- Angie replies to den| 11 repliesI think the problem that Metis Law is one of legal process. They consider they have a duty of confidentiality to Imperial and that comes before anything - even though they reported their own client for fraud in March. The directions hearing is apparently to get a judge to decide what happens to the 31k which is the only money left out of the 10.8 million. I believe Imperial have been trying to get their hands on it, and Metis Law say they are owed 50k+ and I have asked for it to pay for accountancy fees. The single most important thing is to get the accounts done so that we can all see exactly what happened to all the money and what each member is entitled to - until that is done nobody could transfer out (even if there were any liquid funds) because it would be impossible to see what each person's entitlement was to funds and what proportion of the costs should be attributed to them. There is already an order by the Ombudsman that one member should be allowed to transfer to another scheme, but until there are accounts he can't. He could, in theory, do an "in specie" transfer which means that he could transfer the assets rather than actual money, but that would depend on another scheme being willing to accept the assets - which they wouldn't do until and unless they were valued.
- Joe replies to denI don't know the ins and outs of what went were and who authorised it the 5%-10% loans were paid out by thurlstone so in guessing that's what that was for someone instructed metis they have the documents as far as I'm aware métis we're acting under instruction and the main rule is client confidentiality
They have however now been put in a predicament by imperial store first capita oak and Angie brooks I for one have faith in them to sort this whole mess out yes they will be getting fees you can't expect it to be gone for nothing I was asked the question " would you rather have your money back and the perps walk free or have nothing and see them chased for years to come " I don't give a hoot about them I want my money back was my answer
Metis are half involved know what's going on and are willing to fight to get our money back cynics will say they knew all along what was happening maybe they did maybe they didn't we have no way of knowing but I do believe they are genuinely tying to sort this mess out for there client and for the members - Joe replies to denReading the e mail of the letter metis sent Angie and her responses I really don't see how she ripped it to shreds came over as a bit of tit for tat metis have the means and contacts to sort this
- Joe replies to Angie| 10 repliesI'm not aware of any ruling by ombudsman I'm in constant communication with investigating officers and constantly watching there web site for any rulings metis say they wanted to work with you and it was agreed in principle by all parties inc pension regulator but because of your ego and hidden agenda things have got worst
My one burning question is why are you avoiding returning to the uk ????? - Angie replies to Joe| 9 repliesThere is no hidden agenda, and I am not resisting returning to the UK. There is only one agenda and that is to get the members' money back so that their pension benefits can be protected. Metis Law are hostile because they are instructed by Imperial - and when tPR makes a determination they may appoint an independent trustee who will take whatever steps they decide and charge whatever fees and legal costs they deem fit. This whole situation is tragic for the 300+ members and it is a pity that Metis Law can't work in a more conciliatory manner, but they believe they are following due process. They may or may not be right, but one thing is for sure and that is that the people behind Imperial and Capita Oak are guilty of fraud and must be brought to justice. That is what the main focus should now be, but if you can see it from Metis Law's point of view, they have a duty to their own client: Imperial. A real dilemma.

I believe as previously stated the MAIN priority for members should be the return of there pensions and worry about the convictions later or if at all as I would have thought they will be well covered - den replies to Joe| 3 repliesI do agree about getting our money back is the priority over the perps getting brought to justice but if it's left to ML the length of time they take to do anything if tpr bring a trustee all or a lot of any funds we manage to recover could be be taken in their fee etc like what's happened to the Ark victims
- Joe replies to den| 2 repliesAccording to raj an appointed trustee can be avoided if metis are given full co-operation yes there going to charge fees , they are after all doing work so I don't see a problem in giving them a chance but they have to have full reins that said there is things happening which could see metis leave altogether I for one see that as a negative I want them to continue in what guise they see fit

The BBC suggested it wasn't. Can an accountant then tell us the value of our invididual pots? Is that so dam difficult?

- BRIAN DOWNS| 6 repliesWe are the accountants who are acting for the Capita Oak scheme and have now almost completed our financial enquiries and as promised we will report to all members of our findings. The last piece in this situation is who and when did store first pay the return monies to as it was not Imperial or Capita Oak or anyone connected as far as I have so far been informed with respect to all on this site so much nonsense and untruths have been written. For example Maria Orolfo was appointed by James Hadley and also removed by him. Should you have any questions you can ask me.
