I keep getting repeated calls from this number...I never answer and they usually stop calling after a week or two...but then it starts again a few months later!
As I said I never answer, and of course they don't leave messages - until yesterday! I was surprised to see that I had voicemail after the call came through, so checked it out. What I heard was pretty funny. It seems that, perhaps in a rush to get a slice of cake, the person that called me forgot to hang up, and I was treated to the muffled sounds of a bunch of Indians singing Happy Birthday to someone in their office...and then 'Happy Long Life to You' - can't say i've heard that one before. Then someone making a speech and it went on and on...
I have saved the message in the hope that I will catch out these dum dums one day....

    Hmmmmm
    Interesting development.
I found out last night that my residential number is listed online with a few business directories under a business I have no connection with. Hotfrog and heylocal were 2 directories.
The directories have been notified of the error and were happy to help.
Just this morning I received a call from this number advising me that were from optus, and they were under the impression that they had called the business which was listed on the directories.
I told her that I was not the said business, asked me if this was a business or residential number and bid me farewell.

I got a call from this number and actually spoke to the person on the line; apparantly if you have some service or other with Optus, the marketers from Optus can call you regardless of you being on the do not call register.
I asked how i could be taken off the marketing list and was told - just tell us!
So I did, and they said they'd take my number off their list within 24 hours.

03 9937 7700 called, claiming to be Optus, asked for my details to "update their database". The operator said they would give me a "free $50 voucher if you provide your email address". I asked them to provide my current details on record and they could not provide them. When I questioned why they would not provide any credentials they said "no problem, have a nice day" and hung up. DODGY!!!

There is a world of difference between merely getting an opinion and being asked to buy something. Researchers are not telemarketers! There is a big, big, difference in law for that one. In Australia, it is quite legitimate for research companies like OCIS (Oceania Customer Interaction Services) to survey you (http://www.mrsa.com.au/index.cfm?a=detail&id=2706&eid=140). This can happen to you even if you are on the Australian "Do Not Call Register" (search for it on Google) and you have a silent number. Do not blow a head gasket if it happens to you. Instead, know your rights.

If you are on the “Do Not Call Register”  (https://www.donotcall.gov.au/enqcomp.cfm) it is ILLEGAL (under the Australian Trade Practices Act 1974 http://www.austlii.edu.au/au/legis/cth/consol_act/tpa1974149/s52.html) for a research employee from a research company like OCIS, or any other telemarketer for that matter, to use deceptive practices to try and "bait-and-switch" you from an initial market research call, into a selling call. This may allegedly happen during research calls for Optus approved research (http://forums.whirlpool.net.au/forum-replies-archive.cfm/1122207.html)

Companies like OCIS probably approach you with a name because you have agreed to accept market research calls about Optus (yes, without even being aware of how you consented with Optus). You can remove this unconscious ‘election’ by calling Optus (the slow way). Another scary way is to contact companies like OCIS directly (the fastest way).  You can send them all a hard-line message that they clean up their ‘pseudo selling’ act shenanigans or they lose your co-operation for all and any research they may be contemplating. Even go one better, get in their face and demand something for your time and information, or you will not play. Do not lie down and think of England without finding out your hourly rate. Try this. Ring, ring, ring, 03 9937 7700 calling, “Hi, I’m from Optus.” You say, “Really?” They say, “Oh yeah, trust me.” You say, “Oh you did not just go there! You are not. You are a researcher for OCIS!” They say, “Umm oh yeah, you got me there. I remember now.” You say, “So what are you going to give me for free? To talk to you that is?” Click.

Now, if a researcher like OCIS calls you, they usually do so because phone companies like Optus ask them to. The trick is to listen for their identity. Get the researcher out of the delusion that they are an Optus employee. They are not Optus. Let them know you know you guessed Clark Kent was Superman. They do not have an Optus employee number and Optus does not bank their wages. Truly, researchers like OCIS are OCIS research staff acting for companies like Optus in a very limited research capacity. They say, “Do you really, really like Optus.”  You say, “Yeah sure.” They say, “Okay, outstanding! We will let ‘em know. Take care now. Bye.”

With your consent, providers like Optus give researchers limited info about you (your first name) so bananas like OCIS can survey you about Optus services. Some researchers ‘bodgey up’ their call rates by phoning you endlessly and hanging up without talking to you. If it is 03 9937 7700 bombing you, phone up the OCIS CEO and let him know his employees are ghost calling you. Phone monkey’s can pretty much claim almost anything about what happened, and only that company will know. Sure as eggs Optus isn’t going to run down to OCIS with their lawyer and a contract to check the recordings of their calls made to you. That’s right, ask if OCIS is likely to be record your call (for research purposes of course). Ask them if they are.

But, and this is a big one, if researchers like OCIS even hint at or attempt to switch you into buying something, you should get the operator’s name, every detail you can about the call, and as many details as you can about the product they are trying to sell you.

Here is a possible way it goes. A researcher slips in a research question something like “Is it likely ou have ever considered an alternative phone service?” Without thinking, you say “Doh, or yer, sure, yes!” What were you thinking? Not much, I guess. The researcher can then claim to be off the research hook with your approval (of course). Hey, you started it, you implied you wanted to buy! No actually, you said, “Hey I’m feeling generous, sell me something.”

So let us ask the operator if they know it is illegal to switch from an opinion research call to a sell call. However, do not do this early, because they get out from under any incriminating evidence. If you think you smell a breach of the Trade Practices Act, you should immediately approach MSRA (the Australian professional membership body of marketers) and ACMA (the part of the Australian government that runs the Australian "Do Not Call Register"). If you smell the foul odour of a bait switch, go CSI on them and collect as much evidence as you can write down. Lodge a formal complaint for investigation with ACMA. Complaints to MSRA may see continuous offenders booted out of the industry body. LOL, yeah sure like that is ever going to happen.

Basically, paid bimbos like OCIS and others are not allowed by law to switch from being market researchers into telemarketers while they are performing an authorised role as a contracted agent to providers like Optus. If we bounce some big bad fruity fines off their numbskulls then maybe they will sit back down.
