A WEALTHY businessman has lost an employment tribunal after it was ruled that he had kissed and groped a teenage employee despite his wife being in the next office.

Donald MacLeod, 44, a director of the family firm DM Design Bedrooms Ltd, of Cumbernauld, was yesterday ordered to pay £1,070 in compensation to a telesales canvasser, Lindsay Wallace, 19, for unlawfully sexually discriminating against her.

Mllionaire businessman had asked to see the girl’s tattoos before the tribunal heard how he tried to kiss her and put his hands on her bottom.

At an earlier hearing in May, MacLeod admitted asking her for a kiss in exchange for a piece of wood, but claimed Miss Wallace initiated the advance.

Miss Wallace, from Eastfield, Cumbernauld, had asked MacLeod for a piece of wood in July last year. As they went to collect it from the warehouse, he inquired about her tattoos.

Miss Wallace, who has a tattoo on each arm, three on her hip, and one on her thigh and ankle, added: “He asked to see any ones that weren’t on show. I declined.”

After finding a piece of wood, they returned to an office within the building.

Miss Wallace continued: “He then approached me, tried to place his hands on me, put them around me, then on my bottom. I backed off and asked ‘How do I get out of the office?’ I was confused and very upset.”

MacLeod denied Miss Wallace’s version of events. However, he conceded that he did ask the teenager for a kiss, before insisting that she then made an advance on him.

In a written judgment yesterday, the Glasgow tribunal ruled: “We had no hesitation in preferring the evidence of the applicant to the evidence of Mr MacLeod. We made a close examination of the demeanour of each when giving evidence. We considered Mr MacLeod’s demeanour to be somewhat evasive.”

Sounds a nice firm!

I'm getting calls every day (including Sundays), ignore them but the ringing still disturbs us - and if the phone's hanging up to charge & have to go & look at the display

Got a cold call from male, Scottish accent, professional sounding, offering free vouchers, saying from 'Harvey & Grant'.  I mentioned I'm registered with TPS.  I gently and courteously asked where he had obtained my telephone number.  He said 'Toilet wall'  Thought I'd misheard company name, and asked him to spell it.  He did, sniggered, and hung up.  Obtained this tel no by dialling 1471 (last caller).  Tried calling that, thinking to speak to a supervisor, but constantly an unusual, high beeping tone (similar to engaged tone)..    Checked the company details online. That company (Glasgow address) was DISSOLVED in 1996, so call seems fraudulent?  Insult could be very distressing to a vulnerable person.  I felt disturbed by it.  Assuming few would waste their time just to insult strangers, I'm guessing that he planned some scam.  Since then, by Googling company name, I found another collection of contributions like this, (evidently same callers) but for a different telephone numbers.0247632  1330 0247-632  1330 0845 632  1330

Keep getting calls from these dafties, going to invest in a referees whistle tomorrow, and spend a while phoning their 0800 number (+141), and using said whistle. I live in Kirkcaldy too, makes it even more galling somehow.

Now calling themselves Campbell and Cole offering 10 1k vouchers. I didn't let them finish. Caller was Scottish.

This type of comment makes me cross!!!! If I wanted to update my kitchen/bathroom/kitchen I would approach companies for further details. Also to hang up without any comment is DOWNRIGHT BAD MANNERS and not very professional.

We too have been pestered for several months....asking for a "Mrs McCafferty"...sometimes an Asian male, sometimes a well spoken female....We keep telling them wrong number and asking them to remove our details from their Database.

Called asking if i was my wife (duh) and proceeded to tell me about some kind of vouchers i had won. When i said we were tps she promised to get my number taken off the list and politely ended the call. Scottish accent.

Called and asked to speak to me - gave me my address and asked to confirm and for data Protection purposes asked for my post code.  

Put the phone down on him when I assumed he was trying to sell me a new kitchen

WHY DID HE CALL - I registered with the telephone preference service some years ago

Just had this number call us at 8.15pm. Didn't answer as I didn't recognise it. I am registered with TPS also. Really annoying.

had a call from 01592642600 earlier today. when i answered i heard female saying all he ever goes on about is his love life, when i said hello the female immediately hung up. sorry no info on them and personally i am not interested in anyone's love life so wont be answering that number again.

asked if we were home owners and said something about vouchers my husband said he wasn't interested and was told he could have said that in first place in stead of wasting his **** time

phone rang twice, second time just 3 rings and when i phoned back got this strange tone. another waste of space I presume.

Got a call this morning from some smarmy young man who immediately got defensive when I asked if this was a sales call. He said he had already stated it was not a sales call but was going to offer me £800 of vouchers if I answered some 'retail questions'. I mentioned TPS and this man became quite ill-mannered, obviously not the behaviour of someone who works for a genuine company. I hung up but am going to complain to TPS and would urge others to do the same.

Got a call saying that I had won £800 or so if I could answer three questions.   I said I was registered with the TPS so as not to receive unsolicited calls of this type and they apologised and said they would 'remove me from their database.'   Hope this is the end of it !

This number keeps calling me. They can be very offensive. I have a TPS number. I have complained to them but it makes no difference  obviously.
