- Gav| 3 repliesThis is ridiculous.
We're not playing some kind of quiz here. A lot of people want answers to as Angie has advised "Simple straight forward questions"
If you generally have nothing to hide then why such a delay?
I think the majority have been very patient and conducted themselves respectfully for too long.
Something has got to give otherwise this is just going to go on and on and on. - brian downs replies to Gav| 2 repliesgav i can assure that i have answered all miss brooks questions that i can and have also pointed out to her that there is no missing 1.2 million that she has declared i am sorry but she has not approached the task correctly as if she had she would not have claimed that the 1.2 was missing . i am sorry that is a point of fact . the accounts and report have gone to the director for his approval and will then be sent to all members
- balance sheet| 2 repliesIt will be interesting reading, what value will that show! Is anyone in charge of this mess taking legal action to get the rent that suddenly is not really in Gibraltar any more!!!!!!!
- den replies to balance sheetMetis Law are waiting for authorisation from Roger Chant to appoint a valuer as he is the director of Imperial..Metis reckon a valuation will not be complete until atleast late January 20 15
Roger Chant get your finger out!! You keep stalling you will have 300 very pissed off people to deal with very soon WE WANT OUR MONEY AND YOU ARE STOPPING US GETTING IT - Angie replies to balance sheetIt never was in Gibraltar. Transeuro was registered in Gibraltar but the directors were anonymous nominees in Nevis in the West Indies (somebody really didn't want to get caught) but according to the BBC their offices were at Store First's premises in Goodlass Road. Transeuro was connected to Thurlstone (who gave out the loans connected to Capita Oak) and there is a sum of 100,557.58 which was paid to Thurlstone by Metis Law Solicitors and this amount also appears on the Imperial bank statements at least twice. The fraudsters are doing everything in their power to suppress the evidence but it will all come out - probably sooner rather than later now the police are on the case and the Ombudsman has made his determination and the whole Capita Oak/Imperial scam is firmly in the public domain. All those covering up and using smoke and mirror tactics will get exposed.

- Angie replies to neat & tidy| 7 repliesLol. But at least he can now spell "auditor"! Seriously, though, I think your post does raise an interesting issue. If the promoters and organisers of Capita had been honest about the investment in the pension it would not have been fraud. If they had made it clear that 100% of the assets would be illiquid, high-risk and without diversity; that there would be no liquidity (so nobody could retire, transfer out or die); that there were no valuations on the properties purchased; that the properties would be put into the name of Imperial rather than Capita Oak; that there was no trustee; that no accounts would be done and no investment manager appointed; that pension liberation constituted unauthorised payments and the Thurlstone loans would be taxed at 55%; that the 8% "guaranteed" rental income was only guaranteed to be paid to the fraudsters operating the scheme who would also be paid 30% introduction commission, and the member was still happy to transfer - then that would not have been fraud. If a member had been happy to accept those risks at the outset, and was fully aware of them, there could have been no cause for criticism or criminal complaint.
- CONFUSED replies to Angie| 2 repliesPlease can somebody clarify, if HMRC seeks 55%, is it of the full pension transfer amount or of the 5% payment made by Thurlestone?
- Ombudsman ruling replies to Angie| 3 replieshttp://www.eversheds.com/global/en/what/artic ... sions_Ombudsman
This story is gathering momentum with lots reporting on it now - Angie replies to CONFUSED| 1 replyThere will be a 55% unauthorised payment charge on the 5% Thurlstone loan, but there may also be a 40% sanction charge on the scheme itself. But much more worrying is that if tPR/HMRC deem that Capita Oak was never a genuine pension scheme, there could be a 55% tax charge on the entire transfer. The problem is that it is clear that Capita Oak was never set up to provide retirement income and tPR and HMRC can prove this by the fact that 100% of the assets were invested in an illiquid property investment with no clear exit strategy, and no liquidity maintained to pay out retirement, transfer or death benefits. This is why I have been trying so hard to get Metis Law, JWK and Downs & Co to cooperate so that we could sort all this out. But each party, for their own reasons, has refused to cooperate.
- Tax replies to AngieWould the people that designed this have known this could of happened when they set the thing up at the start? Or is this something that could of not been predictible? Why would the revenue tax the pension at 40%, the investors are not the ones that b..g..ered this up! That sanction sounds like a penalty on the scheme, but the people have money in the scheme and how is the the fault of the people in it?
- momemtim replies to Ombudsman ruling| 1 replySure is
http://www.professionalpensions.com/professio ... ransfer-request
While Chant is reviewing the accounts will he have time to respond to the omsbusdman or will he ignore this? - John jI don't care if don't get interest back only just what I put into the pension then if am to get penalised by HRMC then peeps should be made to pay the fines also! This would give opportunists something to think on if continue losing their homes and assets would be fantastic :-)
- paul t replies to momemtimAll the "pink financial press are picking up on after the ruling (as they do when something like this) ..
This may alert IFA ' S if they've seen something recently on behalf of someone...and not thought much of it....so the more press the better, obviously.
had a meeting with a smaller SIPP provider today and I am waiting on a reply as to whether that provider has accepted monies into their accounts vis Storefirst (though I suspect the answer will be no) - Anon| 26 repliesAll roads lead to TW, him and Stuart Chapman Clarke are very good friends...and take a look at who was at the groupfirst Xmas party in 2012:

People have been conned by these crooks who are all linked. You get the pensions from innocent ppl, invest in my store first...I'll then pay to another company that we cannot be linked too. TW left a lot of people devastated in his Dylan Harvey days. Now he's flying in helicopters..lives in a mansion and drives cars with expensive number plates all over the suffering of hardworking ppl.- Caller: Asdfhj
