement, allow them to complete a full Fact Find ensuring they discuss risk profile, capacity for risk/capacity for loss, levels of fund management, initial and ongoing charges. They should then go away and do research and come back with a full Financial Report/Suitability Letter highlighting what was discussed at first meeting, what your needs were, what they have recommended, the fund choice, level of investment risk and why the recommendation meets your needs. It should document who the pension provider is that you will be transferring your funds too, usually a well established company such as Legal & General, Zurich, Friends Life, Aviva etc. You will then need to complete an application form for that company in order for them to process your transfer. If in doubt, research the company provider you have been recommended to transfer too before signing any paperwork or providing your proof of ID documents etc. It is a lot of work for the Financial Adviser to do but if he/she is legitimate they will be happy to do it for you as that is their job. If they are not legitimate, you will not get that level of professional service and they won't bother doing all of the hard work because they are just looking to make a quick killing and move on to the next victim.
Hope that info helps you out, but from what I've researched today for my client it looks like he is another victim like yourselves and suitable action needs to be taken.
Hope you all get a positive outcome.
Regards.
John - John R. replies to DavidDon't even go there. I am a financial adviser. No industry professional would even consider transferring your army pension, the scheme you have is the best in the business, your army pension is classed as gold plated, you will not get anything better anywhere, never let anyone tell you any different. This company appear to be well dodgy, one of my new clients has unfortunately transferred his pension to them and is pursuing a case against them for pension fraud via the serious fraud office. Enough said. Hope that helps, regards, John.
- Paul replies to John Rushbrooke| 1 replyThank you very much for your correspondence john . I don't want to take advantage of your professional position but do I stand any chance of getting my money back if I go through legal channels and follow criminal proceedings against these people ?
